One 11 Travel LLC – Terms & Conditions

Effective Date: January 20, 2025

These terms and conditions ("Agreement") govern the relationship between One 11 Travel LLC, an independent travel advisor ("Travel Advisor," "we," "us") and you, the purchaser of travel services or lead traveler ("Client," "you"). By using Travel Advisor’s services, requesting planning, or booking travel, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you may not use our services.

Use of Travel Advisor’s Services

You represent and warrant that:

• You are at least 18 years of age and authorized to enter into this Agreement and make travel bookings with Travel Advisor;
• All information you provide (for yourself or on behalf of others) is true, accurate, and will remain current throughout your engagement; and
• You will comply with this Agreement and with all applicable terms and conditions of travel suppliers or partners.

Travel Advisor reserves the right to decline or discontinue services to any Client at its discretion. Termination of services does not entitle Client to a refund of planning fees or to relief from Supplier-imposed charges.

Independent Travel Advisor

Travel Advisor is an independent travel advisor affiliated with Fora Travel, Inc. ("Fora") and operates a separate travel business. Client understands and agrees that:

1. Travel Advisor is not an agent, representative, or employee of Fora;
2. Fora is a technology provider and host agency, not a travel service provider;
3. Client will have no claim against Fora for losses or damages arising from services provided by Travel Advisor; and
4. Fora is not a party to this Agreement for any purpose.

Client expressly waives any claims, demands, or causes of action against Fora arising from or related to travel arrangements, advisor services, cancellations, disputes, or any other matters related to this Agreement.

Services; Planning Fees

Travel Advisor provides professional travel planning services, which may include research, itinerary design, booking of accommodations, transportation, cruises, activities, tours, group travel, and related services as agreed in writing.

Planning fees may apply and will be disclosed and agreed upon in writing prior to work beginning. All planning fees are 100% non-refundable and must be paid before Travel Advisor commences itinerary work.

Suppliers; Client Responsibility

Travel Advisor acts solely as an intermediary between Client and third-party travel suppliers ("Suppliers"). Client agrees to indemnify and hold harmless Travel Advisor from any claims, damages, losses, or expenses arising from Client’s conduct, documentation issues, or Supplier-provided services. The Suppliers identified in travel documentation are solely responsible for providing the travel services purchased.

Client acknowledges and agrees that:

• Suppliers are independent entities beyond Travel Advisor’s control;
• Travel Advisor does not guarantee availability, rates, service quality, or special requests;
• Travel Advisor is not responsible for dissatisfaction with Supplier services; and
• Travel Advisor is not liable for Supplier changes, delays, cancellations, schedule modifications, operational failures, bankruptcy, or force majeure events.

Travel Bookings; Pricing; Payments

Rates & Dynamic Pricing: All prices are quoted in USD unless otherwise stated and are subject to change without notice due to dynamic pricing models, demand, and availability.

Currency Fluctuations: International travel pricing may be affected by currency exchange rate fluctuations.

Booking Confirmation: Prices are not guaranteed until booked, confirmed, and payment is received.

Taxes & Fees: Quoted prices include taxes and fees unless otherwise stated. Additional charges imposed by Suppliers are Client’s responsibility.

Payment: Client agrees to remit payment when due, either directly to Suppliers or, when directed, through Fora acting as payment processor on behalf of a Supplier.

Independent Arrangements: Travel Advisor is not responsible for costs, penalties, or issues related to travel arrangements booked independently by Client.

Credit Card Authorization; Disputes; Chargebacks

Client certifies they are an authorized user of any credit card provided and authorize charges expressly approved by them.

Client agrees not to initiate chargebacks or payment disputes to avoid or violate Supplier or Travel Advisor terms, except in cases where services were never provided or were grossly misrepresented. Nothing in this section limits Client’s rights under applicable consumer protection laws. Client must notify Travel Advisor promptly of any issues and allow reasonable opportunity for resolution.

Nonrefundable Bookings; Modifications; Cancellations

Client understands that many travel services are nonrefundable and subject to Supplier-specific cancellation, modification, and refund policies.

Client agrees to:

• Provide at least 48 hours’ written notice for modification or cancellation requests;
• Accept all Supplier-imposed penalties; and
• Reimburse Travel Advisor for any fees or expenses incurred due to changes or cancellations.

Travel Advisor cannot override or alter Supplier policies.

Cruise Bookings

All cruise bookings are subject to the cruise line’s terms and conditions. Cruise itineraries and schedules may change due to weather, mechanical issues, or operational requirements. Travel Advisor is not liable for such changes.

Group Bookings

For group travel:

• A designated group leader serves as the primary point of contact;
• Group pricing and benefits are subject to Supplier minimum participation and policies; and
• Changes or cancellations may affect the entire group and incur additional fees.
  

Travel Insurance

Travel insurance is not included unless expressly purchased and is strongly recommended. Without travel insurance, Client assumes full financial risk for cancellations, delays, medical emergencies, interruptions, and lost luggage.

Government Identification; Entry Requirements

Client is solely responsible for obtaining and carrying valid passports, visas, vaccinations, and required documentation. Names must match government-issued identification exactly.

Denied Entry: Travel Advisor is not responsible for denied entry for any reason. Denied entry may result in total financial loss with no entitlement to refund.

Minors: Additional documentation may be required for minors traveling without both parents or legal guardians.

Travel Advisories; Assumption of Risk

Travel to certain destinations involves inherent risks, including health, safety, geopolitical, and pandemic-related concerns. Changes in travel advisories do not override Supplier cancellation or refund policies.

Client acknowledges that participation in travel constitutes acceptance of all associated risks. Fear, anxiety, changes in personal circumstances, or discomfort regarding a destination do not constitute force majeure and do not entitle Client to a refund, credit, or compensation.

Liability; Limitation of Damages; Force Majeure

TRAVEL ADVISOR ACTS SOLELY AS AN AUTHORIZED SELLER AND IS NOT LIABLE FOR ACTS, ERRORS, OMISSIONS, NEGLIGENCE, OR FAILURES OF SUPPLIERS OR PARTNERS.

Travel Advisor disclaims all liability for direct, indirect, incidental, or consequential damages, to the fullest extent permitted by law. Any recovery against Travel Advisor is limited to the commissions and fees actually received.

Travel Advisor is not liable for delays or failures caused by force majeure events, including natural disasters, pandemics, civil unrest, government actions, or other events beyond its control.

Governing Law; Venue; Claims; Class Action Waiver

This Agreement is governed by the laws of the State of Arizona. Client consents to exclusive jurisdiction and venue in Phoenix, Arizona.

Any claim must be brought within 12 months of trip completion. Client waives the right to punitive damages and agrees to bring claims only in their individual capacity, not as part of any class or representative action.

Modifications; Severability; Entire Agreement

Travel Advisor may modify this Agreement at any time. Continued use of services constitutes acceptance of updated terms.

If any provision is deemed unenforceable, the remaining provisions remain in effect. This Agreement constitutes the entire agreement between the parties.

Acceptance

By booking or engaging services with One 11 Travel LLC, Client confirms acceptance of these Terms & Conditions.
