E.L.K. TRAVELS LLC – TERMS AND CONDITIONS

Thank you for choosing E.L.K. TRAVELS LLC to assist you in your vacation planning and to save you time and stress. Planning your vacation involves a significant investment of your travel expert’s time. We consider your lifestyle, travel goals, travel history, and any special requests when developing your custom itinerary. We research a number of hotels, tours, and flights to meet your specific needs and desires, using trusted suppliers to offer you the best value for your hard-earned dollars while creating a detailed final itinerary to ensure a memorable and smooth vacation. Vacations arranged through E.L.K. TRAVELS LLC provide peace of mind and high-quality service every step of the way.

CONTRACT

Please carefully read all Terms and Conditions below. These Terms and Conditions – including all brochures, documents, correspondence, and the terms and conditions of our travel vendors – form the basis of the contract between you and E.L.K. TRAVELS LLC. By requesting confirmation of your booking, you acknowledge that you have read and agree to these Terms and Conditions, including waivers of liability, class action waivers, and venue selection provisions, and that you understand your legal rights may be affected.

If you are booking for a group, the lead customer is responsible for sharing these Terms and Conditions with all group members and is financially responsible for the entire booking. You represent and warrant that (a) you are of sufficient age to use our services and create binding legal obligations, (b) you are legally authorized to act on behalf of all persons you represent, and (c) the information you supply is true and correct.

I. RESERVATION OF RIGHTS & CORRECTION OF PRICING

We reserve the right, in our sole discretion, to correct any errors or omissions in pricing or availability at any time. Should a pricing error or omission occur, we will notify you immediately and either provide the corrected pricing or offer you the option to cancel your booking. All supplier quotes and deadlines are valid only at the time they are requested; prices may change until full payment is received.

II. LOYALTY PROGRAM PROVISIONS

Please note that bookings arranged through E.L.K. TRAVELS LLC may not qualify for frequent flyer, hotel, or other loyalty reward points. If you participate in any loyalty program, you are responsible for verifying with the provider that your booking qualifies for points or rewards. We do not guarantee or assist with the accrual or redemption of loyalty benefits.

III. MINOR TRAVEL DOCUMENTATION

If you are making a booking that includes minors, you are required to provide additional documentation—such as birth certificates or notarized parental consent forms—per applicable government regulations. Failure to supply such documentation may result in denied boarding or entry.

IV. TRAVEL DOCUMENTS & REVIEW PROCEDURE

It is your responsibility to obtain and carry all necessary travel documents (passports, visas, and any required identification). Upon receipt of your travel documents from us, you must review them within 24 hours and inform us immediately of any errors or discrepancies. If no notice is received within 24 hours, you acknowledge that all details are correct, and we shall not be liable for any subsequent corrections or additional costs.

V. OUR RESPONSIBILITIES & PROFESSIONAL SERVICES

E.L.K. TRAVELS LLC provides retail travel services as an agent. We do not operate, control, or manage the services provided by independent travel vendors. Our services include:

1. Pre-Planning Consultation: Listening to your needs, travel goals, history, budget, and destination interests.
2. Planning: Researching flights, hotels, tours, cruises, excursions, and workshops to meet your specific desires.
3. Booking: Utilizing trusted suppliers to secure the best value; facilitating reservations and handling all related travel arrangements, deposits, payments, invoicing, and room allocations.
4. Confirmation/Pre-Departure: Creating a detailed final itinerary and providing all required travel documents at least 10 days prior to departure (provided travel is paid in full).
5. While Traveling: Assisting with any desired changes or supplier substitutions.
6. Post Return: Following up to learn about your experience and requesting reviews for our website and social media pages.

VI. SERVICE FEES, PAYMENTS, AND CANCELLATION

Any applicable planning or service fees will be fully disclosed before your travel planning begins. All such fees are non-refundable and separate from the cost of your trip. You must adhere to the payment deadlines provided. Failure to make payments may result in the cancellation of your reservation, which will be treated as a client-initiated cancellation and subject to cancellation fees of $50 per person plus any supplier-imposed charges. In addition, you agree not to initiate any chargebacks or disputes with your bank or credit card company to circumvent these terms.

VII. CREDIT CARD AUTHORIZATION

By providing your credit card information, you authorize E.L.K. TRAVELS LLC to charge your card for travel bookings, including any additional amounts arising from supplier-imposed changes (such as increased taxes or fees). If you attempt an improper chargeback, we reserve the right to dispute the claim and recover all associated costs, including attorney fees, and to cancel your travel reservation.

VIII. DAMAGE, LOSS, AND INDEMNIFICATION

You are responsible for any damage or loss incurred during your trip. You agree to indemnify, defend, and hold E.L.K. TRAVELS LLC, its owners, agents, and assigns harmless from any claims, losses, liabilities, damages, judgments, settlements, or costs (including reasonable attorney fees) arising directly or indirectly from your negligence, misconduct, or breach of these Terms and Conditions.

IX. LEGAL AND SAFETY COMPLIANCE

You agree to comply with all applicable laws, safety regulations, and the specific policies of any travel supplier. Failure to adhere to these legal and safety requirements may result in the immediate cancellation of your travel arrangements without refund.

X. TRAVEL INSURANCE & WAIVER REQUIREMENT

It is strongly recommended that you purchase a travel protection plan covering cancellation, interruption, medical expenses, emergency evacuation, and baggage loss. Should you choose to decline travel insurance, you must execute a written waiver acknowledging that you understand and assume the risks associated with traveling without insurance coverage. Please note that we are not a licensed insurance broker and cannot provide technical advice regarding insurance policies. We also cannot guarantee that any insurance claim submitted on your behalf will be approved or result in a refund; the outcome is solely at the discretion of the insurance provider.

XI. FORCE MAJEURE

E.L.K. TRAVELS LLC shall not be held liable for any loss, damage, delay, or cancellation resulting from any Act of God or other force majeure event, including but not limited to fire, hurricanes, earthquakes, strikes, riots, terrorism, government actions, epidemics, pandemics, or any other unforeseen event beyond our control. In such events, any available refunds from suppliers will be passed to you; however, our service fees shall remain non-refundable. We strongly advise that you secure travel insurance to protect against such eventualities.

XII. TRAVEL PROTECTION & STEP PROGRAM

Travel protection coverage is strongly recommended to safeguard your investment. We advise purchasing insurance that protects against non-refundable deposits, cancellations, and interruptions. Additionally, we recommend all travelers register with the U.S. Smart Traveler Enrollment Program (STEP) to receive emergency assistance and timely safety updates during your trip.

XIII. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising out of or relating to these Terms and Conditions shall be resolved exclusively in the appropriate courts located in Texas. You agree to bring any claim solely in your individual capacity, waive your right to participate in class actions, and agree that no punitive or exemplary damages will be awarded.

XIV. ENTIRE AGREEMENT & SEVERABILITY

This Agreement, including any other documents (such as invoices and supplier terms) provided by E.L.K. TRAVELS LLC, constitutes the entire agreement between you and us. It supersedes all prior communications and proposals. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

XV. SELLER OF TRAVEL

E.L.K. TRAVELS LLC is authorized to sell travel services to clients in all U.S. states except Hawaii. Our current Seller of Travel registration numbers are as follows:

For clients in California, please note that we are a Wyoming-based company registered to sell travel in that state.
