Holly NeSmith Travel, LLC. Terms and Conditions

Before we make arrangements for your trip, we require that you read and sign this form; your signature will signify your acknowledgement of the booking policies and fees, as well as, agreement with the following terms and conditions:

Holly NeSmith Travel, LLC acts as a sales agent for any airline, hotel, car rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”).

Holly NeSmith Travel, LLC is not responsible for acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund. You acknowledge and understand that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms.

Holly NeSmith Travel, LLC assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under Holly NeSmith Travel, LLC’s control.

You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. 

Holly NeSmith Travel, LLC has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel.

Holly NeSmith Travel, LLC has no responsibility for health-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest government travel regulations, we recommend referencing information on the IATA website at https://www.iatatravelcentre.com/. 

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer under the policy.

Holly NeSmith Travel, LLC charges fees for service. Fees are paid by client after an initial Discover call, but before any substantive work is done on client travel plans per the outlined rates below:

• Custom Travel Planning: starting at $400

  • Standard family group of 2-6 travelers
  • Planning for up to 7 nights of travel

• Group or Multigenerational Travel Planning: starting at $500

  • Couples, groups or multigenerational families
  • Planning for up to 7 nights of travel

• Extended Travel Days: +$25 per additional night over 10 

• Redirection Fees: starting at $75

  • If a custom travel plan has already been made, whether deposited or not, and the client decides to change destinations or substantially change the trip outline, a redirection fee will be charged.

• Hotel Booking outside of a custom travel plan: complimentary

• Concierge Only Travel Plans: starting at $125

• Air Management:

  • Domestic Ticket: $75 per ticket (up to $500)
  • International Ticket: $100 per ticket (up to $500)
  • Change Fee: $75 per change

All fees are prepaid, non-transferable and non-refundable at the time of payment regardless of whether the client takes the trip as planned or not.

You acknowledge and understand that all travel suppliers (including but not limited to airlines, hotels, cruise lines, tour operators, and other service providers) maintain their own cancellation policies, penalties, and refund terms, which are separate from and independent of the policies of Holly NeSmith Travel, LLC. Supplier cancellation penalties may apply regardless of any fees charged by Holly NeSmith Travel, LLC, and you agree to be bound by those supplier terms.

In addition to supplier-imposed penalties, Holly NeSmith Travel, LLC maintains its own cancellation policies to protect the time, expertise, and resources invested in the travel planning process. The professional planning services provided by Holly NeSmith Travel, LLC are not contingent upon travel taking place and are not covered by any reservation management fee.

If a client cancels travel for any reason after planning services have commenced, the following cancellation fees will apply based on the number of days prior to the scheduled departure date:

• 60 to 30 days prior to travel: A cancellation fee equal to 25% of lost commission will be charged.
• 29 to 15 days prior to travel: A cancellation fee equal to 50% of lost commission will be charged.
• 14 to 0 days prior to travel: A cancellation fee equal to 100% of lost commission will be charged.

Cancellations made more than 60 days prior to travel will not incur a cancellation fee related to lost commission. However, all planning fees, planning rates, and service fees are non-refundable from the point of processing, regardless of whether travel is ultimately canceled.

Lost commission refers to the commission Holly NeSmith Travel, LLC would reasonably have earned had the trip traveled as booked. Any applicable cancellation fees will be invoiced and are due upon receipt.

RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN THIS DOCUMENT, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD HOLLY NESMITH TRAVEL LLC,, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Jefferson County Alabama will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
