CONTRACT

Please carefully read all of the Terms and Conditions of travel below, these Terms and Conditions including all brochures, documents, correspondence and the terms and conditions of our travel vendors form the basis of the contract with you. Before making a booking with us you must ensure that you have read and understood these Terms and Conditions (and ask any questions you may have). Please be aware that these Terms and Conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses, all of which affect your legal rights. By asking us to confirm your booking you are accepting all the Terms and Conditions laid out below and acknowledging that you have read the Terms of this Contract and agree with it. The terms “we”, “us”, and “our” and LUXE LEVEL ESCAPES refer to LUXE LEVEL ESCAPES and the terms “you”, “your”, “client”, “my” and “customer” refer to the individual who makes a booking with us and all members of their group. 

OUR RESPONSIBILITIES 

LUXE LEVEL ESCAPES offers a variety of travel related products from different Suppliers and service providers ("Suppliers"). Each Supplier has its own terms and conditions that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Our website, which is referred throughout this Agreement, can be found at https://luxelevelescapes.com/

LUXE LEVEL ESCAPES does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that LUXE LEVEL ESCAPES is acting as intermediary or a "Booking Agent" for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services. 

Any disability requiring special attention must be reported to LUXE LEVEL ESCAPES at the time the reservation is made. LUXE LEVEL ESCAPES will make reasonable attempts to accommodate the special needs of travelers, but are not responsible in the event it is unable to do so nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. 

LUXE LEVEL ESCAPES shall never be held responsible for any loss, accident, injury, delay, defect, omission, or irregularity which may occur or be occasioned, whether by reason of any accident, negligence, closing or default of any independent company or persona engaged in or responsible for carrying out any of the arrangements or otherwise in connection therewith. It is highly recommended that Customers purchase a travel protection plan. 

SUPPLIER QUOTES AND PRICING  

Availability and price quotes are applicable to the date and time at which they are requested and cannot be guaranteed until payment is made in full. LUXE LEVEL ESCAPES will ensure client receives quotes, deadlines, deposit, refund, and cancellation details within a timely manner to make financially prudent travel decisions. 

Upon booking, we will provide you with instructions of payments and all due dates.  You must make all payments in full and on time.  Failure to make a payment may result in the cancellation of your travel.  In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect. 

LUXE LEVEL ESCAPES will notify client of the supplier’s refund, change and/or cancellation fees and penalties during the proposal phase. Client is aware that the airline ticket, especially holiday, group and discounted fares may be subject to the loss of some or all of the fare or require expenditure of additional money if client elects to change or cancel the reservation. 

LUXE LEVEL ESCAPES will make every effort to request that suppliers honor and uphold price as originally quoted; however, under certain circumstances additional costs by a supplier or government may be imposed due to an increase in cost for one or more of the travel components, which is the responsibility of the customer. 

If travel is outside of the U.S., some components of the quotes are from foreign suppliers. Customers must note that currency fluctuates daily with exchange rates, and international payments may carry a foreign traction fee, which is the responsibility of the customer. 

Flight confirmation is subject to availability and prices are subject to change after the date of quote or deposit, including price increases in the fee for a seat assignment, fee for baggage, applicable fuel surcharges and/or an increase in government-imposed fee(s) or tax(es). LUXE LEVEL ESCAPES does not own, control, manage or operate any airline and your agreement as to any flight will be with the Air Carrier. We do not control any special requests made with airlines.  You should read and understand the Air Carriers’ terms and conditions. 

CLIENT RESPONSIBILITIES

Client agrees to the following: 

  1. Agrees to be attentive and responsive to adviser communications with the understanding that some information may be time sensitive, which may affect pricing. 
  2. Agrees to make payments by the stated deadlines. 
  3. Agrees to take responsibility for completing travel specific duties, such as, but not limited to visas, passports and/or inoculations. 
  4. Agrees to take responsibility for reviewing and adhering to any COVID-19 or similar related policies or restrictions while traveling. 
  5. Agrees to encourage friends/family/colleagues/fellow travelers to make reservations exclusively through LUXE LEVEL ESCAPES for group rates and added benefits. 
  6. Give due diligence to relevant travel warnings. 
  7. Provide LUXE LEVEL ESCAPES a method of contacting Customer in the case of an emergency. 
  8. Agrees to let LUXE LEVEL ESCAPES know of any accommodation condition or services that are unsatisfactory during this travel. 

TRAVEL PLANNING FEES 

Any applicable planning or service fees will be fully disclosed prior to starting your travel planning journey with LUXE LEVEL ESCAPES. All Service Fees and Planning Fees charged by LUXE LEVEL ESCAPES are non-refundable and are separate from the cost of your trip and may be split between multiple travelers.  

Our planning fee is integral to covering the time spent researching, pricing, compiling, and organizing your booking. If your trip is not finalized and deposited within 30 days, we must treat it as a new booking, which incurs a fresh planning fee. This is necessary due to the need for re-pricing and reorganizing your trip based on current availability. Additionally, should the scope of your trip change significantly, a higher planning fee may apply to accommodate the additional work required before more work can continue. 

Below is a guideline, but yield to the specific amount in your agency agreement you sign and the planning charge invoice.  

DEPOSITS AND PAYMENTS

A deposit, as indicated in your quote, along with a completed client profile form is required for all new reservations with LUXE LEVEL ESCAPES. All payments made towards the elected trip are non-refundable and non-transferable. Please be sure your calendar is free and you are able to take your planned LUXE LEVEL ESCAPES prior to submitting a deposit. 

Final payment dates are clearly noted on the invoice and/or website of the event you have selected as well as listed in your monthly statements. All late payments will be assessed a late fee of $50. You must contact LUXE LEVEL ESCAPES prior to final payment if there will be a delay in making the final payment. You must send your request by email and provide the date that the final payment will be made. Permission to make a late final payment is at the sole discretion of LUXE LEVEL ESCAPES. 

If you fail to make your final payment by the final payment date and have not received authorization to make a late final payment, your reservation will automatically cancel and all previous payments will be forfeited. 

As we are acting as your Booking Agent, any supplemental increases in price due to fuel costs, taxes, fees, and currency exchange rates will be borne solely by the consumer and thus we will pass on any such increase to you as we become aware of such increase. Subsequently, you are not guaranteed a lower price if at any time prior to your travel the price decreases. 

DOCUMENTATION 

Our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you make a request for such documents to be sent as a hard copy.

CREDIT CARD PAYMENTS

While LUXE LEVEL ESCAPES and or travel vendors accept major credit cards including Visa, MasterCard, American Express and Discover, all travelers are required to complete an online credit card authorization form for every transaction for your trip. No payments will be processed unless the form is completed. Your authorization is an agreement for us to charge your card and an acknowledgement and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks. Payments are only accepted online. 

In certain cases, you may dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. LUXE LEVEL ESCAPES retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims: 

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used. 
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud. 
  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description. 
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of LUXE LEVEL ESCAPES or the travel vendor. 
  • Chargebacks resulting because you do not agree with the cancellation policy. 

CHANGES AND CANCELLATIONS 

Your agreement with your Suppliers may grant them the authority to cancel or modify bookings. Suppliers retain the right to adjust prices to accommodate rising expenses, including fuel surcharges, tariffs, taxes, and fluctuations in foreign exchange rates. 

If we are your Booking Agent, we commit to promptly informing you of any significant alterations as soon as we become aware of them, provided there is sufficient time before your departure. However, we assume no responsibility for any resulting changes or expenses incurred. Subject to the terms and conditions set by the Supplier, you will then have the option to accept the revised arrangements, consider an alternative travel proposal if one is offered by the Supplier, or cancel your existing arrangements and potentially receive applicable refunds. We cannot guarantee the availability of refunds in all cases. 

Once purchased, air transaction prices will not increase, except for potential charges that result from government-imposed taxes or fees. You consent to pay for such changes and authorize LUXE LEVEL ESCAPES to charge your credit card for such additional amount, albeit rare. 

If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the United States, we will contact you by email to advise you of this. Please ensure that you have given your contact email address to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.  

If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage. 

YOUR AGREEMENT WITH US 

YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS 

By booking your arrangement with LUXE LEVEL ESCAPES or using our website, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. 

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct.  

If you are making a booking as a group, the lead customer of the group is responsible for sharing these Terms and Conditions with all members of the group and you are financially responsible for any use of our services or website by you and those using your name or account. We will not be liable for a group leader’s failure to share these Terms and Conditions with all members of their group. 

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you is true and correct. 

IF YOU CHANGE YOUR BOOKING

Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Our non-refundable, Standard Change Fees are as follows: 

  • All Non-Group Bookings: $25 per person + any change fee charged by the supplier or airline, if applicable 
  • All Group Bookings: $25 per person + any change fee charged by the supplier or airline, if applicable 

Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased. 

Changes to name details are not allowed by many airlines and other Supplier(s). While we will endeavor make such a change if necessary, please bear in mind that most airlines and Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.  

Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as booked, please contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.

IF YOU CANCEL YOUR BOOKING 

If you cancel your arrangements, you may be entitled to a partial refund per the terms of your travel protection policy. In addition to the cancellation terms and conditions of your Supplier(s), our standard, non-refundable fees will apply as follows: 

  • All Non-Group Bookings: $100 per person + any cancellation fee charged by the supplier or airline, if applicable 
  • All Group Bookings: $100 per person + any cancellation fee charged by the supplier or airline, if applicable 

Note: LUXE LEVEL ESCAPE's cancellation fees are separate from the supplier’s cancellation fees and are not covered by travel protection plans. Supplier policies regarding cancellation fees will be relayed in your trip proposal. Suppliers may choose to provide a travel voucher or credit in lieu of refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency. A completed signed Cancellation Form must be received and cancellation fees must be paid via a provided link in order for LUXE LEVEL ESCAPES to move forward with cancellation of trip components. If the trip is moved, or another trip is planned before canceling a trip resulting in the number of trips with LUXE LEVEL ESCAPES to be the same or greater, this fee can be waived. 

If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable. Refunds will only be paid to you once we have received the funds back from the Supplier(s). Generally flight tickets cannot be refunded if they are partially used. We are not responsible for a Supplier's failure to pay a refund. 

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer. 

CLIENT REFUNDS

Client understands and agrees that LUXE LEVEL ESCAPE’s Fees are nonrefundable, nontransferable and apply to each customized travel journey requested. 

Client understands that travel components are refundable only based on individual Supplier policy and you will be informed with those details within your proposal. 

Client acknowledges that in the event of cancellation and any resulting refunds, LUXE LEVEL ESCAPES, acting as your travel advisor, will assist in obtaining refunds from the supplier on behalf of the client. However, LUXE LEVEL ESCAPES shall not be held responsible in any manner for refunds not paid by the supplier. 

Client understands that supplier prices change constantly. LUXE LEVEL ESCAPES assumes no responsibility if price lowers after travel arrangements have been confirmed, paid in full or ticketed. Client also understands there may be a fee to receive refunds in some instances, such as refunds of group contracted airfare after ticketing date. 

IMPORTANT NOTICE REGARDING AIRLINE RESERVATIONS

If you arrive at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservation for you – do not leave the counter. Check your ticket. If the status box shows "OK" for the flight in question, the airline policies typically require them to accommodate you on that flight, or if that is not possible, they must either find you a substitute flight or pay you denied boarding compensation. If necessary ask to speak to a supervisor.

IF YOU HAVE A COMPLAINT

If you have a problem during your vacation, please inform the relevant supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us using the contact information you were provided upon booking. If you fail to contact LUXE LEVEL ESCAPES in a timely manner, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.

TRAVEL DOCUMENTS AND DESTINATIONS

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies within 24 hours of booking. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. 

Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations, you can find that information by going to https://www.travel.state.gov. By offering travel to any particular destination, we do not represent that travel to such destination is safe or without risk. 

LUXE LEVEL ESCAPES urges customers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as vaccinations, medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, LUXE LEVEL ESCAPES will not be liable for damages or losses that result from travel to such destinations. 

Each foreign country holds different views of past criminal offenses – if you have a current or past offense, please contact that country directly for entry and exit requirements. Travelers with DWI or DUI records should check whether current rules exclude admission to foreign destinations. As an example, Canada often denies entry to travelers with a DUI conviction. These requirements remain the traveler’s responsibility due to the private nature of criminal records. For further information, please visit the U.S. State Department website at travel.state.gov

PASSPORT, VISA AND IMMIGRATION REQUIREMENTS 

Ensuring compliance with the passport, visa, and other immigration requirements relevant to your itinerary is your responsibility. We advise you to verify these requirements directly with the appropriate embassies and/or consulates. LUXE LEVEL ESCAPES bears no responsibility if you are unable to travel due to failure to comply with any such requirements. 

Clients are required to send Passport or State Issued ID copies for all travelers to confirm reservations. We keep these copies in an electronically secure space to utilize for booking purposes and to mitigate unforeseen issues that may arise during international travel. LUXE LEVEL ESCAPES strongly urges all clients to purchase travel insurance in the unlikely event of travel delays, illness, or injury. 

The client must provide correct legal names and dates of birth that match identification to be used for travel (i.e., Passports/ Driver’s License) to LUXE LEVEL ESCAPES. Name changes are not permitted on airline tickets in any circumstance. Clients are responsible for providing accurate information to LUXE LEVEL ESCAPES via the Passenger Travel Profile Form. LUXE LEVEL ESCAPES is not responsible for costs incurred by incorrect information provided by client for travel planning including reservations and airline tickets. Please double check that we have all information correct prior to authorizing booking to commence. 

Travel documents, including passports, visas, and health/vaccination certificates required are your responsibility. The name, gender and date of birth must match the information listed on the airline ticket(s) and booking records. 

Beginning May 7, 2025, every air traveler 18 years of age and older will need a REAL ID-compliant driver’s license, state-issued enhanced driver’s license, or another acceptable form of ID to fly within the United States. This is the responsibility of the traveler. 

Valid passports are required for all international destinations (outside of the United States) and the expiration date should be at least six (6) months following the return date of your trip. Some countries require that your passport have two to four blank visa/stamp pages.  Some airlines will not allow you to board if this requirement isn’t met.  

Important Note – Passport Books vs Passport Cards: While passport books and passport cards are both government-issued forms of ID that allow you to travel internationally, they have significant differences. The most important difference is that passport books are accepted for all forms of international travel to all international destinations, whereas passport cards are only acceptable for land and sea transportation to Canada, Mexico, Caribbean countries, and Bermuda. This means if you're flying internationally, no matter the destination, you need a passport book. 

Where visa and vaccinations records are required, please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration officials (s). Should a visa not be issued, LUXE LEVEL ESCAPES is not responsible for lost payments made toward contemplated trip. However, LUXE LEVEL ESCAPES  will make effort to assist with re-routing the client. 

Whether traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. 

Visit the DHS website: https://www.tsa.gov/travel/security-screening/identification for updates on what to expect during your security screening; what you can bring in your carryon, etc. 

Visit the State Department website: www.travel.stat.gov for visa, passport support, and destination safety and health hazard notifications. 

TRAVEL INSURANCE 

It is the customer’s responsibility to protect their purchases. For this reason, Travel Protection Coverage including additional cancel for any reason coverage is strongly recommended. Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase. 

LUXE LEVEL ESCAPES is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. LUXE LEVEL ESCAPES cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. We are able to arrange travel insurance for you, and furnish a quote. For specific questions regarding coverage you will be referred to the travel insurance supplier. 

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. LUXE LEVEL ESCAPES cannot be held responsible for denied entry if a customer is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.   If this protection is declined, a signed liability release waiver form will be required. 

COVID-19 ASSUMPTION OF RISK 

By booking a trip at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself, and any minors traveling with you, that you may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your trip. You acknowledge that exposure to any viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by LUXE LEVEL ESCAPES. 

Client understands that it is his/her responsibility to check, understand, and comply with the latest travel information regarding this virus at:  https://wwwnc.cdc.gov/travel/notices, domestic governing bodies https://travel.state.gov, destination governing bodies, and all Suppliers associated with Client’s travel. 

Client is aware that it is his/her personal decision to travel, and is doing so with full knowledge of current travel recommendations, restrictions, and requirements with regards to the COVID-19 and takes full responsibility for his/her actions. 

Client is aware the travel warnings, travel restrictions and rules including screening and use of masks, quarantining, travel insurance restrictions, and restrictions that may impede Clients ability to enter or exit a destination as planned, related to COVID-19 and understands the risks, is accepting of these, WHETHER ARISING FROM THE NEGLIGENCE OF THE LUXE LEVEL ESCAPES OR OTHERWISE, and holds LUXE LEVEL ESCAPES harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations Client is traveling through. 

Client further agrees to hold LUXE LEVEL ESCAPES harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to COVID-19 and agrees not to sue or institute a credit card dispute or “charge back” to LUXE LEVEL ESCAPES or its partners for said penalties, fees, or real or alleged damages. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. 

AIRLINE USE OF INSECTICIDE SPRAY 

Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. HAZARDOUS MATERIALS DISCLOSURE 

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles and radio-pharmaceuticals. 

There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. USE OF OUR SERVICES AND WEBSITE 

NON-RESPONSIBILITY 

LUXE LEVEL ESCAPES, and its employees, members, agents, and representatives use third party Suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this trip. LUXE LEVEL ESCAPES is an independent contractor and is not an employee, agent, or representative of any of these suppliers. LUXE LEVEL ESCAPES does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your trip. All suppliers are independent contractors and are not agents or employees or representatives of LUXE LEVEL ESCAPES. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all Customers agree that neither LUXE LEVEL ESCAPES, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any trip Customer or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of LUXE LEVEL ESCAPES. LUXE LEVEL ESCAPES assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any Customer that may result from any act or omission on the part of others; LUXE LEVEL ESCAPES assumes no responsibility or liability for personal property; and LUXE LEVEL ESCAPES shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. LUXE LEVEL ESCAPES accepts no responsibility for lost or stolen items. LUXE LEVEL ESCAPES reserves the right to refuse any Customer or potential Customer at its sole discretion. 

ASSUMPTION OF RISK/WAIVER 

Customer is aware that travel such area as customer is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including trip guides, other Customers, LUXE LEVEL ESCAPES and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided. 

Customer understands the description of these risks, is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, customer is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Customer hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of LUXE LEVEL ESCAPES and agrees to and shall hold harmless and fully release LUXE LEVEL ESCAPES, its owners, members, agents and assigns (together LUXE LEVEL ESCAPES) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of LUXE LEVEL ESCAPES and customer hereby covenant not to sue LUXE LEVEL ESCAPES  for any such claims or join any lawsuit or action that is suing LUXE LEVEL ESCAPES. This agreement also binds your heirs, legal representatives, and assigns.  The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. 

PRIVACY POLICY 

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us with the Supplier(s). Your personal information will not be used for any other purpose. You represent that you have read and agree to the terms of our privacy policy, which can be found at our website. 

INDEMNIFICATION 

Each customer is expected to act responsibly and adhere to all behavior guidelines established by LUXE LEVEL ESCAPES and our local suppliers. We and our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of others. In any such case, there will be no refund and we will not be liable for any expenses incurred by you due to your removal. 

Customer agrees to and shall indemnify and hold harmless LUXE LEVEL ESCAPES, and each of our owners, members, agents and assigns (collectively “LUXE LEVEL ESCAPES”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by LUXE LEVEL ESCAPES (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitration, or other causes of action, which result, directly or indirectly, from: (i) Customer’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by Customer while participating in the trip. 

PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES 

The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our trips. 

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your trip, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. LUXE LEVEL ESCAPES will communicate requests to Suppliers but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the customer requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility. 

Our Suppliers are, unfortunately, unable to offer additional assistance to customers with limited mobility and all such assistance will need to be provided by whoever the customer is traveling with. Customers with disabilities must notify LUXE LEVEL ESCAPES at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel. 

If you are pregnant or expecting at or around the time of your planned travels, please inform us prior to booking. Some Suppliers will not permit travel past certain gestational periods for your safety and the safety of your child(ren).  If you become pregnant after booking with us, please consult with a doctor and review the Supplier terms and conditions as they relate to your booking to determine whether you will be permitted or prevented from traveling. If you are denied boarding, embarkation, or access to a Supplier due to a pregnancy, LUXE LEVEL ESCAPES shall not be liable for any losses, expenses, or refunds resulting from such loss in access for you or anyone in your group. 

FORCE MAJEURE 

LUXE LEVEL ESCAPES assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by LUXE LEVEL ESCAPES that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by LUXE LEVEL ESCAPES. We will always be entitled to retain our fees.  

ADDITIONAL TERMS 

WARRANTIES, DISCLAIMERS AND LIMITATION OF LIABILITY 

We are acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers as a result of this Agreement or your use of our website. 

You agree to waive all claims for special, indirect, or consequential damages. You agree to indemnify and hold us harmless from and against our liability to third parties (including your guests and companions) arising from you or your guests' or companions’ actions or omissions. YOU AGREE THAT OUR MAXIMUM LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US. 

Changes to this agreement must be made in writing and signed by both you and LUXE LEVEL ESCAPES. Once we have completed the services described herein, this agreement will terminate automatically, except with respect to limitations on our liability and with respect to your indemnity. 

VENUE OF CHOICE 

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Missouri exclusive of conflict or choice of law rules. In the event of any legal action or proceeding arising from this Agreement, the parties agree that the state court forum for said litigation shall exclusively be in St. Louis County, Missouri in the court of appropriate jurisdiction, and that the federal court jurisdiction shall be in St. Louis, Missouri. The parties hereto submit to the exclusive jurisdiction of such courts and hereby waive any objection or defense to such jurisdiction or venue, including any defense based upon inconvenient forum. 

You consent to bringing claims against LUXE LEVEL ESCAPES solely in your individual capacity and not as a plaintiff or member of any class action or representative proceeding. LUXE LEVEL ESCAPES will only be liable for compensatory damages, and by submitting a deposit for a trip, you agree to these sales conditions and explicitly waive any right to seek punitive damages. You acknowledge and agree that you will not make any claims or initiate legal action against LUXE LEVEL ESCAPES unless you have first submitted a written notice of the claim within 14 days following the conclusion of the trip or its cancellation. 

RESERVATION OF RIGHTS TO AMEND 

LUXE LEVEL ESCAPES reserves the right, in our sole discretion, to change these Terms and Conditions at any time without prior notice to you. Upon making changes, we will notify you via the email address you provide to us at booking. The current terms will apply to your booking. You must therefore be familiar with the Terms and Conditions in effect at the time you book. Your continued access or use of our website or services signifies your acceptance of the modifications to the Agreement. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.
