STORIED GETAWAYS LLC

Storied Getaways LLC is a travel agency specializing in planning domestic and international travel experiences, including river and ocean cruises and all-inclusive vacations. The terms "we," "us," "our," "STORIED GETAWAYS," and "Storied Getaways Travel" refer to Storied Getaways LLC, a California limited liability company and an independent affiliate with WorldVia Travel Network, a Travel Leader’s Network Associate. The terms "you," "guest," "traveler," "client," or "participant" refer to the person making a booking with us and all members of their traveling group.

CONTRACT

We draw your attention to these Terms and Conditions of travel, which incorporate all brochures, documents, correspondence, and the terms and conditions of our Suppliers (as herein defined), and which form the basis of our legally binding contract with you ("Terms and Conditions" or "Agreement"). Before making a booking with us or paying any planning fees, you must ensure that you have read and understood these Terms and Conditions. Please be aware that these Terms and Conditions contain waivers of liability, as well as class action waiver, venue selection, and notice clauses.

By making any payment to STORIED GETAWAYS or participating in any of our travel experiences, you accept all the Terms and Conditions set forth herein (including the Cancellation and Chargeback sections) and acknowledge that you have read and agree to the terms of this legally binding agreement. If you do not agree with any part of these Terms and Conditions, you must not make a booking with us or engage us for travel-related services.

These Terms and Conditions govern the relationship between Storied Getaways LLC and you, the purchaser or traveler ("Client" or "you"). By planning travel with STORIED GETAWAYS, you agree to be bound by these terms and acknowledge that STORIED GETAWAYS acts solely as a booking agent for disclosed principal suppliers, including tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”). STORIED GETAWAYS is not the source or provider of the travel services. These terms include warranties, disclaimers, and exclusions of liability, and may restrict your rights and remedies and provide protection to STORIED GETAWAYS.

1. USE OF STORIED GETAWAYS SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with STORIED GETAWAYS. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with STORIED GETAWAYS and its Suppliers, and you acknowledge that any speculative, false, or fraudulent reservation is prohibited.

STORIED GETAWAYS accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through STORIED GETAWAYS, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

STORIED GETAWAYS is not liable or responsible for any arrangements made independently of STORIED GETAWAYS. STORIED GETAWAYS assumes no responsibility for costs or fees you incur for independent arrangements not booked through us, including, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, STORIED GETAWAYS is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made independently. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel, casino, and airline rewards or points cannot be redeemed for travel arrangements made by STORIED GETAWAYS.

If you are making a booking as a group/family, the designated travel leader is responsible for sharing these Terms and Conditions with all members of the group/family for whom they are making a booking and is financially responsible for the booking. STORIED GETAWAYS LLC will not be liable for a travel leader’s failure to share these Terms and Conditions with all travelers in their group.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you, or members of your group, is true and correct.

2. VIOLATIONS BY YOU

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel-related product or service.

3. CHANGES TO THESE TERMS AND CONDITIONS

STORIED GETAWAYS LLC reserves the right, in our sole discretion, to change these Terms and Conditions at any time and without notice. Updated versions of the Terms and Conditions will be posted on our website and are effective immediately upon posting. The current terms will apply to your booking. You must therefore be familiar with the terms in effect at the time you book. Your continued use of our services, including continuing to use or maintain any bookings after any changes to these Terms and Conditions, constitutes your consent to any changes.

4. SCOPE OF RESPONSIBILITY/AGENCY DISCLAIMER

Storied Getaways LLC acts solely as a booking agent for independent third-party suppliers who provide travel products such as flights, accommodations, and cruises ("Travel Products"). These suppliers are responsible for the Travel Products and any associated amenities. Your booking is subject to the terms, conditions, and privacy policies of the individual suppliers. By booking, you acknowledge that Storied Getaways LLC is not responsible for the acts, omissions, negligence, bankruptcy, insolvency, or default of any supplier. Your interaction with any supplier is at your own risk.

Right to Correct Errors and Offers Subject to Availability

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares, and additional late booking fees. Availability and pricing of services may fluctuate based on the Supplier’s pricing policies.

5. BOOKING/PAYMENT; SERVICE FEES

To initiate travel planning, please contact us for a complimentary consultation via email, phone, or by filling out the contact form on our website at https://storiedgetaways.com/. Our itineraries require significant planning and effort to create unique experiences for our travelers; as such, a NON-REFUNDABLE planning fee will apply as further described herein. Any and all fees relating to our travel planning services, including, without limitation, planning fees, revision or change fees, cancellation fees, and ticketing fees (collectively, "Service Fees"), are NON-REFUNDABLE and must be received in full by STORIED GETAWAYS LLC before any proposal or itinerary is presented.

If you decide to move forward with your reservation, booking will be confirmed upon receipt of the required traveler information and payment of the applicable NON-REFUNDABLE deposit(s) to Supplier(s). After the booking is processed, you will receive your final itinerary, an invoice with payment information, Supplier terms and conditions, and other important travel information. The invoice will contain a breakdown of the elements of your booking and is subject to change until you receive confirmation that your travel is booked. Some Suppliers may require a larger deposit, or payment in full, to hold your booking; you will be notified of the required amount. You must also execute a legally binding payment authorization in connection with your travel purchases. Your acknowledgment and agreement to these Terms and Conditions are required in connection with the foregoing.

Our NON-REFUNDABLE planning fee, usually a minimum amount of $50, is determined based on the complexity of your trip, in our sole discretion, for custom itinerary creation and travel planning support. This customized planning fee is billed after a customized itinerary is requested and is NON-REFUNDABLE even if you cancel your trip or decide not to book. Please note that your customized proposal is valid for fourteen (14) days and is not guaranteed until a deposit is made. Flight, hotel and tour/travel options and pricing are not guaranteed until booked, and can change due to constant market fluctuations. Pricing and availability are subject to change at any time based upon supply and demand. Furthermore, if your trip is scheduled to depart within sixty (60) days, an additional NON-REFUNDABLE expedited travel planning fee of $150 will be assessed for this expedited service.

If you choose to have us assist with booking your airfare reservations, a NON-REFUNDABLE ticketing fee of $25 per person for domestic flights and $50 per person for international flights may be assessed (and will be noted in your trip proposal, payable at the time of booking).

Inter-tour airfare is only included as expressly described in your itinerary. If you independently purchase your airfare, you must not make any air reservations until you receive written confirmation of your booking from STORIED GETAWAYS. Travelers who independently purchase airfare prior to receiving such confirmation do so at their own risk and are solely liable for any resulting change fees, penalties, or losses related to said booking. Your contract for airfare is with the carrier and subject to its terms, conditions, and policies; we will not be liable for any change and/or cancellation fees or other additional costs you incur with the air carrier.

Following approval of your final itinerary and after your booking is processed, we will provide you with instructions regarding payments and all due dates. While STORIED GETAWAYS LLC may send a payment schedule reminder, it is the traveler’s sole responsibility to make all payments in full and on time as required by the applicable travel Supplier. Failure to make any payment by the stipulated deadline, including full and final payment, may result in the cancellation of your travel. In such a case, this would be considered a cancellation by you, and the cancellation terms and fees as described in the relevant section below would be in effect. Further, you are only entitled to request or make changes to your itinerary as stipulated in the Changes and Cancellation section below. Traveler understands that discounted fares typically involve restrictions and that changing any aspect of the travel arrangements may result in the payment of additional monies in order to accomplish said changes.

Group Travel, All-Inclusive or Vacation Package Travel

Our group travel options are carefully curated experiences for groups of participants; as such, you are not able to request or make any changes to your finalized itinerary. Since some of our trips, including our tours and all-inclusive vacations, are purchased as complete packages, you are not entitled to request, and will not be provided with, an itemized breakdown of costs in connection therewith due to the contractual agreements with our Suppliers.

Group travel is often based on a minimum number of participants. If the trip drops below the minimum number of participants, cancellation of the trip may occur at the sole discretion of the applicable travel Supplier and/or STORIED GETAWAYS LLC. Furthermore, when STORIED GETAWAYS LLC accompanies a travel group as an onsite travel advisor/escort, any and all decisions made by us will be for the safety and well-being of the group and in accordance with these terms. STORIED GETAWAYS LLC will not be liable for situations resulting in, but not limited to, any delayed or missed flights or activities due to a traveler’s untimeliness, inability to keep up with the group, or issues with traveler information or documentation (e.g., misplaced passport, etc.). The traveler will be solely responsible for any and all costs incurred related to said situations. While STORIED GETAWAYS LLC may attempt to assist the traveler in said situations, STORIED GETAWAYS LLC must remain with the group and will not be able to stay behind with an individual traveler.

6. AIRFARE / AIRLINE TRAVEL

Your airline ticket is a contract between you and the air carrier, even if you purchase it through STORIED GETAWAYS. If you purchase air travel through STORIED GETAWAYS, you acknowledge and agree that we do not have the right to control the operations of independent airlines and agree that STORIED GETAWAYS is not liable for any personal injury or property damage related to your purchase of air tickets or air travel, including, but not limited to, any act, error, omission, injury, loss, accident, or delay caused by the airline. This includes an airline’s failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy, or cessation of operations.

You understand and agree that STORIED GETAWAYS functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because STORIED GETAWAYS does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees, or seat assignments must come directly from the airline and not from STORIED GETAWAYS.

STORIED GETAWAYS shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only. In those rare instances, you will be responsible for payment of cash departure taxes while traveling.

7. PAYMENT METHODS / CHARGEBACKS

Payments will be processed through a secure online system and may be made via major debit and credit cards (Visa, Mastercard, American Express, and Discover) and ACH transfers, as applicable. Travelers must provide a click (checkbox) or signed authorization for every transaction related to their trip. This authorization constitutes a legally binding agreement for STORIED GETAWAYS LLC and/or the Supplier to process payment and signifies your acknowledgment and agreement to these Terms and Conditions, including the cancellation terms. You further agree not to initiate any improper chargebacks.

You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through STORIED GETAWAYS. By submitting a credit card authorization form to STORIED GETAWAYS, you agree to allow STORIED GETAWAYS to use your payment method to purchase travel products from our Suppliers on your behalf. EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF STORIED GETAWAYS OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF STORIED GETAWAYS OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE, OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, STORIED GETAWAYS RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES, AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL, OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. Suppliers may require non-US travelers to make payments in United States Dollars when making arrangements through STORIED GETAWAYS. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations.

In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to STORIED GETAWAYS in writing. As a result of cancellation or changes to confirmed bookings, third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund.

Before initiating a chargeback with a credit card company or payment processor (“chargeback”), you must first email catherine.storiedgetaways@gmail.com with any questions or concerns related to the charge. We will make reasonable efforts to resolve such concerns. STORIED GETAWAYS LLC reserves the right to dispute any improper chargeback and to recover any associated costs, including attorney’s fees. We also reserve the right to cancel any travel reservation connected to an improper chargeback.

Improper chargeback scenarios include, without limitation:

• Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
• Chargebacks resulting from charges authorized by family members, friends, associates, or any third party with direct access to your credit card (excluding fraud).
• Chargebacks arising from inconsistency or inaccuracy in the Supplier’s product description.
• Chargebacks resulting from force majeure or circumstances beyond the control of STORIED GETAWAYS LLC or the Supplier.
• Chargebacks filed because you disagree with the cancellation policy.
• Chargebacks filed because you were not provided with an itemized cost breakdown for your trip.
• Chargebacks resulting from dissatisfaction with Supplier-provided products or services.

8. PRICE AND RATE CHANGES; FOREIGN TRANSACTION FEES

The price listed in your proposal is based on known costs as of the proposal’s issuance date. While all advertised prices are accurate at publication, Suppliers may adjust pricing, and STORIED GETAWAYS LLC reserves the right to update those prices accordingly. Prices may include estimated costs for fuel or local taxes, which remain subject to change. At booking confirmation, you will receive an invoice reflecting the current price and inclusions.

Upon payment of your deposit and applicable Service Fees, and upon written booking confirmation, your price will be locked in except for increases or decreases related to fuel surcharges, airport charges, scheduled airfares, transportation-related charges, local taxes or dues, government actions, currency fluctuations, port fees, airline surcharges, tariffs, or other Supplier-imposed fees. If our cost to supply your travel increases, we may apply a supplemental charge and will issue an updated invoice reflecting such changes. Subject to these exceptions, your price is locked in after final payment.

STORIED GETAWAYS LLC reserves the right to adjust or correct advertised pricing prior to confirmation of travel. Any known errors and corresponding price adjustments will be communicated to you at the time of booking.

Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations. STORIED GETAWAYS is not responsible for surcharges or foreign transaction fees imposed by Client’s credit card or bank.

9. CHANGES AND CANCELLATION BY TRAVELER

Changes by Traveler

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and you will be responsible for any increases in cost imposed by the Supplier, as well as any STORIED GETAWAYS or Supplier change fees. All requests for changes to a booking must be made in writing to STORIED GETAWAYS. When tour, cruise, or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel.

Since changes may be considered cancelled services, additional cancellation penalties may apply. All changes are subject to Supplier availability and may incur additional fees. Changes to airfare or other ticket contracts, including cruise lines, are subject to the applicable Supplier’s terms and conditions. In addition to Supplier change fees, STORIED GETAWAYS LLC may, in its sole discretion, charge a change fee starting at $25 per traveler/per booking.

Cancellation by Traveler

Cancellation must be submitted in writing to catherine.storiedgetaways@gmail.com and becomes effective on the date received. All Planning and/or Service Fees paid to STORIED GETAWAYS LLC are NON-REFUNDABLE. Each Supplier maintains its own cancellation policies, which may result in additional fees. Upon receiving your cancellation request, we will contact the Suppliers to determine whether any refund is available, subject to Supplier terms. Any refund, credit, or voucher is the sole responsibility of the Supplier. STORIED GETAWAYS LLC is not responsible for Supplier refusal, delay, insolvency, or bankruptcy. Airline tickets are governed exclusively by the air carrier’s policies. Cruise refund policies vary by cruise line. If a Supplier issues a refund or credit, it will be returned in the form of the original payment method. STORIED GETAWAYS LLC may charge an additional cancellation fee of at least $100 per person, per booking, per room (depending on complexity) for our time in processing traveler’s cancellation(s).

IMPORTANT: If your reason for cancellation is covered under your travel protection plan, you may be able to recover certain losses. We strongly recommend purchasing comprehensive travel protection. Storied Getaways does not handle or process claims that a passenger may make against their travel/trip protection policies.

10. CHANGES AND CANCELLATION BY SUPPLIER AND/OR STORIED GETAWAYS

If a Supplier must make a significant change or cancel your confirmed booking, we will notify you as soon as reasonably possible and assist with rebooking efforts.

11. FORCE MAJEURE

STORIED GETAWAYS LLC assumes no liability for loss, damage, delay, or cancellation resulting from force majeure events. We will not be in breach of this Agreement or otherwise liable to you for any failure or delay in performing an obligation hereunder that is due to causes beyond our reasonable control. Such events include, but are not limited to: natural disasters, fire, volcanic eruptions, hurricanes, severe weather, floods, power outages, environmental hazards, riots, civil unrest, acts of terrorism, war, government actions, epidemics/pandemics (including COVID-19), labor strikes, technological outages, breakdown of communication facilities, equipment malfunction, or any other unforeseen circumstance beyond the control of STORIED GETAWAYS.

In such circumstances, we are not obligated to provide refunds. If we successfully recover funds from Suppliers, we will refund those specific amounts to you.

THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

Each of STORIED GETAWAYS’s Suppliers maintains terms and conditions which include force majeure provisions. In the event a force majeure event occurs, those Suppliers may be entitled to, and may in their sole discretion, vary, postpone, or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although STORIED GETAWAYS shall use its reasonable efforts to secure reimbursement for you where possible.

12. TRAVEL PROTECTION / INSURANCE

Travel protection is NOT included unless specifically listed on your invoice. It is the traveler’s sole responsibility to protect their trip investment. We strongly recommend purchasing comprehensive travel insurance, including coverage for cancellation, interruption, medical emergencies, evacuation/repatriation, baggage delay/loss, and missed connections. Cancel-For-Any-Reason (CFAR) coverage may also be available.

While STORIED GETAWAYS LLC may recommend insurance options, we are not an insurance broker and are not liable for coverage disputes, claim denials, the adequacy of the policy, or technical interpretations of insurance benefits. Any cancellation fees charged by STORIED GETAWAYS LLC or Suppliers will not be reimbursed unless explicitly covered by your policy. For all questions and claims, you must contact your insurer directly.

Some countries require valid medical insurance for entry. STORIED GETAWAYS LLC is not responsible for denied entry due to inadequate insurance. Declining travel protection may result in significant financial loss. If you choose to travel without adequate insurance, STORIED GETAWAYS LLC will not be liable for any losses for which insurance coverage would otherwise have been available.

STORIED GETAWAYS offers access to travel insurance to protect passengers and their investment. Unless specifically noted, travel insurance is not included in the cost of your itinerary to protect against third-party Supplier default/bankruptcy protection, delay, interruption, cancellation, medical emergency transportation/evacuation, baggage loss/delay, illness, and more.

Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of the trip/tour may not be refunded, and STORIED GETAWAYS’s and travel Suppliers’ cancellation penalties will apply, potentially resulting in the loss of monies up to the full cost of your travel booking and related costs. The purchase of travel insurance is not required to purchase any other product or service offered by STORIED GETAWAYS; however, if you decline to purchase insurance, STORIED GETAWAYS may require that you execute an insurance waiver.

STORIED GETAWAYS is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, or conditions of any insurance offered, nor evaluate the adequacy of prospective insured's existing insurance coverage. An additional charge applies for any travel insurance selected. It is your responsibility to understand your insurance policy coverage and to put alternative coverage in place if you wish to insure for conditions excluded by your policy. STORIED GETAWAYS CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE.

13. DESTINATIONS AND DOCUMENTATION

Travel to certain destinations may involve greater risk than others. STORIED GETAWAYS LLC urges travelers to remain informed daily as to current news and to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel.

Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found on government websites, including: http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free U.S. government service for U.S. citizens traveling or living abroad, which allows the Department of State to better assist in an emergency. Registration is recommended via https://step.state.gov/step/.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, STORIED GETAWAYS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.

Further information on conditions in various countries and the level of risk is available at https://travel.state.gov/content/travel.html and http://www.cdc.gov. You should also consult government websites to ensure compliance with all entry requirements, including any COVID-19 mandates, medical tests, tracking, and local laws. A U.S. State Department list of travel advisories is available at https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/. Should you choose to travel to a country that has been issued a travel warning or advisory, STORIED GETAWAYS will not be liable for damages or losses that result from travel to such destinations.

Individual Entry and Exit Requirements

Each country maintains different rules of entry for travel, including views on past criminal offenses, whether within or outside of the U.S.

14. NON-RESPONSIBILITY

STORIED GETAWAYS LLC and its members, managers, president, owners, employees, affiliates, agents, and representatives (“Representatives”) use third-party Suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this trip. STORIED GETAWAYS LLC is an independent contractor and is not a Representative of any of these Suppliers. STORIED GETAWAYS LLC does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel, restaurant, or any other entity that supplies services related to your trip. All Suppliers are independent contractors and are not Representatives of STORIED GETAWAYS.

All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each Supplier. By accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither STORIED GETAWAYS nor its Representatives are or may be liable for any loss, injury, or damage to any traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of STORIED GETAWAYS, including in the event any third-party providers or healthcare professionals seek to assist with medical or other help.

STORIED GETAWAYS assumes no responsibility or liability for any delay, schedule change, loss, injury, or damage that may result from any act or omission of others; STORIED GETAWAYS assumes no responsibility or liability for personal property; and STORIED GETAWAYS shall be entirely relieved of any obligations under these Terms in the event of force majeure. STORIED GETAWAYS accepts no responsibility for lost or stolen items. Further, STORIED GETAWAYS reserves the right to refuse any customer or potential customer at its sole discretion.

Limitations of Responsibility and Disclosure

STORIED GETAWAYS acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of STORIED GETAWAYS. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those Suppliers.

STORIED GETAWAYS is not responsible if a restaurant, tour operator, cruise line, or other service provider on your tour is unable to or fails to accommodate your dietary restrictions or requirements.

The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and STORIED GETAWAYS bears no responsibility for any changes.

BECAUSE STORIED GETAWAYS ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT STORIED GETAWAYS IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. STORIED GETAWAYS HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH STORIED GETAWAYS. THIS DISCLAIMER INCLUDES, WITHOUT LIMITATION, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF STORIED GETAWAYS’S CONTROL, AND YOU HEREBY EXONERATE STORIED GETAWAYS FROM ANY LIABILITY WITH RESPECT TO THE SAME.

STORIED GETAWAYS has solely received commission and fees for travel transactions, and Client agrees and understands that any recovery from STORIED GETAWAYS will be limited to the amount of commission and fees actually received by STORIED GETAWAYS.

15. ASSUMPTION OF RISK/WAIVER

Traveler acknowledges travel involves inherent risks including injury or death from force majeure, vehicle collisions, water activities, roadway hazards, slips and falls, crime, terrorism, government actions, contaminated food or water, exposure to natural elements, negligence of others, animal encounters, illness in remote areas, pre-existing medical conditions, infectious diseases, equipment malfunction, or inadequate medical care. Traveler accepts all such risks voluntarily. Traveler agrees to hold harmless and fully release STORIED GETAWAYS LLC and its Representatives from all claims, including negligence, and covenants not to sue. These terms bind traveler’s heirs and survive termination of these Terms.

16. INDEMNIFICATION

Traveler agrees to indemnify and hold harmless STORIED GETAWAYS LLC and its Representatives from any damages, losses, liabilities, judgments, settlements, or expenses (including attorneys’ fees) arising from traveler’s breach of these Terms, acts or omissions, inherent travel risks, or third-party claims. This obligation survives termination.

17. HEALTH/PRE-EXISTING CONDITIONS/PERSONS WITH DISABILITIES

Traveler must disclose disabilities, medical conditions, or special requirements before booking. STORIED GETAWAYS LLC will communicate requests to Suppliers but cannot guarantee ADA compliance. Travelers with disabilities must travel with a fully paid companion who can assist them. Pregnant travelers must confirm Supplier restrictions and provide medical clearance. STORIED GETAWAYS LLC may request health information and may decline participation for safety reasons.

18. YOUR BEHAVIOR

Travelers must comply with all Supplier rules and behave responsibly. Suppliers may remove travelers for misconduct, danger, or disruption, without refund. Travelers are liable for damage caused by themselves or their party and must indemnify STORIED GETAWAYS for claims arising from such conduct.

Each participant in any trip escorted by STORIED GETAWAYS is expected to act responsibly and adhere to all behavior guidelines established by STORIED GETAWAYS and our Suppliers, including adhering to dress codes at religious or cultural sites, or Supplier dress codes. STORIED GETAWAYS and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location, or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places you visit. In any such case, there will be no refund.

When you book with STORIED GETAWAYS, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify STORIED GETAWAYS for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold STORIED GETAWAYS or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant.

Any transportation, possession, or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over-the-counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.

19. PHOTOGRAPHIC/VIDEO LIKENESS AND FEEDBACK

Traveler grants STORIED GETAWAYS LLC a perpetual, royalty-free license to use testimonials, reviews, photos, and videos for marketing purposes. Travelers may request the removal of specific media via email.

20. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of California. All claims and disputes arising under or related to this Agreement must be brought exclusively in the state or federal courts located in Alameda County, California. Traveler hereby consents to the personal jurisdiction of such courts.

21. CLASS ACTION WAIVER AND LIMITATION OF DAMAGES

Traveler agrees to bring claims only individually and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Traveler waives the right to punitive damages and agrees that STORIED GETAWAYS’s maximum liability shall not exceed the total amount that STORIED GETAWAYS has received as commission and fees for their travel transactions. Client agrees and understands that any recovery from STORIED GETAWAYS will be limited to the amount of commission and fees actually received by STORIED GETAWAYS.

22. JURY WAIVER AND NOTICE OF CLAIM

Traveler waives all rights to a jury trial in any action or proceeding arising out of or relating to this Agreement. Traveler must submit written claims to STORIED GETAWAYS LLC within fourteen (14) days of the trip end date and must file any formal suit or action within one (1) year of the conclusion of the travel arrangements.

23. ELECTRONIC COMMUNICATIONS

Traveler consents to receive communications from STORIED GETAWAYS LLC electronically, including emails and website postings. This consent fulfills any legal requirement that such communications be in writing.

24. ENTIRE AGREEMENT & SEVERABILITY

These Terms and Conditions, all applicable Supplier terms, and final invoices constitute the entire agreement between the Traveler and STORIED GETAWAYS LLC concerning the subject matter hereof, superseding all prior or contemporaneous communications, proposals, and agreements, whether oral or written. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

25. MISCELLANEOUS

The English language controls all interpretations of this Agreement. The rule of construction that ambiguities in a contract are construed against the drafter shall not apply to this document.

Pricing and Availability

• All pricing and availability are subject to change until supplier(s) confirm the reservation(s).
• Prices are based on current supplier rates, availability, taxes, and fees at the time of booking.
• Suppliers may adjust pricing at any time prior to confirmation, and you will be notified of any changes affecting your reservation.

Payment Requirements

• A deposit is required to secure your reservation. The specific deposit amount and due date will be outlined in your proposal or itinerary.
• Final payment is due by the date indicated in your itinerary. Failure to remit payment by the deadline may result in automatic cancellation of your reservation and forfeiture of deposits.
• By submitting your credit card information through the Tern Travel or WorldVia PCI‑compliant payment portals, you authorize Storied Getaways LLC to process approved payments with each supplier on your behalf.
• Payments must be made directly to the supplier or to Storied Getaways LLC’s host agency, WorldVia Travel Network, in accordance with California Seller of Travel laws. (Travel advisors are legally prohibited from directly collecting client payments for purchased travel.)

Accepted Payment Methods

• Credit Cards: All credit card transactions must be processed directly with the supplier or via an approved PCI‑compliant system. Storied Getaways currently uses Tern Travel and WorldVia PCI‑compliant payment systems.
• Checks: If paying by check, payments must be made payable to WorldVia Travel Network and mailed to the Roswell, GA office for processing. A service fee may apply to check payments.
• Certain suppliers may impose additional payment restrictions or require immediate payment; such requirements will be communicated when applicable.

Cancellation and Refund Policy

• All cancellation policies, penalties, and refund rules are determined by the supplier(s) providing your travel services. These policies will be provided in your itinerary and supplier Terms & Conditions.
• Refunds, when permitted, will be issued solely in accordance with the supplier’s policies. Processing times vary by supplier.
• Any cancellation, modification, or change request may result in additional fees imposed by the supplier or WorldVia Travel Network.
• Storied Getaways LLC is not responsible for supplier insolvency, schedule changes, or decisions that impact refund eligibility.

Travel Insurance

Travel insurance is strongly recommended to protect your travel investment against unforeseen events such as medical emergencies, trip delays, cancellations, travel interruptions, and baggage loss. Quotes can be provided through our preferred travel insurance partners.

If you decline travel insurance, you will be required to sign an acknowledgment form confirming your decision and understanding of the associated risks.

Trust Account Compliance – California Requirements

Storied Getaways LLC does not take client/traveler payments into a bank or trust account.

1. Passenger payments are made by credit card directly to travel suppliers.
2. Storied Getaways LLC does not deposit, negotiate, or factor the credit card charge, nor otherwise obtain payment of or credit the amount of the credit card charge to any account it controls.
3. (a) If the client/traveler’s charge includes transportation, the transportation carrier processes the credit card. (b) If the charge is only for services, the provider of services processes the credit card charge.

California Consumer Notice & Disclosure

We are a participant in the State of California Travel Consumer Restitution Fund (TCRF).

California Residents: This transaction is covered by the TCRF if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider, or if such money was not refunded when required.

• The maximum amount payable by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000.
• A claim must be submitted to the TCRF within twelve (12) months of the scheduled completion date of travel.
• Claims must include sufficient documentation and a $35 processing fee.
• Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which a TCRF claim is filed.

Non‑Residents of California: Transactions with Storied Getaways LLC are not covered by the TCRF.

Disclosures Provided to Clients

You will receive documentation that includes:

• Total cost of your planned travel arrangements
• Amounts paid to date and remaining balance
• Payment schedule and due dates
• Purpose of each payment received.
• An itemized statement of outstanding charges, if any
• A confirmed itinerary including travel service providers, dates, times, locations, and any conditions under which details may change.

Planning/Service Fees

Storied Getaways LLC may charge a Planning Fee or Service Fee. This fee will be communicated and collected prior to proceeding.

• Planning/Service fees are invoiced separately from travel bookings.
• These fees are non-refundable. Should you decide not to proceed with booking a trip planned by Storied Getaways, any planning fee paid will not be refunded.

Planning fees reflect the initial time and expertise provided by Storied Getaways in building the client’s itinerary/proposal.

Examples of when a planning fee may be charged include:

• Customized itinerary planning tailored to the client’s preferences and needs.
• Booking of flights only (commodity products that are typically non‑commissionable)
• Insider knowledge and access, such as securing the best rate or availability with suppliers.
• Passport and visa assistance
• Ongoing consultation regarding destinations or trip types to save clients time and avoid pitfalls.
• Post‑booking service, including after‑hours support for issues with accommodations or transportation.

Traveler/Client Acknowledgment

By authorizing payment, you confirm that you have reviewed, understood, and agree to these Payment Terms and Conditions and all applicable supplier Terms & Conditions.

Storied Getaways LLC is registered as a Seller of Travel in California. CST #2167514‑70. Registration as a Seller of Travel does not constitute approval by the State of California.
