Jennifer Ellis Travel Terms and Conditions

1. Introduction

By engaging the services of Jennifer Ellis Travel LLC (hereinafter "we," "us," or "our"), you (hereinafter "you" or "Client") agree to be bound by these Terms and Conditions. Please read them carefully before making any travel arrangements through us. These terms are specific to services provided by us and do not supersede or replace any individual travel supplier's terms and conditions.

2. Eligibility and Use of Services

You represent and warrant that:

  • You are at least 18 years of age and are authorized to enter into this Agreement and make travel bookings with us;
  • The information you provide (whether for you or on behalf of others) is true and accurate, and you will continue to provide updated information throughout your engagement with us;
  • You authorize our use of your personal information for bookings, airfare/airline tickets, tours, cruises, restaurant reservations and any other services requested by you; and
  • You will abide by the terms and conditions of this Agreement and any terms and conditions of our travel suppliers or partners that are applicable to your booking.

3. Host Agency Relationship

Jennifer Ellis Travel is affiliated with Fora Travel, Inc., which serves as our host agency and provides technology and payment processing services. When booking travel, we use Fora's industry credentials and systems, which means Fora may appear as the agent of record on certain travel documents and confirmations. However, you are working directly with Jennifer Ellis Travel for all planning and service matters. Fora is not a party to this Agreement.

4. Services Provided

We offer essential planning, full-service planning, and direct booking services. Services may include accommodations, transportation, cruises, tours, activities, and coordination with local partners. The scope of services available depends on the service tier selected.

In providing travel services, we work with various suppliers and service providers, including but not limited to hotels, airlines, cruise lines, tour operators, local partners, ground transportation providers, and activity providers. We may select and engage these suppliers on your behalf based on our professional judgment and your stated preferences.

For full-service planning: Local partners may communicate with you directly regarding logistics and on-the-ground details of your arrangements.

5. Fees

We may charge fees for our essential planning or full-service planning services, which will be mutually agreed with you in writing. Fees may include, but are not limited to, planning fees, rush fees for expedited service, and fees based on group size or complexity. Any fees charged are 100% non-refundable and due before we begin work on an itinerary. These fees compensate for the time spent designing your itinerary and coordinating with suppliers and local partners.

6. Booking and Payment

Price Quotes and Confirmations

Price quotes are estimates only and are subject to change based on availability, demand, currency fluctuations, and supplier pricing adjustments. A reservation is only confirmed, and the price guaranteed, once you have received a booking confirmation from us. All quoted prices are in USD unless otherwise indicated.

You are responsible for any applicable taxes, fees, and charges imposed by airlines, hotels, tour operators, and other suppliers. Currency fluctuations may affect the final amount due for your reservations, particularly for international bookings.

Payment Methods and Authorization

Payment methods accepted include credit and debit cards. In certain circumstances, suppliers may require alternative payment methods such as wire transfers, which we will communicate to you if necessary.

For full-service planning: Certain services coordinated through local partners may require you to make payments directly to those partners. International payments may incur wire transfer fees, foreign transaction fees, and currency conversion costs.

By providing your payment information, you authorize us to process payments to suppliers for the services you have requested. This may include charging your credit card or processing other forms of payment as agreed upon. We will only charge you for services you have authorized us to book on your behalf.

We keep credit cards on file for your convenience, which we may charge for any travel services and associated amounts that are expressly authorized by you. You further certify that you are an authorized user of any credit card provided to us.

You will pay for all travel services promptly when due by paying the supplier directly or, if directed by us, by paying Fora Travel, Inc. who will process the payment on behalf of a supplier.

Payment Requirements

In order for a reservation to be made and confirmed, you must make payments in accordance with the payment schedule and requirements specified by the travel supplier (e.g., airline, hotel, tour operator). We will inform you of these requirements, and it is your responsibility to adhere to them. Failure to authorize timely payments may result in the cancellation of your reservation and potential loss of any deposits paid. We are not responsible for reservations that are not confirmed due to your failure to comply with the supplier's payment requirements.

Credit Card Disputes and Chargebacks

You agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of ours or our travel suppliers or partners, including cancellations or changes of itinerary or arrangements for reasons beyond our control, unless the product or services purchased were never provided or grossly misrepresented. You agree to notify us immediately if any products or services purchased are not as expected and to give us a reasonable opportunity to assist in finding an acceptable resolution with the supplier responsible for providing the product or services.

7. Cancellations, Modifications, and Refunds

Cancellation and modification policies are set by each individual supplier. We will inform you of the specific policies at the time of booking.

You authorize us to modify or rebook your reservations when lower rates or improved terms become available, provided that the essential elements of the booking (such as room type, bedding configuration, and cancellation policies) remain substantially the same or better. We will notify you of any such changes. If you prefer not to have proactive rebookings made on your behalf, please notify us in writing.

You agree to provide us with a minimum of 48 hours' notice by email for us to effect any cancellation or modification requests. We will not be liable for any penalties imposed on you due to untimely requests by you.

Cancellations may be subject to cancellation fees imposed by the supplier. We do not charge additional cancellation fees beyond those imposed by suppliers. Refunds, if applicable, will be processed according to the supplier's policies and may take several weeks to be issued. We are not responsible for cancellations or changes made by suppliers.

8. Communication

We will communicate with you primarily via email and phone, as well as through the travel software Tern. Please ensure that you provide us with your current contact information.

We're committed to being responsive and helpful throughout your travel planning and during your trip. While we strive to respond promptly during business hours, for urgent matters or emergencies requiring immediate assistance during your trip, please contact your travel supplier or insurance provider directly as they are best positioned to assist you in real-time.

9. Travel Documents

You are solely responsible for ensuring that you have all necessary travel documents, including passports, visas, and any required health certificates. A passport is required for international travel, including for children and babies. Many countries require that your passport is valid for at least six (6) months beyond your intended return date. Failure to meet this requirement may result in denied boarding or entry.

When you receive your travel documents, it is your responsibility to ensure the information is correct. All names on documents must match the legal name on your photo I.D., and travel document information must match tickets. Minors may require additional documentation including parental consent forms. Please consult https://help.cbp.gov for specific requirements.

We are not responsible for denied entry into any country. Travelers with criminal convictions may be denied entry to certain countries, including Canada. Being denied entry for any reason may result in a complete financial loss associated with your trip and does not entitle you to any refund.

10. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance to protect against trip cancellations, medical emergencies, travel delays, lost baggage, and other unforeseen circumstances. Travel insurance is not included in our services unless expressly purchased by you.

Without travel insurance, you will be subject to all supplier cancellation penalties and may lose up to the full cost of your travel booking if you need to cancel or interrupt your trip.

We can provide information about travel insurance options, but the final decision to purchase insurance rests with you. We are not a licensed insurance broker, and are not authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of existing insurance coverage. All questions about benefits, exclusions and conditions of any offered insurance should be directed to the insurer or prospective insurer.

11. Travel Advisories and Risk Acceptance

Travel to certain destinations may involve risks related to health, safety, or geopolitical conditions. It is your responsibility to review travel advisories for your destinations.

Changes in travel advisories or personal concerns about a destination do not entitle you to a refund unless you have applicable travel insurance coverage. Your participation in any travel constitutes acceptance of such risk.

12. Liability and Limitations

Our Role as Your Agent

We act as an intermediary between you and travel suppliers (hotels, airlines, cruise lines, tour operators, local partners, and other service providers). We carefully select suppliers based on our professional experience and your preferences, and work diligently to resolve any issues that arise. However, we do not own, operate, or control these suppliers, and cannot guarantee their performance.

For suppliers you select, you are responsible for your own due diligence. For suppliers we recommend, you acknowledge they operate independently and we cannot guarantee their services will meet your expectations.

Limitations on Our Liability

Jennifer Ellis Travel is not liable for issues arising from supplier services or circumstances beyond our control, including but not limited to:

  • Supplier acts, errors, omissions, service failures, cancellations, or operational issues
  • Natural disasters, severe weather, or pandemics
  • War, terrorism, civil unrest, or government actions
  • System outages, technology failures, or equipment malfunctions affecting suppliers or travel infrastructure

Jennifer Ellis Travel's liability is limited to the amount of commission and fees we received for your specific booking. We are not liable for indirect, incidental, or consequential damages.

13. Dispute Resolution

In the event of any dispute, concern, or claim arising from or relating to our services or this Agreement, you agree to first contact us directly to attempt an informal resolution before pursuing any legal action. We are committed to working with you in good faith to resolve any issues.

14. Choice of Law and Forum

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, exclusive of its choice of law rules. You hereby consent to the exclusive jurisdiction and venue of courts in Norfolk County, Massachusetts in all disputes arising out of or relating to travel bookings with Jennifer Ellis Travel. To the extent any provision of this Agreement conflicts with applicable Massachusetts consumer protection laws, those laws shall govern.

15. Entire Agreement

These Terms and Conditions, together with any service agreements or fee schedules, constitute the entire agreement between the parties with respect to the subject matter hereof.

16. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time, in our sole discretion. Updated versions of this Agreement are effective immediately upon provision to Client. The most current version of these terms and conditions will be available on jenniferellistravel.com.

18. Acceptance

By proceeding with booking travel services through us, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

Acceptance of these Terms and Conditions may occur through: (a) explicit written acknowledgment, (b) approval of booking quotes or proposals that reference these Terms, (c) payment for services, or (d) any other conduct indicating acceptance.
