Oceans & Lands, LLC Terms and Conditions

Thank you for choosing Oceans & Lands, LLC ("we," "us," or "our") for your travel planning needs. By booking or participating in any travel services provided by Oceans & Lands, LLC, you ("you," "client," or "traveler") agree to the following Terms and Conditions. Please read them carefully, as they form a legally binding agreement between you and Oceans & Lands, LLC.

1. Scope of Services

Oceans & Lands, LLC acts as an intermediary between you and third-party travel suppliers (e.g., airlines, hotels, tour operators, cruise lines, etc.). We arrange travel services based on your preferences but do not directly provide transportation, accommodations, or other travel-related services. All services are subject to the terms and conditions of the respective suppliers, which may include restrictions or penalties for changes or cancellations.

2. Booking and Payment

• Reservations: To confirm a booking, you must provide accurate information and a deposit or full payment as specified at the time of booking. We are not responsible for errors caused by inaccurate information provided by you.
• Payments: You agree to pay all fees, including service fees, supplier costs, and taxes, as outlined in your booking confirmation. Payments must be made by the due dates provided. Late payments may result in cancellation of your booking without refund.
• Pricing: Prices are subject to change until full payment is received and confirmed. We are not responsible for price changes imposed by suppliers after booking.

3. Cancellations and Refunds

• By You: Cancellations must be submitted in writing (email or letter). Refunds, if any, depend on the supplier’s policies and may incur fees or penalties. Oceans & Lands, LLC service fees are non-refundable unless otherwise stated.
• By Suppliers or Oceans & Lands, LLC: If a supplier cancels a service, we will work to secure a refund or alternative arrangement, subject to the supplier’s terms. If Oceans & Lands, LLC cancels due to unforeseen circumstances (e.g., safety concerns), we will notify you promptly and provide a refund or credit, less any non-refundable fees.
• No-Show: Failure to appear for a booked service without prior cancellation may result in a total loss of payment.

4. Changes to Itineraries

• By You: Changes to your travel plans are subject to supplier availability and policies. Additional fees may apply, including Oceans & Lands, LLC service fees.
• By Suppliers or Oceans & Lands, LLC: We are not responsible for changes made by suppliers (e.g., schedule changes, cancellations). We will notify you of changes as soon as possible and assist with alternatives, but we are not liable for costs or losses resulting from supplier changes.

5. Travel Documentation and Requirements

• You are responsible for obtaining and carrying all required travel documents (e.g., passports, visas, vaccination records) and complying with all entry, exit, and health requirements for your destination. Oceans & Lands, LLC is not liable for losses or expenses due to failure to meet these requirements.
• We recommend verifying requirements with relevant authorities (e.g., embassies, consulates) well in advance of travel.

6. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance to cover cancellations, medical emergencies, trip interruptions, and other risks. Oceans & Lands, LLC is not responsible for losses or expenses due to unforeseen events (e.g., illness, natural disasters, supplier insolvency). If you decline insurance, you assume all associated risks.

7. Liability and Limitations

• Limitation of Liability: Oceans & Lands, LLC is not liable for acts, errors, omissions, or negligence of third-party suppliers, nor for any injuries, damages, losses, or delays caused by events beyond our control (e.g., weather, strikes, political unrest). Our liability is limited to the amount of fees paid to us for services rendered.
• Assumption of Risk: Travel involves inherent risks (e.g., illness, injury, loss of property). By booking with us, you acknowledge and accept these risks.
• Accuracy of Information: We strive to provide accurate information but are not responsible for errors in supplier-provided details (e.g., pricing, schedules) or changes after booking.

8. Client Responsibilities

You agree to:

• Provide accurate and complete information for bookings.
• Comply with all supplier terms, destination laws, and regulations.
• Behave respectfully and not engage in conduct that disrupts travel services or endangers others.
• Pay all charges and fees on time.

Failure to comply may result in cancellation of services without refund.

9. Dispute Resolution

• Complaints: Please notify us in writing within 30 days of your trip’s completion if you have a complaint. We will work to resolve issues promptly but are not liable for supplier-related disputes.
• Governing Law: These Terms are governed by the laws of [Insert Your State, e.g., Delaware], USA. Any disputes will be resolved in the courts of [Insert Your County, e.g., New Castle County], Delaware.
• Mediation: We encourage resolving disputes through mediation before pursuing legal action.

10. Modifications to Terms

11. Miscellaneous

• Force Majeure: Oceans & Lands, LLC is not liable for delays or cancellations due to events beyond our control, such as natural disasters, pandemics, or government actions.
• Severability: If any part of these Terms is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms constitute the entire agreement between you and Oceans & Lands, LLC, superseding any prior agreements.
