CMV COMPLETE TERMS AND CONDITIONS
1. INTRODUCTION
These Terms and Conditions ("Agreement") constitute a legally binding contract between
[Creating Magic Vacations LLC] ("Agency," "we," "us," or "our") and the client ("Client," "you," or
"your"). By engaging our services, you acknowledge that you have read, understood, and agree
to be bound by these terms.
2. AGENCY ROLE
2.1 Travel Agency Services
We act as an intermediary between you and travel suppliers, including but not limited to airlines,
cruise lines, hotels, tour operators, and car rental companies ("Suppliers"). We arrange travel
services on your behalf based on your instructions.
2.2 Supplier Relationship
The Agency does not own, manage, control, or operate any vehicle, hotel, resort, cruise ship,
restaurant, or attraction. We select reputable Suppliers, but we cannot guarantee their
performance. All bookings are subject to the terms and conditions of the relevant Suppliers.
3. BOOKING AND PAYMENT
3.1 Booking Process
All bookings are subject to availability at the time of reservation. We reserve the right to decline
any booking at our discretion.
3.2 Deposit Requirements
A non-refundable deposit is required to secure most bookings. Deposit amounts vary by trip
type, destination, and Supplier requirements.
3.3 Final Payment
Final payment is due according to the specific terms outlined in your supplier's confirmation
documents. Payment deadlines vary by supplier and travel type and will be clearly
communicated in your booking confirmation. Failure to make the final payment by the supplier's
required due date may result in cancellation of your booking and forfeiture of any deposits or
payments made.
3.4 Payment Methods
By providing your payment information, you authorize us to charge the applicable fees and
acknowledge that no further authorization is required.
3.5 Agency Fees
We may at times charge professional service fees for our expertise and time in planning and
managing your travel arrangements. These fees are non-refundable and will be clearly
disclosed prior to booking if applicable.
4. PRICING AND FEES
4.1 Price Changes
All prices are subject to change without notice until full payment is received and
tickets/documents are issued. Even after payment, prices may increase due to government-
imposed taxes or fees, currency fluctuations, or Supplier surcharges.
4.2 Inclusions/Exclusions
Pricing generally includes only the items specifically listed in your confirmation. Unless explicitly
stated, prices do not include optional excursions, travel insurance, passport/visa fees, gratuities,
personal expenses, or any other items not listed.
5. DOCUMENTATION
5.1 Travel Documents
You are responsible for obtaining and maintaining all necessary travel documents, including
valid passports, visas, permits, and certificates, as well as for complying with all applicable laws,
regulations, orders, and requirements of the countries to be visited.
5.2 Passport Requirements
Most international travel requires a passport valid for at least six months beyond your planned
return date. Some destinations require passports to have two to four blank visa pages for entry
stamps.
5.3 Visa and Entry Requirements
Entry requirements vary by destination and citizenship. While we may provide general
information, it is your responsibility to confirm and obtain all necessary visas and meet all entry
requirements.
5.4 Health Requirements
You are responsible for ensuring you meet all health requirements for your destination, including
vaccinations, tests, or other precautionary measures that may be required.
6. CHANGES AND CANCELLATIONS
6.1 Changes by Client
Changes to bookings are subject to availability and may incur fees from both the Agency and
Suppliers. Change fees vary based on the Supplier, timing, and nature of the change.
6.2 Cancellation by Client
All cancellations must be made in writing. Each booking is subject to the specific cancellation
policy of the supplier(s) providing your travel services, as outlined in their confirmation
documents. These policies vary widely by supplier, destination, travel dates, and type of service.
Cancellation penalties typically increase as the departure date approaches and may result in
100% non-refundability within a certain timeframe before departure. The exact cancellation
timeline and associated penalties will be clearly communicated in your supplier's confirmation
documents.
Please note that some travel arrangements, including but not limited to special event tickets,
certain airfares, and holiday packages, may be 100% non-refundable from the time of booking.
6.3 Changes by Suppliers
Suppliers may need to make changes to your booking due to weather, mechanical issues, or
other unforeseen circumstances. The Agency is not responsible for such changes.
6.4 Force Majeure
Neither the Agency nor any Supplier shall be liable for any delay, change, or cancellation due to
circumstances beyond reasonable control, including but not limited to acts of God, pandemic,
war, terrorist acts, strikes, riots, civil disorder, government actions, natural disasters, or technical
problems with transportation.
7. REFUNDS
7.1 Refund Policy
Refunds are subject to Supplier policies. Agency service fees, if applicable, are non-refundable
regardless of the reason for cancellation.
7.2 No-Show
Failure to check in or board transportation as scheduled is considered a no-show and will result
in automatic cancellation of all remaining arrangements and forfeiture of payments made.
7.3 Unused Services
No refund will be provided for any unused portion of travel, including but not limited to missed
flights, hotel nights, or activities, regardless of the reason.
8. TRAVEL INSURANCE
8.1 Recommendation
We strongly recommend purchasing comprehensive travel insurance that includes coverage for
trip cancellation, interruption, medical expenses, emergency evacuation, baggage loss, and
other contingencies.
8.2 Acknowledgment
By declining travel insurance, you acknowledge the risks of uninsured travel and accept full
financial responsibility for any expenses that might have been covered by travel insurance.
8.3 Policy Terms
All insurance policies are subject to the terms and conditions of the insurance provider, and we
act only as an intermediary in offering such policies.
9. LIMITATIONS OF LIABILITY
9.1 Agency Liability
Our maximum liability to you under any circumstances is limited to the amount paid to the
Agency for our services, excluding any payments made to Suppliers.
9.2 Supplier Liability
We are not responsible for any acts or omissions of Suppliers or third parties, including but not
limited to delays, cancellations, overbooking, schedule changes, routing changes, mechanical
failures, strikes, terrorism, criminal acts, weather conditions, or other circumstances beyond our
control.
9.3 Claims
Any claim against a Supplier must be made directly to that Supplier in accordance with their
policies and procedures. You agree to pursue any claims directly with the Supplier before
involving the Agency.
9.4 Information Accuracy
While we strive to provide accurate information, we cannot guarantee the accuracy of
information provided about destinations, accommodations, or services. We are not liable for any
inaccuracies or discrepancies in descriptions.
10. CLIENT RESPONSIBILITIES
10.1 Special Requests
Special requests (such as room location, bedding type, diet requirements, or disability
accommodations) must be made at the time of booking. While we will forward such requests to
the relevant Supplier, we cannot guarantee they will be honored.
10.2 Travel Behavior
You agree to comply with all rules, laws, and regulations of the destinations visited. The Agency
reserves the right to refuse service to anyone whose behavior interferes with the operation of
travel services or with the enjoyment of fellow travelers.
10.3 Medical Conditions
You must inform us of any condition, medical or otherwise, that may require special attention,
accommodation, or treatment during your travel at the time of booking.
10.4 Accessibility
Not all travel accommodations and services are accessible to those with disabilities. You are
responsible for informing us of any special requirements.
11. MISCELLANEOUS
11.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of
Florida, without regard to its conflict of law principles.
11.2 Dispute Resolution
Any dispute arising from this Agreement shall be resolved through binding arbitration in the
State of Florida.
11.3 Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be
struck and the remaining provisions shall be enforced.
11.4 Entire Agreement
This Agreement, together with the booking confirmation and any attachments, constitutes the
entire agreement between you and the Agency and supersedes all prior agreements or
understandings.
11.5 Privacy Policy
We respect your privacy. Our privacy practices are described in our Privacy Policy, which is
incorporated by reference into this Agreement.
11.6 Communication
By providing your email address, you consent to receive all correspondence related to your
booking electronically.
11.7 Assignment
This Agreement may not be assigned by you without our prior written consent, but may be
assigned by us without your consent.
12. ACKNOWLEDGMENT
By engaging our services, you acknowledge that you have read, understood, and accepted
these Terms and Conditions. You also acknowledge that you are authorized to accept these
terms on behalf of all travelers in your party.
