Chickadee Travel Terms and Conditions

Welcome to Chickadee Travel, LLC (“we,” “us,” or “our”). By accepting a travel quote or booking services with us, you (“client,” “you,” or “your”) agree to these Terms & Conditions. Please read this agreement carefully, as it outlines your rights and obligations and limits our liability.

These Terms & Conditions govern the relationship between you and Chickadee Travel, LLC, including all interactions with our Travel Advisors. This document is legally binding, and your acceptance is required to proceed with your travel plans.

1. Role of Travel Advisor

Chickadee Travel, LLC serves as a travel planning and advisory service. Our Travel Advisors act as intermediaries between you and various travel suppliers, including but not limited to airlines, hotels, tour operators, car rental companies, cruise lines, and other providers (collectively, “Suppliers”).

While we strive to arrange seamless travel experiences, your travel contract is ultimately with the Suppliers, and the delivery of their services is beyond our control.

2. Liability Disclaimer: Supplier Actions and Inactions

Chickadee Travel, LLC is not responsible for the acts, omissions, or performance failures of Suppliers. This includes, but is not limited to:

- Flight cancellations, delays, or changes.

- Hotel overbookings or failures to honor reservations.

- Lost or damaged baggage by airlines or transportation providers.

- Service disruptions caused by strikes, labor issues, or Supplier insolvency.

By booking through Chickadee Travel, LLC, you acknowledge that the delivery of services is the responsibility of the respective Supplier.

3. Travel Insurance – Strongly Recommended

We strongly recommend that you purchase travel insurance to protect your travel investment. Travel insurance can provide coverage for the following (non-exhaustive list):

- Trip cancellations, delays, or interruptions.

- Medical emergencies or evacuations.

- Lost, damaged, or delayed baggage.

- Supplier insolvency or default.

- Weather-related disruptions.

Chickadee Travel, LLC is not liable for any events that would be covered under a travel insurance policy. If you choose to decline travel insurance, you assume all associated risks and financial losses.

4. Client Responsibilities: Accurate Information and Travel Documents

It is your responsibility to provide accurate and complete information to our Travel Advisors. Chickadee Travel, LLC is not responsible for issues arising from incorrect or missing information, including but not limited to:

- Misspellings of names, incorrect passport numbers, or other identification errors.

- Failure to secure or present proper travel documents (e.g., passports, visas, health certifications).

- Failure to verify the accuracy of travel details on itineraries, tickets, or reservations.

You must ensure your travel documents are valid for the entire duration of your trip, with the required expiration dates and entry permissions for all destinations.

5. Changes, Cancellations, and Refunds

All changes, cancellations, and refund requests are subject to the policies of the individual Suppliers. Chickadee Travel, LLC will assist in processing requests, but we do not guarantee refunds or favorable outcomes. Clients are responsible for any fees imposed by Suppliers for changes or cancellations.

In the event of a cancellation or change initiated by a Supplier, we will attempt to offer suitable alternatives where available. However, additional costs may apply, and refunds are subject to the Supplier’s policies.

6. Force Majeure (Unforeseeable Events)

Chickadee Travel, LLC is not liable for any losses or disruptions caused by events beyond our control, including but not limited to:

- Natural disasters (e.g., hurricanes, earthquakes, floods).

- Government actions or travel restrictions.

- War, terrorism, pandemics, or civil unrest.

- Supplier insolvency, strikes, or labor disputes.

- Flight delays or cancellations due to weather conditions.

Travel insurance may offer coverage for these events, and we strongly encourage you to obtain appropriate protection.

7. Limitations of Liability

To the maximum extent permitted by law, Chickadee Travel, LLC is not liable for:

- Any direct, indirect, incidental, or consequential damages resulting from your use of Supplier services.

- Injury, illness, or death during your trip.

- Losses related to missed flights, connections, or transport delays.

- Loss of enjoyment or disappointment with your travel experience.

In no event shall our liability exceed the total amount paid to us for our services.

8. Compliance with Laws and Regulations

You are responsible for complying with the laws, regulations, and travel requirements of the countries you visit, including health and safety protocols. Chickadee Travel, LLC is not responsible for your failure to meet these requirements. This includes any consequences arising from non-compliance with COVID-19 policies, customs regulations, or entry restrictions.

9. Payment Terms and Authorization

By providing payment information, you authorize Chickadee Travel, LLC to charge your card or other payment method for all travel-related costs and service fees as outlined in your quote. You authorize Chickadee Travel, LLC and its authorized agents to collect, store, use, and transmit your credit card information for the sole purpose of booking travel and related services. You certify that the information provided above pertains to a credit card issued in your name, and you have the legal authority to use this card. You understand and agree that your credit card details may be shared with our booking partners and service providers strictly to complete these transactions.

All payments are subject to our cancellation policies and those of the Suppliers.

We reserve the right to refuse service or cancel bookings if payment is not received on time.

10. Service Fees

Chickadee Travel, LLC may charge service fees for consulting, planning, and booking travel. These fees are non-refundable and will be disclosed upfront. Service fees are separate from the costs of Supplier services.

11. Dispute Resolution and Governing Law

In the event of a dispute, the parties agree to attempt to resolve the matter through good-faith negotiations. If a resolution cannot be reached, the dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association.

This agreement shall be governed by the laws of the State of Minnesota, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the courts located in Hennepin County, Minnesota.

12. Privacy Policy

We are committed to protecting your personal information. Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

13. Amendments and Severability

Chickadee Travel, LLC reserves the right to modify these Terms & Conditions at any time. Updated terms will be posted on our website and apply to all future bookings.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Acknowledgment and Acceptance

By accepting a travel quote, placing a credit card authorization on file, and/or booking travel with Chickadee Travel, LLC, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
