Extra Mile Travels - Terms and Conditions
1. Agreement to Terms:
By booking travel services through Extra Mile Travels ("we," "us," or "our"), you ("the Client," "you," or "your") agree to be bound by these Terms and Conditions. Please read them carefully before making any bookings.
2. Booking and Confirmation:
- All bookings are subject to availability and confirmation by the relevant service providers (e.g., airlines, hotels, tour operators).
- A booking is considered confirmed only when you receive a written confirmation from Extra Mile Travels.
- It is your responsibility to carefully review the booking confirmation and notify us immediately of any discrepancies or errors. Extra Mile Travels is not responsible for errors in bookings due to incorrect information provided by you.
3. Pricing and Payment:
- All prices are quoted in US Dollars and are subject to change without prior notice unless a booking has been confirmed.
- Prices may include taxes, fees, and surcharges as specified at the time of booking. However, additional local taxes or fees may be payable directly to the service provider.
- Payment terms will be outlined at the time of booking. We accept credit cards.
- Full payment or a deposit may be required at the time of booking, depending on the specific travel services and supplier policies.
- Failure to make timely payments may result in the cancellation of your booking.
4. Cancellations and Changes by You:
- Cancellation and change policies vary depending on the specific travel services and the policies of the service providers.
- You are responsible for reviewing the specific cancellation and change policies provided to you at the time of booking.
- Cancellation or change requests must be submitted to Extra Mile Travels in writing (e.g., email).
- Fees and penalties may apply for cancellations or changes, as determined by the service providers and/or Extra Mile Travels. These fees will be communicated to you prior to processing the cancellation or change.
- No refunds will be provided for unused portions of travel services.
5. Cancellations and Changes by Service Providers:
- Service providers (e.g., airlines, hotels, tour operators) may occasionally need to cancel or make changes to travel arrangements due to unforeseen circumstances such as weather, technical issues, overbooking, or force majeure events.
- Extra Mile Travels will make reasonable efforts to notify you of any such cancellations or changes as soon as we are informed.
- In the event of a significant change or cancellation by a service provider, we will work with you to find alternative arrangements or process a refund in accordance with the service provider's policies.
- Extra Mile Travels is not responsible for any additional costs, losses, or damages incurred by you as a result of cancellations or changes initiated by service providers.
6. Travel Documents:
- It is your sole responsibility to ensure that you possess all necessary travel documents, including valid passports, visas, health certificates, and any other required documentation for your destination(s).
- You must ensure that your travel documents are valid for the entire duration of your trip and any additional period required by the destination country.
- Extra Mile Travels is not responsible for any issues arising from your failure to possess or obtain the necessary travel documents.
7. Insurance:
- We strongly recommend that you purchase comprehensive travel insurance to cover unforeseen circumstances such as trip cancellation, interruption, medical emergencies, lost baggage, and other potential risks.
- It is your responsibility to ensure that your travel insurance provides adequate coverage for your specific needs.
- Extra Mile Travels can provide information on travel insurance options but does not endorse or guarantee the services of any particular insurance provider.
8. Health and Safety:
- It is your responsibility to be aware of any health risks and recommended precautions for your destination(s). Consult with your doctor or a travel health clinic for advice.
- You are responsible for complying with all health and safety guidelines and regulations of the destination(s) you are visiting.
- Extra Mile Travels is not liable for any illness, injury, or death that may occur during your travels.
9. Liability:
- Extra Mile Travels acts as an intermediary between you and the service providers (e.g., airlines, hotels, tour operators). We are not the direct providers of the travel services.
- Therefore, to the fullest extent permitted by law, Extra Mile Travels shall not be liable for any loss, injury, damage, delay, or inconvenience arising directly or indirectly from the acts, omissions, or defaults of the service providers or from any circumstances beyond our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, natural disasters, or government actions.
- Our liability to you for any breach of these Terms and Conditions shall be limited to the amount you paid to Extra Mile Travels for the specific travel services in question.
10. Client Responsibilities:
- You are responsible for providing accurate and complete information at the time of booking.
- You are responsible for reviewing all travel documents and confirmations carefully and notifying us of any errors immediately.
- You are responsible for adhering to the terms and conditions of the service providers.
- You are responsible for conducting yourself in a respectful and responsible manner during your travels.
11. Complaints:
- Any complaints regarding travel services should first be directed to the service provider during your trip to allow them an opportunity to resolve the issue.
- If the issue is not resolved to your satisfaction, you may submit a written complaint to Extra Mile Travels within 15 days of your return. Please include all relevant documentation.
- We will make reasonable efforts to assist in resolving complaints with the service providers, but we cannot guarantee a specific outcome.
- Client(s) agree in good faith to negotiate and or mediation prior to filing any lawsuit.
12. Governing Law and Jurisdiction:
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
- Any dispute arising out of or relating to these Terms and Conditions shall be subject to jurisdiction/venue in Snohomish County in the state and federal courts located in Washington State.
13. Entire Agreement:
- These Terms and Conditions constitute the entire agreement between you and Extra Mile Travels with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
14. Severability:
- If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
15. Modifications:
- Extra Mile Travels reserves the right to modify these Terms and Conditions at any time without prior notice. Your continued use of our services after any such modifications constitutes your acceptance of the revised Terms and Conditions.
