KNH Luxury Travel, LLC d/b/a K. Heitman Travel

These Terms and Conditions ("Terms") govern the relationship between KNH Luxury Travel, LLC d/b/a K. Heitman Travel ("K. Heitman Travel," "we," "us," or "our") and you, the client ("Client," "you," or "your"). By engaging K. Heitman Travel's services, you agree to be bound by these Terms and acknowledge that K. Heitman Travel acts solely as an independent travel advisor and booking agent for disclosed principal suppliers including tour operators, cruise lines, hotels, airlines, ground transportation companies, and other independent contractors providing accommodations, transportation, and other travel services ("Suppliers"). K. Heitman Travel is not the source or provider of travel services.

1. SCOPE OF SERVICES

K. Heitman Travel provides luxury travel planning and advisory services including itinerary design, supplier research and recommendations, booking coordination, and ongoing client support. We act as your agent in securing reservations with various travel Suppliers but do not own, operate, or control any travel services.

Planning Fees: K. Heitman Travel charges non-refundable planning fees for our professional services, which vary based on trip complexity, duration, destination, and party size. Planning fees are separate from and in addition to the cost of travel services purchased from Suppliers.

Payment Structure: K. Heitman Travel collects planning fees only. All payments for travel services (hotels, tours, transportation, etc.) are made directly to Suppliers using Client's payment methods. By authorizing us to use your payment method, you agree to allow K. Heitman Travel to purchase travel products from Suppliers on your behalf only after receiving your explicit authorization for each transaction.

2. CLIENT RESPONSIBILITIES

Authorization: You warrant that you are at least 18 years of age and possess legal authority to enter into this agreement and make travel bookings. You agree to be financially responsible for all travel bookings and warrant that all information provided is true and accurate.

Travel Documentation: You are solely responsible for obtaining and carrying valid passports, visas, identification, health certificates, and all other documents required by applicable government regulations and Suppliers. Names on all travel documents must exactly match those on identification and airline tickets.

Health and Safety: You must obtain proper immunizations, health screenings, and required documentation before travel. You acknowledge that travel involves inherent risks and agree to research destination-specific health, safety, and security conditions.

Supplier Terms: You agree to review and abide by the terms and conditions of each Supplier whose services you purchase. K. Heitman Travel will provide copies of relevant Supplier terms and conditions, but it remains your responsibility to read, understand, and comply with them.

3. PAYMENTS AND CANCELLATIONS

Payment Authorization: By providing credit card information, you authorize K. Heitman Travel to charge planning fees and to use your payment method to purchase travel services from Suppliers on your behalf only after receiving your explicit authorization for each transaction.

Chargeback Prohibition: EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE BOOKING TERMS AND CONDITIONS OF K. HEITMAN TRAVEL OR ITS SUPPLIERS. If you attempt to chargeback, reverse, or recollect a previously authorized payment, K. Heitman Travel reserves the right to collect all costs, fees, and expenses associated with such action, including attorney fees.

Cancellations: All cancellation requests must be made in writing. Planning fees are non-refundable. Cancellation penalties for travel services are determined by individual Supplier policies. We strongly recommend purchasing travel insurance.

Payment Deadlines: All payments for travel services are due according to Supplier terms. Failure to make timely payments may result in cancellation and forfeiture of deposits.

4. LIMITATIONS OF LIABILITY AND DISCLAIMERS

Agency Relationship: K. Heitman Travel acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of travel services. Each Supplier is an independent entity not subject to our control.

Limitation of Liability: BECAUSE K. HEITMAN TRAVEL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT CONTROL THE OPERATIONS OF INDEPENDENT SUPPLIERS, YOU AGREE THAT K. HEITMAN TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM TRAVEL SERVICES. K. HEITMAN TRAVEL DISCLAIMS ALL LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES IN CONNECTION WITH GOODS OR SERVICES PROVIDED BY SUPPLIERS.

Damages Cap: K. HEITMAN TRAVEL'S LIABILITY IN ANY DISPUTE SHALL BE LIMITED TO THE AMOUNT OF PLANNING FEES ACTUALLY RECEIVED BY K. HEITMAN TRAVEL FOR YOUR SPECIFIC TRAVEL TRANSACTION.

No Warranties: We make no representations or warranties regarding Supplier services, accommodations, or experiences. All recommendations are based on available information and professional judgment but are not guaranteed.

5. TRAVEL RISKS AND FORCE MAJEURE

Assumption of Risk: You acknowledge that travel involves inherent risks including but not limited to weather conditions, natural disasters, political instability, terrorism, health emergencies, and Supplier defaults. BY ENGAGING OUR SERVICES, YOU ASSUME ALL RISKS ASSOCIATED WITH TRAVEL.

Force Majeure: K. Heitman Travel shall not be liable for any failure to perform obligations due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, government actions, or Supplier bankruptcies.

Travel Insurance: WE STRONGLY RECOMMEND PURCHASING COMPREHENSIVE TRAVEL INSURANCE. Travel insurance is not included in our services unless specifically noted. Without appropriate insurance, you may lose money paid for travel services due to cancellation, interruption, or other covered events.

6. TRAVEL DOCUMENTATION AND ENTRY REQUIREMENTS

You are solely responsible for:

• Obtaining valid passports (must be valid at least 6 months beyond return date)
• Securing required visas and entry permits
• Meeting health and vaccination requirements
• Understanding and complying with destination entry/exit requirements
• Carrying acceptable identification for domestic and international travel

We provide general guidance but cannot guarantee accuracy of requirements, which change frequently. You must verify current requirements with appropriate authorities.

7. MODIFICATIONS AND UNUSED SERVICES

Itinerary Changes: Changes to confirmed bookings may incur administrative fees plus any Supplier-imposed charges. Not all bookings can be modified.

Unused Services: No refunds for unused portions of travel services as our rates are often based on Supplier contract terms.

8. DISPUTE RESOLUTION

Governing Law: These Terms are governed by Georgia law without regard to conflict of law principles.

Jurisdiction: Any disputes shall be resolved in the state or federal courts of DeKalb County, Georgia. You consent to personal jurisdiction in Georgia.

Attorney Fees: The prevailing party in any dispute shall be entitled to recover reasonable attorney fees and costs.

9. GENERAL PROVISIONS

Entire Agreement: These Terms constitute the entire agreement between you and K. Heitman Travel regarding our services and supersede all prior communications.

Modification: We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and are effective immediately.

Severability: If any provision is deemed unenforceable, the remaining provisions remain in full effect.

Independent Contractor Status: K. Heitman Travel operates as an independent travel advisor. Our contractors and assistants work under our direction in providing advisory services.

By engaging K. Heitman Travel's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
