Traveling Jay Byrd, LLC DBA Journey to Empower – Credit Card Authorization Terms & Conditions
By providing your credit card information to Traveling Jay Byrd, LLC DBA Journey to Empower (“we,” “our,” or “us”), you (“Client” or “Traveler”) agree to the following terms and conditions:
1. Authorization for Use of Credit Card
You authorize Traveling Jay Byrd, LLC DBA Journey to Empower to use your credit card for the purpose of booking travel arrangements on your behalf, including but not limited to flights, hotels, cruises, tours, insurance, and other travel-related services.
You further acknowledge that:
- You are the authorized user of the card provided.
- You approve all charges made by Traveling Jay Byrd, LLC DBA Journey to Empower to third-party travel suppliers on your behalf.
2. Third-Party Charges
All payments made by Traveling Jay Byrd, LLC DBA Journey to Empower to travel suppliers (e.g., airlines, tour operators, hotels) are subject to the terms and conditions of those suppliers. Any disputes regarding pricing, quality of service, changes, or cancellations must be addressed directly with the supplier.
3. Chargebacks
Client agrees not to initiate a chargeback or dispute with their credit card company for any authorized transaction. Attempting to charge back an approved transaction may be considered a breach of contract and may result in legal action.
If you have any concerns about a charge, you agree to contact us first to resolve the issue.
4. Card Information and Storage
We use secure, PCI-compliant systems to store credit card information when necessary. By providing your credit card details, you consent to the secure saving of your card information solely for the purpose of managing your current and future travel bookings.
We do not share, sell, or misuse your personal or financial information.
5. Refunds and Cancellations
All bookings are subject to the cancellation, change, and refund policies of the individual travel suppliers. Refunds, if applicable, will be processed according to supplier terms and may be subject to penalties or non-refundable portions.
Traveling Jay Byrd, LLC DBA Journey to Empower charges a non-refundable planning/design fee for travel services, which is not covered by any supplier policy.
6. Acknowledgment
By submitting your credit card information to Traveling Jay Byrd, LLC DBA Journey to Empower, you acknowledge and agree to these terms and conditions in full. You understand your card may be used for immediate and/or future authorized travel-related purchases.
Terms and Conditions
Welcome to Traveling Jay Byrd, operating under Journey to Empower (“Company,” “we,” “our,” or “us”). By booking travel services with us, you (“client,” “you,” or “traveler”) agree to be bound by the following Terms and Conditions. Please read carefully.
1. Agency Role and Limitation of Liability
Traveling Jay Byrd DBA Journey to Empower acts solely as an agent for suppliers including but not limited to airlines, hotels, tour operators, ground transport, cruise lines, and activity providers (“Suppliers”). We do not own, operate, or control these Suppliers and therefore are not responsible for their acts or omissions, including but not limited to cancellations, delays, overbooking, weather, strikes, political unrest, acts of terrorism, or other force majeure events.
By booking through us, you acknowledge that all travel involves some risk and that you release us from any and all liability for personal injury, death, property damage, or other loss caused by Suppliers or circumstances beyond our control.
2. Client Responsibility
It is your responsibility to:
- Ensure that all names provided match legal identification or passports exactly.
- Have a valid passport, visa(s), and any necessary vaccinations.
- Review all travel documents and notify us immediately of any discrepancies.
- Arrive at scheduled destinations on time, follow Supplier rules, and behave respectfully.
- Obtain travel insurance, including medical and cancellation coverage.
Failure to comply may result in denied boarding or travel, at your expense.
3. Payments, Pricing & Currency
All prices are subject to change without notice until paid in full. We are not responsible for fare increases, fuel surcharges, or currency fluctuations imposed by Suppliers.
Payment of a deposit or full balance indicates your acceptance of these terms.
A non-refundable design/consultation fee may be required before planning services commence.
4. Cancellations, Refunds, and Changes
All bookings are subject to Supplier cancellation and refund policies. We will assist in facilitating changes or cancellations, but we are not responsible for any fees, penalties, or losses incurred.
Our agency charges a non-refundable cancellation fee of $200 per person for any cancellation, regardless of reason or refund status from suppliers. This fee is in addition to any penalties imposed by the Supplier.
Our design and planning fees are also non-refundable under any circumstances, including trip cancellation or rescheduling.
If you must cancel or change your plans, please notify us immediately in writing.
5. Airfare
Airline tickets are highly restrictive, non-refundable, and non-transferable. Modification of passenger names, dates, times, routes, or departure/arrival airports is at the sole discretion of the airline and, if permitted, will likely incur a significant change fee. The passenger is responsible for any such fees.
Regarding air ticket purchases, Journey to Empower acts solely as an intermediary between you and the airline. Once a reservation is made, your credit or debit card will be charged for the full amount, regardless of whether or not the reservation is used. No credit will be issued for unused airline tickets, nor can they be applied to future bookings.
Unless otherwise specified, all airline tickets will be issued for basic economy class, and all travel will be round-trip. Seat assignments are subject to airline policies and may not be available until check-in at the airport. Airline tickets booked through Journey to Empower may not be eligible for frequent flyer mileage accrual. We strongly recommend that you confirm your flights directly with the airline at least 72 hours prior to departure.
Please note: direct flights may be non-stop or may include stopovers under the same flight number. Connecting flights may also involve layovers or airport changes. If your itinerary includes a stopover with a change in airports, it is your responsibility to ensure adequate time and transportation between airports. Journey to Empower is not responsible for missed flights or additional costs incurred.
Journey to Empower’s responsibility regarding air travel is limited by the conditions of carriage set forth by each airline. The operating carrier may differ from the one originally quoted. We are unable to guarantee the type of aircraft used. If an airline delays or cancels a flight, it is the passenger’s responsibility to work directly with the airline to secure alternate arrangements. No refund will be issued by Journey to Empower for missed trips or segments due to airline schedule changes.
In addition, Journey to Empower is not liable for any issues arising from airline timetable changes, delays, cancellations, missed connections, mechanical failures, weather disruptions, seating changes, lost or delayed baggage, security delays, denied boarding, or failure to check in properly.
6. Travel Insurance
Travel insurance is strongly recommended. It is your responsibility to purchase travel insurance to protect against trip interruption, cancellation, medical emergencies, baggage loss, or Supplier default. We can offer options, but you are responsible for reviewing coverage and limitations.
7. Health & Safety Risks
Participation in certain travel activities may involve health or safety risks. You voluntarily assume all such risks. It is your responsibility to consult with a physician before travel and ensure your fitness for any itinerary activities.
8. COVID-19 & Public Health Notices
You understand the risks related to COVID-19 and other communicable diseases. You are responsible for complying with all health protocols, testing requirements, quarantines, and regulations in effect at your destination. We are not liable for any disruption caused by COVID-19-related restrictions or illness.
9. Force Majeure
We are not liable for failure to perform due to causes beyond our control including but not limited to natural disasters, pandemics, government actions, strikes, war, terrorism, or Supplier insolvency. In such cases, refunds or rescheduling are subject solely to the policies of each Supplier.
10. Dispute Resolution
Any dispute shall be resolved by binding arbitration in the state of [Your Business Location], and governed by the laws of that state. Attorney’s fees and costs shall be borne by the party bringing the claim unless otherwise ordered.
11. Agreement and Acknowledgement
By submitting payment or confirming a booking, you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions, including all cancellation fees.
