Ivylatti Travel LLC Terms and Conditions

1. AGREEMENT AND SCOPE

By engaging Ivylatti Travel ("Agency," "we," "us"), you ("Client," "you") agree to the following Terms and Conditions. Ivylatti Travel is an Independent Contractor of WorldVia Travel Network (Travel Quest Network). These terms apply to all services provided by the Agency, including travel planning, consulting, and booking services. By engaging Ivylatti Travel, submitting payment, signing electronically, or otherwise authorizing services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2. ROLE OF THE AGENCY

Ivylatti Travel acts solely as a booking agent for third-party suppliers (e.g., airlines, hotels, cruise lines, tour operators). We do not own, manage, control, or operate any supplier services. We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. This includes, without limitation, supplier bankruptcy, insolvency, cessation of operations, schedule changes, overbooking, or failure to deliver contracted services.

3. PROFESSIONAL PLANNING FEES

Ivylatti Travel charges professional planning fees to compensate for the time and expertise required to research, curate, and manage your travel arrangements. Professional planning fees are earned upon commencement of research, consultation, or itinerary development. Payment of a planning fee does not guarantee pricing, availability, confirmation of travel services, or successful completion of travel.

• Fee Schedule: By engaging Ivylatti Travel, you agree to the following schedule of non-refundable professional fees:

Note: Custom Journey fees cover up to 2 travelers. An additional fee of $50 applies per extra traveler.

• Administrative Surcharges: To maintain service standards, the following surcharges apply to specific requests:

• Non-Refundable: All fees listed above are strictly non-refundable and non-transferable, regardless of whether travel is eventually booked or completed.
• Scope: Fees cover the services listed in the Fee Schedule. Requests outside this scope may incur additional charges.

4. PAYMENTS AND PRICING

• Supplier Payments: All payments for travel will be processed by the third-party supplier. You authorize Ivylatti Travel to provide your payment information to these suppliers on your behalf.
• Price Fluctuation: Prices and availability are subject to change by the supplier until a deposit is paid and the booking is confirmed. We cannot guarantee pricing that has not been ticketed or deposited.
• Credit Card Authorization: By providing your credit card information, you authorize the Agency and its suppliers to charge the agreed-upon amounts. You agree not to initiate a chargeback for valid services rendered or for penalties imposed by supplier cancellation policies.

5. CANCELLATION AND CHANGE POLICIES

• Supplier Policies: Each airline, hotel, cruise line, and tour operator has its own cancellation and change penalties. These are separate from Ivylatti Travel fees. You are responsible for all supplier penalties.
• Agency Cancellation: In the event you cancel a confirmed trip, Ivylatti Travel retains all planning fees. We reserve the right to charge an additional administrative cancellation fee to cover the time spent processing cancellations and refunds. Changes requested after booking confirmation may result in additional planning or modification fees.

6. TRAVEL INSURANCE

Ivylatti Travel strongly recommends the purchase of comprehensive travel insurance to protect your investment, health, and belongings.

• If you decline insurance, you assume full responsibility for any financial loss associated with your travel arrangements, including medical emergencies, trip cancellation, or delays.
• Waiver: By declining insurance, you waive any claim against Ivylatti Travel for losses that could have been covered by such insurance.

7. DOCUMENTATION AND REQUIREMENTS

• Passports & Visas: It is the Client's sole responsibility to ensure that all travelers hold valid passports (valid for at least 6 months beyond the return date) and necessary visas.
• Health & Safety: It is the Client's responsibility to review and meet all health and entry requirements (vaccinations, testing, etc.) for their destination. Ivylatti Travel provides advice based on current information but assumes no liability for denied entry.

8. FORCE MAJEURE

Ivylatti Travel shall not be liable for any failure or delay in performing its obligations where such failure or delay is due to causes beyond its reasonable control, including but not limited to: acts of God, war, strikes, labor disputes, government orders, pandemics, epidemics, or weather conditions.

9. CODE OF CONDUCT

At Ivylatti Travel, we prioritize Safety, Joy, and Respect. We reserve the right to withdraw service or terminate a client relationship immediately if our staff or partners are subjected to harassment, discrimination, or abusive behavior. Termination of services under this section may occur without refund of professional planning fees already earned.

10. INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless Ivylatti Travel, its owners, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from or related to the Client’s actions, omissions, or failure to comply with supplier terms, destination requirements, or applicable laws.

11. GOVERNING LAW AND SELLER OF TRAVEL DISCLOSURES

This agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising under this agreement shall be resolved exclusively in the courts located in Cook County, Illinois.

Severability: If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
