Travel Agent Booking Terms and Credit Card Authorization

1. Introduction

This Agreement outlines the terms and conditions governing the relationship between The I Love Travel Company, LLC ("we," "us," or "our") and you ("Client," "you," or "your") for the services we provide as your travel agent. By using our services and confirming your booking, you acknowledge and agree to the terms outlined herein.

We serve as an intermediary to facilitate your travel arrangements with Suppliers, such as airlines, hotels, cruise lines, and other travel service providers. This Agreement ensures clarity, defines responsibilities, and limits liability. Please read it carefully before proceeding with your booking.

2. Services Provided

As an independent travel agency, we assist with the booking of travel services, including but not limited to:

  • Flights, cruises, accommodations, car rentals, and tours.
  • Travel package customization to fit your preferences and budget.
  • Guidance on entry requirements, including visas, health documentation, and vaccinations.

We act solely as an intermediary and are not the provider of these services. Your contract for travel services is directly with the Suppliers, and any issues or disputes must be addressed with them.

3. Supplier Terms and Conditions

All travel arrangements are subject to the Suppliers' terms, including but not limited to:

  • Cancellation policies and fees.
  • Refund and rescheduling policies.
  • Restrictions, including those related to pricing, availability, and itinerary changes.

It is your responsibility to review and understand these policies prior to completing your booking. The I Love Travel Company, LLC is not liable for any actions, omissions, or changes made by the Supplier.

4. Client Responsibilities

As a Client, you are responsible for the following:

  • Accuracy of Information: Ensuring all personal details (e.g., name, date of birth, passport information) are correct and match official travel documentation.
  • Entry Requirements: Obtaining and complying with all entry requirements for your destination, including visas, health certifications, and vaccination records.
  • Booking Review: Carefully reviewing all booking details, including passenger names, travel dates, and itineraries, at the time of confirmation.
  • Travel Insurance: Deciding whether to purchase travel insurance to protect your investment.

We will not be held responsible for any issues arising from inaccurate or incomplete information provided by you.

5. Fees and Payment

  • Payment Deadlines: All payments for travel arrangements must be made as specified at the time of booking. Failure to pay by the deadline may result in cancellation of your booking and forfeiture of any deposits paid.
  • Non-Refundable Fees: Service fees charged by The I Love Travel Company, LLC are non-refundable.
  • Currency and Transaction Fees: Some transactions may be subject to foreign currency conversion or international transaction fees by your credit card issuer.

6. Changes and Cancellations

All changes or cancellations are subject to the Supplier’s terms, which may include:

  • Non-refundable deposits.
  • Penalties for changes or cancellations.
  • Additional administrative fees for changes processed by The I Love Travel Company, LLC.

We strongly recommend purchasing travel insurance to safeguard against unexpected cancellations or itinerary changes.

7. Travel Insurance

The I Love Travel Company, LLC strongly encourages purchasing travel insurance to protect against unforeseen circumstances such as:

  • Trip interruptions or cancellations.
  • Medical emergencies during travel.
  • Lost, delayed, or damaged baggage.

If you choose to decline travel insurance, you assume full responsibility for any losses incurred as a result.

8. Limitation of Liability

  • Intermediary Role: We act solely as an intermediary between you and the Suppliers.
  • Force Majeure: We are not liable for events beyond our control, including but not limited to natural disasters, government restrictions, pandemics, or Supplier insolvency.
  • Client Responsibility: We are not liable for missed connections, incorrect information provided by the Client, or any changes made by the Client after booking confirmation.

9. Assumption of Risk

Travel, particularly international travel, involves inherent risks, including but not limited to:

  • Delays, cancellations, or missed connections.
  • Political instability, natural disasters, health risks, or other unforeseen events.
  • Changes to travel requirements, including visa, passport, or vaccination mandates.

By proceeding with your booking, you voluntarily assume these risks and release The I Love Travel Company, LLC from any liability associated with such risks.

10. Declined Payments, Chargebacks, and Associated Fees

  • Declined Payments: If your payment is declined, we are not responsible for incomplete bookings, missed deadlines, or loss of reservations. Any penalties resulting from declined payments are your sole responsibility.
  • Chargebacks: Unwarranted chargebacks may result in additional fees or legal action to recover costs incurred by us. You agree to reimburse us for any resulting fees, penalties, or losses unless the chargeback was caused by our error.
  • Additional Fees: Any fees imposed by the Supplier or incurred during payment processing due to declined transactions are your sole responsibility.

11. Refund Limitations

Refunds for unused travel services, cancellations, or schedule changes are subject to the policies of the Suppliers. Refunds may be:

  • Limited or unavailable for certain discounted or promotional fares.
  • Delayed by the Supplier’s internal processes.

We will make reasonable efforts to assist with refund requests but are not liable for delays, denials, or partial refunds issued by Suppliers.

12. Travel Documentation and Customs Compliance

You are solely responsible for ensuring compliance with customs and immigration requirements, including:

  • Valid passports with sufficient validity for your trip.
  • Visas or entry permits required by your destination(s).
  • Adherence to import/export restrictions for goods or personal items.

The I Love Travel Company, LLC is not responsible for delays, fines, or denied entry due to failure to comply with these requirements.

13. Dispute Resolution and Class Action Waiver

Any disputes arising from this Agreement will be resolved through binding arbitration in the state of South Carolina. You waive the right to bring or participate in any class action or representative proceeding against The I Love Travel Company, LLC.

14. Indemnification

You agree to indemnify and hold harmless The I Love Travel Company, LLC, its owners, agents, and employees, from any claims, losses, damages, or expenses (including legal fees) arising out of your use of our services, failure to comply with these terms, or actions of Suppliers.

15. Non-Disparagement Clause

You agree not to post or communicate any negative, false, or defamatory statements about The I Love Travel Company, LLC. All concerns or disputes must be resolved privately through the dispute resolution process.

16. Force Majeure

We are not liable for nonperformance or delays resulting from causes beyond our reasonable control, including but not limited to acts of God, war, strikes, pandemics, or government restrictions.

17. Electronic Signatures and Consent

Your electronic signature or acceptance of these terms via our online portal constitutes your binding agreement to all terms and conditions herein.
