1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website, communications, and travel advisory services of Viking Trail Journeys LLC, a South Carolina limited liability company (“Viking Trail Journeys,” “Company,” “we,” “us,” or “our”). By visiting our website, contacting us, requesting a quote, or booking travel through us, you (“you,” “Client,” or “Traveler”) agree to be bound by these Terms. If you do not agree, please do not use our website or services.
These Terms apply in addition to, and do not replace, the terms and conditions, fare rules, and contracts of the airlines, cruise lines, tour operators, hotels, and other travel suppliers (“Suppliers”) whose services we help you book.
2. Our Role as a Travel Advisor
Viking Trail Journeys LLC acts solely as a travel advisor and booking agent. We arrange, recommend, and facilitate travel services — including FIT (independent) travel, ocean and river cruises, all-inclusive vacations, and escorted tours — provided by independent third-party Suppliers. We do not own, operate, manage, or control any airline, cruise line, hotel, ground transportation company, tour operator, or other Supplier.
When you book through us, you enter into a direct contractual relationship with the applicable Supplier(s), and your trip is subject to that Supplier's own terms and conditions, fare rules, cancellation policies, and liability limitations, which we encourage you to read carefully before booking. Viking Trail Journeys LLC is not responsible for the acts, omissions, errors, representations, warranties, breaches, or negligence of any Supplier, or for any injury, damage, loss, accident, delay, or irregularity that may result from the acts or omissions of any Supplier or its personnel.
3. Website Use Terms
3.1 Permitted Use
You may use our website for your own personal, non-commercial purpose of researching and booking travel. You agree not to misuse the website, interfere with its operation, attempt to gain unauthorized access to any portion of it, or use any automated system (bot, scraper, or similar) to access or collect content from it without our prior written consent.
3.2 Intellectual Property
All content on our website — including text, graphics, logos, images, and the Viking Trail Journeys name and marks — is owned by us or our licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. Supplier names, logos, and marks referenced or displayed on our website (including those of cruise lines and tour operators we sell) remain the property of their respective owners and are used to describe or promote bookable travel services. You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written permission.
3.3 No Warranty; Availability
We aim to keep information on our website (including pricing, availability, and itinerary details) accurate and current, but pricing, availability, and offer details are supplied by Suppliers and subject to change without notice. We do not guarantee the accuracy, completeness, or timeliness of any information on the website and are not liable for errors, omissions, or changes in Supplier-provided content, including promotional or sale pricing.
4. Booking and Payment Terms
4.1 Quotes and Reservations
Quotes provided by Viking Trail Journeys LLC are estimates only and are not confirmed or guaranteed until the applicable Supplier issues a confirmed booking and any required deposit has been received and processed. Prices, taxes, fees, and availability can change at any time prior to confirmation.
4.2 Deposits and Final Payment
Deposit amounts and final payment due dates are set by the Supplier for each trip and will be communicated to you at the time of booking. Failure to submit final payment by the applicable deadline may result in automatic cancellation of your reservation and forfeiture of your deposit, in accordance with the Supplier's policies.
4.3 Price Changes
Prices quoted are subject to change until a reservation is fully deposited or paid in full, and in some cases thereafter (for example, due to fuel surcharges, currency fluctuation, government-imposed taxes or fees, or Supplier price adjustments permitted under the Supplier's contract of carriage or booking terms). We will make reasonable efforts to notify you of any such changes we become aware of.
4.4 Cancellations and Refunds
Cancellation policies, penalties, and refund eligibility are established by each Supplier and vary by itinerary, fare type, and timing — not by Viking Trail Journeys LLC. Many fares and promotional rates are non-refundable or carry cancellation fees that increase closer to departure. You are responsible for reviewing the specific cancellation policy applicable to your booking before purchasing. Any advisory service fees charged by Viking Trail Journeys LLC (where applicable) are separate from Supplier penalties and are non-refundable once services have been rendered, except as otherwise agreed in writing.
4.5 Changes to Bookings
Requests to change a confirmed booking (dates, cabin/room category, names, itinerary, etc.) are subject to the Supplier's change policy and may incur change fees or fare differences. We will assist with change requests but cannot guarantee a Supplier will accommodate them.
5. Travel Risk, Consent, and Client Responsibilities
5.1 Assumption of Risk
Travel — including ocean and river cruises, international travel, and independent (FIT) travel — involves inherent risks, including but not limited to illness, injury, accident, delay, adverse weather, political unrest, and other circumstances beyond our control or the control of any Supplier. By booking travel through Viking Trail Journeys LLC, you voluntarily assume all such risks and acknowledge that neither Viking Trail Journeys LLC nor its owners, employees, or representatives can guarantee your safety or the safety of your travel companions.
5.2 Travel Insurance
We strongly recommend that all Clients purchase comprehensive travel insurance, including trip cancellation/interruption, medical, and medical evacuation coverage, at the time of booking. If you decline travel insurance when offered, you acknowledge that you do so at your own risk and that Viking Trail Journeys LLC is not responsible for any losses that adequate travel insurance would otherwise have covered.
5.3 Travel Documents and Entry Requirements
You are solely responsible for ensuring you and your traveling companions hold a valid passport (and, where required, visas, vaccination records, or other entry documentation) that meets the requirements of every country on your itinerary, including passport validity requirements (commonly at least six months beyond your return date). We can provide general guidance, but you should confirm current requirements with the relevant embassy, consulate, or official government resource (such as travel.state.gov) before departure. We are not liable for any Client's failure to obtain proper travel documentation.
5.4 Health, Safety, and Government Advisories
You are responsible for reviewing U.S. Department of State travel advisories, U.S. CDC health notices, and any Supplier-specific health or vaccination requirements applicable to your destination before booking and before departure.
5.5 Special Requirements and Accessibility
If you or a traveling companion has a medical condition, mobility limitation, dietary restriction, or other special need, please notify us at the time of booking so we can communicate this to the applicable Supplier. We will make reasonable efforts to assist, but accommodation is ultimately subject to the Supplier's capabilities and policies.
6. Limitation of Liability
To the fullest extent permitted by South Carolina law, Viking Trail Journeys LLC, its owners, members, and employees shall not be liable for any indirect, incidental, special, or consequential damages, or for any injury, illness, death, damage, loss, delay, accident, or irregularity that may be caused by (a) the acts, errors, omissions, or negligence of any Supplier or third party not under our direct control; (b) mechanical failure, overbooking, strikes, weather, or other force majeure events; or (c) your failure to obtain adequate travel insurance or proper travel documentation. In no event shall the aggregate liability of Viking Trail Journeys LLC for any claim arising from our advisory or booking services exceed the total advisory service fees you paid directly to Viking Trail Journeys LLC for the booking giving rise to the claim.
Nothing in these Terms is intended to limit any liability that cannot lawfully be limited or excluded under South Carolina law.
7. Indemnification
You agree to indemnify and hold harmless Viking Trail Journeys LLC and its owners, members, and employees from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any Supplier's terms and conditions, or your misuse of our website or services.
8. Force Majeure
Viking Trail Journeys LLC is not responsible for any failure to perform, or delay in performing, our services due to causes beyond our reasonable control, including natural disasters, extreme weather, pandemic or public health emergency, acts of government, war, terrorism, civil unrest, strikes, or Supplier insolvency or service disruption.
9. Privacy
Our collection and use of your personal information (such as your name, contact details, passport information, and payment details necessary to book travel) is described in our Privacy Policy. By using our services, you consent to the collection, use, and, where necessary to complete your booking, disclosure of your information to Suppliers and their agents.
10. Dispute Resolution; Governing Law
These Terms, and any dispute arising out of or relating to them or to the services of Viking Trail Journeys LLC, shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to the personal jurisdiction of those courts.
Optional: many travel-advisory agreements instead route disputes to mandatory arbitration (e.g., under the AAA Consumer Arbitration Rules) with a class-action waiver, which can reduce litigation exposure but has tradeoffs and specific drafting/notice requirements to remain enforceable. Discuss with your attorney whether to add an arbitration clause here in place of, or in addition to, the court-venue clause above.
11. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Changes to These Terms; Entire Agreement
We may update these Terms from time to time by posting a revised version on our website with a new Effective Date. Your continued use of our website or services after any such update constitutes acceptance of the revised Terms. These Terms, together with any specific booking confirmation, invoice, or Supplier terms referenced at the time of booking, constitute the entire agreement between you and Viking Trail Journeys LLC regarding the subject matter herein.

Note on South Carolina registration: as of this draft, South Carolina does not impose a state “Seller of Travel” registration, licensing, or bonding requirement on travel agencies (unlike states such as California, Florida, Hawaii, Iowa, Nevada, Ohio, Rhode Island, and Washington). If Viking Trail Journeys LLC sells to residents of, or advertises in, any of those states, separate registration may be required there.
