Agency Role and Limitation of Liability

Staple Travel LLC, an independent limited liability company that is neither controlled by nor controls any third party with which it contracts, works as an agent for third party suppliers of travel offerings. Arrangement of travel components includes, but is not limited to, coordination with vendors of accommodations, flights, touring, cruises, transportation, and other independent contractors. Services are provided to any party on the explicit provision that Staple Travel LLC shall not be liable for any injury, loss, damage, delay, or interruption of travel at any point prior to, during the course of, or following travel, regardless of nature.

Client Responsibility for Information Accuracy

Information provided to Staple Travel LLC may be used for arranging travel services. It is the sole responsibility of the Client to ensure all information provided is accurate. It is the responsibility of the Client to review confirmations and other documents for accuracy promptly upon receipt and to share concerns or questions in a timely manner.

Advisory Fee & Revisions Policy

All advisory fees are fully nonrefundable. These fees are required upfront in order to initiate any aspect of the travel planning process, including but not limited to itinerary design, travel advising, coordinating or reserving travel components, and other related services. Advisory fees are not deposits and are not applied toward the cost of travel. The advisory fee is considered earned upon payment in exchange for the professional expertise and time required to begin the research and design process.

An advisory fee covers a single trip as represented by the Client during the initial consultation process. If the Client requests significant changes to the scope of the trip once the planning process is underway, including but not limited to a change of destination, fees will be subject to reassessment. Upon receipt of the advisory fee, Staple Travel LLC agrees to provide an initial itinerary proposal with up to two revisions. After these revisions, the advisory fee may be reassessed if additional changes are requested. Payment of the advisory fee confirms the understanding and acceptance of this policy by the Client.

Price Fluctuations and Authorization to Proceed

Upon completion of a credit card authorization for a travel reservation, the Client authorizes Staple Travel LLC to proceed with the transaction if the final price fluctuates by an amount up to $300 per item from the initially quoted rate. In the event of such a fluctuation, Staple Travel LLC will notify the Client of the change after the transaction is processed. The purpose of this policy is to mitigate the risk of losing availability for desired reservations due to minor price fluctuations that occur between the time of authorization and final booking.

Pricing and Inclusions

All quotes provided are subject to availability and price changes until a deposit is received and the reservation is confirmed by the supplier. Prices involving foreign currency are subject to exchange rate fluctuations until the payment is processed in full.

Many of the specialized suppliers and partners Staple Travel LLC works with provide pricing as a total bundled rate for itinerary packages rather than a line-item breakdown of individual costs. This is a standard industry practice used by premier partners to protect privileged and negotiated rates that are not available to the general public. Providing a single package price also allows these partners to maintain the integrity of the high-level service and curated experiences they provide.

Chargeback Waiver

By providing credit card information and authorization, the Client agrees that the services provided are valid and the Client waives the right to initiate a chargeback with the credit card issuer for any authorized fees or travel components.

Travel Insurance Disclaimer

Staple Travel LLC strongly recommends that the Client purchase comprehensive travel insurance, including coverage for trip cancellations, medical emergencies, and repatriation, to safeguard against any unforeseen circumstances that may arise due to failure to meet entry requirements or other travel disruptions. Neither Staple Travel LLC nor its agents represent credentialed insurance agents and do not dispatch insurance policy advice in any official capacity. Staple Travel LLC facilitates initial travel insurance quotes, provides resources for further inquiry, and can assist with policy purchases and servicing.

International Travel Documentation and Entry Requirements

The responsibility to understand and comply with all foreign entry requirements lies solely with the Client. This includes, but is not limited to, obtaining and verifying the accuracy of visas, vaccinations, travel insurance, health certifications, and any other required travel or immigration documentation. It is also the sole responsibility of the Client to ensure that the passport is valid for the required period of time for each destination, which is often a minimum of six months beyond the date of travel.

This requirement applies to all international travel, whether the components are organized by Staple Travel LLC or otherwise. While Staple Travel LLC may provide general guidance regarding entry requirements for specific destinations, such guidance is for informational purposes only. It is the sole responsibility of the Client to verify and ensure all entry requirements are met prior to departure through official government channels. Staple Travel LLC shall not be liable for any costs, delays, or other consequences resulting from the failure to meet the required entry or travel documentation requirements. In the event that a Client is denied entry to a country or boarding of a vessel or aircraft, the Client shall bear all associated costs and Staple Travel LLC will not be held liable for any resulting losses, expenses, or missed trip components.

Traveler Health and Conduct

Clients are responsible for ensuring they are in appropriate health for chosen activities. Staple Travel LLC is not liable if a Client is unable to participate in an activity due to health reasons or personal conduct.

Force Majeure

Force Majeure refers to any event or circumstance beyond the reasonable control of Staple Travel LLC, including but not limited to acts of God (such as natural disasters or severe weather conditions), war, civil unrest, strikes, government actions, pandemics, travel restrictions, airline or transport disruptions, or any other event that could not have been anticipated or prevented despite reasonable efforts. Staple Travel LLC shall not be held liable for any failure to provide services, make arrangements, or fulfill any other obligations under this agreement where such failure is due to Force Majeure. If Force Majeure circumstances prevent the Client from using the travel arrangements, the Client agrees to bear all costs and responsibility for changes, cancellations, or adjustments to travel plans.

Governing Law and Venue

These Terms and Conditions shall be governed by the laws of the State of Illinois. The Client agrees that any legal action arising out of this agreement shall be brought exclusively in the state or federal courts located in Cook County, Illinois.

SMS Communications and Privacy

By providing contact information, the Client consents to receive SMS (text) messages from the Staple Travel LLC business line. These messages may include trip updates, appointment reminders, and other relevant communications. Staple Travel LLC will never sell a phone number or message content. Standard message and data rates may apply depending on the mobile carrier. While Staple Travel LLC takes reasonable steps to protect privacy, clients should avoid sending sensitive personal information via SMS. The Client may opt out of SMS communications at any time by replying "STOP."

Third-Party Supplier Terms and Responsibility

The Client acknowledges and agrees that, in addition to these Terms and Conditions, all travel arrangements made by Staple Travel LLC may be subject to the terms and conditions of third-party suppliers, such as airlines, hotels, tour operators, and transport providers. The Client agrees to comply with and be bound by the terms, conditions, policies, and regulations of these third-party suppliers. Staple Travel LLC acts solely as an intermediary in arranging travel services and is not responsible for the performance, quality, or actions of these third-party suppliers. In the event that the services of any third-party supplier fail to meet the expectations of the Client, the Client agrees to directly address such issues with the supplier.
