Champagne Ventures Terms and Conditions

Champagne Ventures LLC (“Champagne Ventures,” “we,” “us”) provides travel planning and booking services as an independent agency based in Spring, Texas, operating as an authorized agent of Cruise Mom’s Cruises / CMC Travel & Tours (Clearwater, FL). By authorizing payment, signing electronically, or otherwise booking with us, you (“you,” “client,” “traveler”) agree to these Terms & Conditions.
1. Role of Champagne Ventures & Supplier Responsibility
We act as a booking agent for independent suppliers including airlines, cruise lines, hotels, tour operators, transportation providers, and insurers. Your contract for travel services is with the applicable supplier. Supplier terms govern availability, changes, cancellations, pricing, conduct, claims, and refunds. We do not control supplier operations and are not liable for their acts, omissions, insolvency, schedule changes, or service quality.
2. Scope of Services
We arrange flights, hotels, cruises, excursions and tours, custom itineraries, travel insurance assistance, visa and passport guidance, and group or corporate travel. For any packages we design, third-party suppliers still fulfill transportation, lodging, and on-the-ground services.
3. Quotes, Pricing & Errors
Quotes are estimates until deposited and confirmed by the supplier. Prices, taxes, fees, surcharges, and availability can change at any time.
4. Booking, Deposits & Final Payment
A nonrefundable deposit (fixed amount or percentage) is due at booking. Final payment is due 45–90 days prior to departure, depending on the supplier. Failure to pay on time may result in cancellation and forfeiture of all amounts paid. By authorizing payment, you confirm you are the authorized cardholder and accept that charges may appear under the supplier or Cruise Mom’s Cruises/CMC Travel & Tours.
5. Cancellations, Changes & Refunds
Supplier policies govern all changes, cancellations, and refunds. Agency service fees are nonrefundable. After final payment, no refunds are available unless the supplier approves an exception. Chargebacks on authorized transactions are improper. You agree to work with us and the supplier to resolve issues before initiating any dispute.
6. Travel Insurance
Travel insurance is optional but strongly recommended to cover cancellations, interruptions, delays, medical events, evacuation, baggage loss, supplier default, and other risks. If you decline coverage, you assume all financial risk. Coverage is subject to the policy terms; certain benefits may require purchase within 14 days of initial deposit.
7. Traveler Documentation & Entry Requirements
You are responsible for obtaining valid passports, visas, vaccinations, health forms, and compliance with all entry and exit requirements. Many countries require passports valid for at least six months beyond return. Denial of boarding or entry due to documentation issues is solely your responsibility.
8. Health, Mobility & Special Assistance
We will convey reasonable accommodation requests to suppliers but cannot guarantee fulfillment or ADA compliance abroad. Destination conditions, accessibility, and medical facilities vary.
9. Risks, Pandemics & Force Majeure
Travel involves inherent risks, including illness, injury, crime, weather, natural disasters, labor unrest, terrorism, war, and government actions. Entry requirements (testing, vaccination, quarantine) may change without notice. We are not liable for losses or costs arising from events outside our control. Always review official travel advisories before departure.
10. Conduct & Prohibited Persons
You must comply with supplier rules and all applicable laws. We cannot arrange travel for individuals or entities prohibited under U.S. sanctions or embargoes.
11. Use of Client Portal (Tern)
We use Tern, a third-party client management and booking platform, to deliver itineraries, contracts, and payment links. Tern is a software platform, not a travel supplier. Access may require a personal account and password. You are responsible for protecting your login credentials and notifying us of unauthorized use. Access is provided “as available” and outages may occur.
12. Links & Third-Party Sites
Our materials and portal may include links to third-party websites. We are not responsible for their content, privacy policies, or security practices.
13. Limitation of Liability
To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the total agency fees you paid to Champagne Ventures for the booking in question. We are not liable for indirect, incidental, special, punitive, or consequential damages.
14. Indemnification
You agree to indemnify and hold harmless Champagne Ventures LLC from any losses, costs, or claims arising from your breach of these terms, misuse of the portal, chargebacks on authorized transactions, or violation of applicable laws.
15. Age & Authority
You must be at least 18 years old to book and enter contracts. Travelers aged 16–17 may book only with the consent of a parent or guardian. If you book on behalf of others, you represent that you have authority to bind those travelers to these terms.
16. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Texas. The exclusive venue for any dispute shall be in state or federal courts located in Harris or Montgomery County, Texas.
17. Updates to Terms
Champagne Ventures may update these Terms & Conditions at any time. The version in effect at the time of booking applies to your reservation.

Tern Platform Use & Software Addendum

This Addendum governs your use of Champagne Ventures’ client portal and tools powered by Tern (“Portal”). It forms part of the Champagne Ventures Terms & Conditions.
1. Purpose of the Platform
Tern is a client management and booking platform used by Champagne Ventures to organize quotes, itineraries, forms, contracts, and payments. Tern is not a travel supplier. All travel services are provided by independent suppliers under their own terms.
2. Account & Security
Portal access may require an account and password. You are responsible for maintaining the confidentiality of your credentials, logging out after sessions, and notifying us immediately of any suspected unauthorized access. Champagne Ventures may suspend access to protect you or our systems.
3. License & Acceptable Use
We grant you a limited, revocable, non-transferable license to use the Portal solely for managing your personal travel. You may not engage in scraping, data mining, automated access, load testing, framing, or other activities that disrupt or degrade the service.
4. Payments & Processing
Payment links provided through the Portal process via PCI-compliant providers or supplier gateways. Your statement may show the supplier, Cruise Mom’s Cruises/CMC Travel & Tours, or another merchant of record. By making payment, you authorize the charge and agree to the applicable supplier’s and processor’s terms. Champagne Ventures is not responsible for processor or supplier outages.
5. Data, Privacy & Security
Champagne Ventures acts as the business determining the purpose of data processing; Tern acts as our service provider. We use commercially reasonable measures to protect data but cannot guarantee absolute security. Please review our Privacy Policy for details on data handling and your rights.
6. Content & Testimonials
If you submit reviews, photos, or feedback through the Portal, you grant Champagne Ventures a non-exclusive, royalty-free license to use that content for service and marketing purposes in accordance with our Privacy Policy. You agree not to upload unlawful or infringing material.
7. Availability & Changes
The Portal is provided “as available.” Features may change, and temporary outages may occur. Champagne Ventures may suspend or terminate access for misuse, technical maintenance, or legal reasons.
8. Compliance & Prohibited Persons
You agree not to use the Portal to arrange travel for any person or entity prohibited under U.S. law, including OFAC-sanctioned individuals. We reserve the right to decline or terminate access to comply with regulations.
9. Disclaimers & Limitation of Liability
We make no warranties, express or implied, regarding the Portal’s operation or availability. Our total liability for claims arising from Portal use is limited to the agency fees you paid to Champagne Ventures for the related booking.
10. Indemnification
You agree to indemnify and hold harmless Champagne Ventures LLC from any claims or losses arising from your misuse of the Portal, violation of these terms, or infringement caused by content you upload.
11. Governing Law
This Addendum is governed by the laws of the State of Texas, with exclusive venue in Harris or Montgomery County, Texas.
