Styled Getaways Terms and Conditions

Please read and submit the client agreement below.

Work will begin after trip Planning Fees have been paid, and once a client agreement, valid credit card, and Traveler Profile Form, are on file.

THIS IS A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT (the “Agreement”). Please read it carefully before signing.

Purpose of the Agreement

Client (hereafter referred to in the first person, such as "I" or "me/my" or "you/your") wishes to hire M. Cash Creative LLC, DBA Styled Getaways, an independent agency affiliated with WorldVia Travel Network, a Travel Leaders Network Associate (hereafter referred to as "Agency" or "Styled Getaways") to provide services relating to my Travel or Event Plans as detailed in this Agreement. Agency has agreed to provide such services according to the terms of this Agreement.

Services. Agency shall provide me with the services agreed upon in Planning Fee Agreement. Any additional services/products requested by the me incurred by Agency will be billed directly to me at rate agreed to, with prior notice and authorization given before the additional work is performed. All services contracted cannot be deducted, but additional services can be added.

Professional Communication. Please note that Agency works M-F and any requests after 3pm EST will be answered the following business day, and after-hours requests should always be via Email. Any business-related text messages sent after hours or on weekends will not be answered. Agency does not offer emergency/after hours or on-trip support; however, if an App Itinerary is part of the planning package purchased, Agency gives you all applicable “quick access” emergency numbers in your App itinerary so you will always have the resources that you need at your fingertips for any time-sensitive issues that arise prior-to, during, or relative-to your travel.

Suppliers. I understand that Agency is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services purchased. I consent to and request the use of those suppliers and agree not to hold Agency responsible should any of these suppliers: 1) fail to provide the travel services purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

Cost of Services. The planning fee set forth in the Planning Fee Agreement is due in full in order to begin the planning process with Agency. This initial non-refundable fee and a signed Client Service Contract must be secured prior to any services being performed by Agency. This fee is separate from the cost of your trip.

Cost of Trip. All costs pertaining to the trip (eg, lodging, activities, reservations, and insurance, but not limited to these things) will be paid by Client, either directly or indirectly via separate secure payment authorization agreement. Agency requires authorization 5-10 business days prior to supplier final payment

Final payment is due prior to departure or consumption according to each Supplier’s (eg, airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases there is no refund once a booking is made and paid for.

Final Payment Authorization Requirement. Agency requires client authorization no later than 5-10 business days prior to supplier’s final payment deadline due date. This ensures sufficient time for processing and prevents any risk of cancellation due to missed deadlines. Failure to provide timely authorization may result in penalties or forfeiture of reservations, per supplier terms.

Price Increases. I understand that the tours, cruises, accommodations or other products purchased are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by the Supplier to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize Agency to charge my credit card for such additional amounts, which I will be notified of as soon as Agency is made aware of any price increases by the Supplier.

Dietary Restrictions & Special Requests. Agency will communicate any bedding requests, dietary restrictions or special meal requests to suppliers when advised by the client. However, the agency is not liable for the availability, quality, or accuracy of these accommodations by the Supplier. It is the client’s responsibility to confirm directly with the airline, hotel, cruise line, or other service providers to ensure their needs can be met.

Air Travel Regulations & Traveling with Medication. Clients are responsible for complying with all airline, TSA, and international travel regulations, including baggage restrictions, security procedures, and entry requirements. Agency is not liable for any issues arising from non-compliance with these regulations. For those traveling with medication, it is the client’s responsibility to ensure that all prescriptions are properly labeled, comply with airline and destination country regulations, and are carried in accordance with security guidelines. Clients should consult their airline, embassy, or relevant authorities for any specific restrictions.

Air Travel: Hazardous Materials Restrictions and Insecticide Notice

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.

There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Special restrictions and limitations for transporting Hazardous Materials and specifically Lithium Ion batteries, refer to www.faa.gov/go/packsafe for more information.

In the event a carry-on bag cannot be accommodated in the passenger cabin and has to be placed below in a cargo bin for any reason, any electronic device or spare Lithium-ion or any other type of battery permitted in carry-on baggage MUST be removed from the carry-on bag and remain in the possession of the passenger in the passenger cabin. For further information, contact your airline representative.

Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at https://www.transportation.gov/airconsumer/spray.

Limit of Liability

Maximum Damages. I agree that the maximum amount of damages I am entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Agency. The Total Cost of Services refers to the Planning Fee Package paid directly to Agency. It does not include the cost of the trip, or any payments made or owed to suppliers or vendors or third parties. Indemnification and Hold Harmless Clause. I agree to indemnify, defend and hold harmless Agency and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services and/or product(s) Agency provides to me.

I accept that Agency is not responsible for, nor will I attempt to hold it liable for, any injury, damage or loss I may suffer on account of any conditions, actions or omissions that are beyond its reasonable control. Excepting only liability that directly arises from the gross negligence or willful misconduct of Agency, I will not hold it responsible for any injury, damage or loss I may suffer while on any third party provided or operated excursion or activity.

Travel Documents. I will review my travel documents for accuracy upon receipt and understand that I may contact Agency if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.

Credit Card. I have been advised to use a credit card as this may offer me the opportunity to dispute the charge should a vendor cease to operate. I am financially responsible for any charges that I have authorized Agency to book, and, except in the case of a supplier or vendor ceasing to operate, I agree NOT to dispute charges. I understand that "Cancel for any Reason" Travel Insurance is recommended to prevent any financial loss from having to cancel or being unable to take a trip. 

Identification. I understand that the Transportation Security Administration (TSA) requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my travel tickets and reservations.

I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas.

I acknowledge that my failure to strictly comply with these requirements may result in denied boarding, travel, or an undue delay causing me to miss my travel plans.

Suppliers. Agency has no special knowledge regarding the financial condition of travel service providers selected for your tour, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.  For information concerning possible dangers at destinations, Agency recommends contacting the Travel Warnings Section of the U.S. State Department at 1-888-407-4747 or www.travel.state.gov.  For medical information, Agency recommends contacting the Centers for Disease Control at 1-800-232-4636 or www.cdc.gov/travel.

I assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

Travel Insurance. I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

Cancellation, Rescheduling and No-Shows.

Cancellation, Rescheduling and No-Shows. If I desires to cancel Services, reschedule Services, or if it becomes impossible for Agency to render Services due to a fault of the mine or parties related to me, such as failure of the Trip to occur or failure of one or more essential parties to the Trip to show up in a timely manner, I shall provide notice to Agency as soon as possible via the Notice provisions detailed in this Agreement.

If the Trip is rescheduled by me, additional rescheduling fees may apply, as detailed in the Planning Fee Agreement. If the trip is cancelled, Agency has no obligation to fill the void created by my cancellation or no-show or if it becomes impossible for Agency to provide the Services due to a fault of mine (or parties related to me), and Agency will not be obligated to refund any monies I have previously paid towards the Cost of Services.

I am not relieved of any payment obligations for the Cost of Trip unless otherwise noted in the agreements with Suppliers. Refunds and allowances will be governed by the respective Supplier's terms and conditions.

Please note that cancellations or significant changes to your itinerary (including rescheduling) may incur additional fees, depending on the services booked and the timeline. If you need to cancel or make major changes after your trip has been confirmed, Agency will do their best to assist. However, any cancellation or modification fees charged by airlines, hotels, or other service providers will be passed along. From Agency, a $50 fee applies for each itinerary change, and a $100 fee will apply for cancellations.

Impossibility

Force Majeure. Not withstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

  1. A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
  2. War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
  3. Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

General Provisions

Governing Law. The laws of the State of Maryland govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. I agree that any action or proceeding brought by me against Agency shall be brought solely in the courts of Alabama located in Etowah County. In the event any action or proceeding is initiated by me in a court outside of Etowah County, Alabama, I agree to pay Agency's costs and reasonable attorney fees associated with defending such action or proceeding.

Severability. If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.

Notice. Parties shall provide effective notice (“Notice”) to each other via the following methods of delivery at the date and time which the Notice is sent:

  1. Email

Merger. This Agreement constitutes the final, exclusive agreement between the parties relating to the Services contained in this Agreement. All earlier and contemporaneous negotiations and agreements between the parties on the matters contained in this Agreement are expressly merged into and superseded by this Agreement.

Amendment. The parties may amend this Agreement only by the parties’ written consent via proper Notice.

Terms of Service. By signing this agreement and choosing Agency to plan your vacation, you also signify your agreement with the Terms of Service laid forth on Agency's website.

By choosing Styled Getaways to plan your vacation, you signify your agreement with the following terms and conditions:

  1. Travel Documents: You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on your documents must match your government-issued ID.
  2. Agent for Suppliers: Agency ("Styled Getaways") acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation ("Suppliers"). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.
  3. Risks of Travel and Release: We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at travel.state.gov, click on "Find International Travel Information" then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at cdc.gov/travel, then click on "Destinations" and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
  4. Entry & Re-entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Make sure to note rules are subject to change whether your travels are foreign or domestic. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.
  5. Fees and Price Drops: You agree to pay the travel planning, change, and other fees at listed in your Planning Fee Agreement. All of our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.
  6. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers' supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.
  7. Reservation Rule Violations: You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets". You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets. If you do not use one of the flights in your reservation, the airline will cancel your remaining itinerary, and it may confiscate your frequent flyer points. You agree to indemnify us against airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased
  8. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
  9. Credit Card Merchant: We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.
  10. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Etowah County, Alabama will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts, but the laws of Maryland will apply.
  11. Accessibility Statement: Styled Getaways is committed to creating travel experiences that are accessible to all. However, the accessibility of services, accommodations, and activities is ultimately determined by suppliers and destinations. While we strive to provide accurate information and advocate for your needs, we cannot guarantee full accessibility at all locations. Please inform us of any specific requirements during the planning process so we can tailor your trip accordingly.
