This Travel Agency Terms and Conditions Agreement ("Agreement") is entered into as of April 4, 2025, by and between Illusionz Travel, LLC, a limited liability corporation with its principal place of business located at 110 Coliseum Crossing #5525, Hampton VA 23666 ("Agent"), and ("Client").

WHEREAS, Illusionz Travel ("Agent") is a corporation with expertise in providing travel services, including but not limited to booking airline tickets, hotel reservations, car rentals, and tour packages;
WHEREAS, [Second Party] ("Client") desires to engage the Agent to provide personalized travel planning and advisory services according to the Client's specifications and needs;
WHEREAS, the Agent and the Client (collectively, "the Parties") wish to enter into this Travel Agency Terms and Conditions Agreement (the "Agreement") to define the terms and conditions under which these travel services will be provided;

NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, the Parties hereto agree as follows:

1. Scope of Services

1.1 The Agent agrees to provide comprehensive travel agency services, including, but not limited to, booking airline tickets, hotel reservations, car rentals, tour packages, and offering travel advice and personalized travel planning based on the Client's needs.
1.2 In providing these services, the Agent shall exercise due care and diligence in selecting reputable service providers and arranging suitable travel plans in accordance with the preferences and specifications provided by the Client during initial consultations.

2. Responsibilities of the Client

2.1 The Client shall provide all necessary information required for the Agent to make accurate bookings. This includes passenger names as they appear on government-issued IDs, travel preferences, allergies, and special accommodation requirements.
2.2 The Client is responsible for reviewing all travel itineraries and documents provided by the Agent before travel dates to ensure accuracy, and must promptly notify the Agent of any discrepancies or errors.
2.3 The Client agrees to adhere to the terms and policies of all third-party service providers facilitated by the Agent.
2.4 The Client is responsible in knowing if any legal offenses on their record could prohibit them from traveling outside of the US and for entry in another foreign state.

3. Hazards

We have no special knowledge of foreign entry requirements, health or weather risks, supplier bankruptcies, or accessibility concerns. You are responsible for verifying passport, visa, vaccination, and entry requirements, as well as conditions related to health, safety, security, and political stability. Resources: U.S. State Department (travel.state.gov), CDC (cdc.gov/travel). If you are denied boarding or entry due to legal, criminal, or financial issues, Illusionz Travel is not liable and no refunds will be issued.

4. Ticketing and Refunds

Airline, tour, cruise, and resort suppliers may impose change or cancellation penalties, often up to 100%. Prices may increase before ticketing. Please review all applicable rules before confirming reservations.

5. Flight Delays and Schedule Changes

Flight delays are common, and airlines are not legally required to cover meals, hotels, or other enroute expenses. Always reconfirm flight times before departure and return.

6. Itinerary Review

Check your itinerary immediately upon receipt to confirm dates, times, fares, and rates. Illusionz Travel is not responsible for losses or inconveniences resulting from your failure to review.

7. Cruises, Tours, Packages, and Resorts

Deposits are required at the time of booking and vary by supplier. Illusionz Travel does not endorse any specific provider; our role is limited to arranging reservations. Any supplier agreements provided after booking must also be signed. In the event of conflict, this agreement prevails.

8. Payment Terms

  • Payment Plans: All Illusionz Travel payment plans are non-refundable.
  • Payment Processing: Payments are made directly to suppliers. A signed credit card authorization is required.
  • Final Payment: Full payment is required before release of tickets or documents.
  • Ticketing Fees: $35 per ticket for departures 30+ days out; $50 within 30 days. Exchanges: $20.
  • Cancellations: $75 per person cancellation fee; $125 per reinstatement fee, plus supplier penalties.
  • Non-Use of Coupons: Airlines may not honor unused/partially used tickets. You agree to indemnify Illusionz Travel against claims.

9. Attrition Policy

Group reservations require a contracted number of rooms, cabins, or seats. If the actual number used falls below the contracted minimum, the Client will be responsible for any attrition fees imposed by the supplier. Illusionz Travel will negotiate to secure allowances (commonly 10–20%) to help protect your group; however, any penalties imposed remain the Client’s responsibility.

10. Change Fee Policy

Any changes made to reservations after booking (including but not limited to name corrections, date changes, room category adjustments, or flight modifications) may result in supplier-imposed change fees, in addition to any administrative fees charged by Illusionz Travel. All changes must be requested in writing, and fees must be paid at the time of change. Certain fare classes or promotional rates (e.g., Basic Economy airfares) may not permit changes.

11. Cancellation and Refunds

11.1 Cancellations of bookings may result in the forfeiture of payments made, depending on the cancellation policies of the third-party service providers.
11.2 The Agent will assist the Client in obtaining any available refunds or credits, although such refunds or credits cannot be guaranteed.
11.3 Any refunds processed will be subject to a cancellation fee payable to the Agent, which will not exceed [%] of the refunded amount.
11.4 Special conditions may apply to cancellations due to unforeseen circumstances, such as natural disasters or pandemics, as per provider policies.

12. Limitation of Liability

12.1 The Agent will not be liable for any failures, accidents, or dissatisfaction directly related to the services provided by third parties.
12.2 The liability of the Agent under this Agreement shall be limited to the amount of fees received by the Agent, excluding costs paid to third parties.
12.3 The Agent acts solely as an intermediary between the Client and third-party service providers, and any disputes with such providers must be addressed directly with the provider.

13. Power of Attorney

You authorize Illusionz Travel to act as your attorney-in-fact for signing documents and credit card authorizations necessary to secure travel services.

14. Chargebacks

You agree not to dispute charges related to deposits, payments, fees, or penalties. Issues must be addressed directly with Illusionz Travel.

15. Mediation & Arbitration

Disputes (except criminal/statutory claims) will first be submitted to the Better Business Bureau of Greater Hampton Roads for mediation. If unresolved, binding arbitration may follow under BBB rules, with decisions final and enforceable by law. This agreement waives your right to pursue claims in court.

16. Miscellaneous

These Terms are governed by Virginia and U.S. law. If any provision is unenforceable, the remainder remains valid. This Agreement, along with Illusionz Travel’s Privacy Policy, constitutes the full understanding between you and Illusionz Travel. We strongly recommend trip cancellation insurance and payment by credit card to ensure protections under the Fair Credit Billing Act.
