Agency Role & Limitation of Liability

Best Travel & Tours acts as an independent travel agent and intermediary for various third-party suppliers, including but not limited to airlines, hotels, cruise lines, tour operators, transportation providers, and activity companies ("Suppliers"). We do not own, operate, or control any of these Suppliers.

We are not responsible for acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier or for any personal injury, death, property damage, delay, or other loss or expense due to acts beyond our control.

Pricing & Payments

All quotes and prices are in USD unless otherwise stated and are subject to change without notice until paid in full. Full payment or deposit must be received before reservations are confirmed. Payment schedules vary by Supplier and type of service booked.

Failure to pay within the required timeframe may result in cancellation of services without refund.

Initial Consultations

Initial consultations are complimentary. A non-refundable service fee, which varies based on trip complexity, will be charged once the client elects to proceed with detailed planning. All bookings are subject to the cancellation policies of the respective suppliers, and we disclaim liability for any supplier fees, penalties, or unforeseen disruptions.

Cancellation, Changes & Refunds

All cancellations and changes must be submitted in writing. Cancellation policies are subject to the terms of each Supplier. Some bookings are non-refundable, non-transferable, or subject to high penalties.

The Agency will charge a standard service fee of $50 per traveler for cancellations or itinerary changes, separate from Supplier penalties.

No refunds are given for unused portions of your travel once travel has commenced.

At Best Travel & Tours, we strive to provide exceptional service and transparent communication. To ensure mutual trust and protect all parties involved, please review our chargeback policy carefully.

💳 Authorization of Charges

By submitting payment for any travel booking through [Your Travel Agency Name], you agree that you are the authorized cardholder and that you approve the transaction. All charges are for travel services requested and confirmed by the client.

📄 Disputes & Resolution

We are committed to resolving any concerns you may have. If you are dissatisfied or have a question about a charge, please contact us first at [your email or phone number]. Most issues can be resolved quickly and amicably.

⚠️ Chargebacks

Initiating a chargeback (a dispute of a payment with your bank or card provider) without giving us the opportunity to resolve the issue directly may be considered a breach of agreement. We reserve the right to dispute any chargebacks and provide documentation to support the validity of the charge, including:

  • Signed agreements or authorizations
  • Email/text/WhatsApp confirmations
  • Supplier confirmations and invoices
  • Payment history and client communication

💼 Non-Refundable Services

Please note that many travel services (including flights, hotels, tours, and packages) are non-refundable once booked, as per the policies of third-party suppliers. We will always inform you of these terms before booking.

📝 Client Responsibility

It is the client's responsibility to review all terms, itineraries, and confirmation details before approving and making a payment. Once a payment is made, any changes or cancellations are subject to the terms of the specific supplier and may not be refundable.

🔐 Fraudulent Chargebacks

Chargebacks filed fraudulently, or to avoid the terms of the agreement or supplier policies, will be treated as a breach of contract and may result in:

  • Immediate cancellation of all pending reservations
  • A recovery fee to cover administrative and legal expenses
  • Being blacklisted from future bookings through our agency

Travel Insurance & Risk Acknowledgment

We strongly recommend that you purchase comprehensive travel insurance to protect your trip investment, including coverage for trip cancellations, delays, interruptions, medical emergencies, and baggage loss.

Travel involves inherent risks, and you voluntarily assume all risks associated with travel. The Agency is not liable for any loss due to your failure to obtain insurance.

Travel Documentation

You are solely responsible for ensuring that you and all members of your travel party have valid identification, passports, visas, vaccination certificates, or other required documents.

We are not liable for any delays, denial of boarding, entry refusals, or travel disruptions due to improper or incomplete documentation.

Itinerary Changes & Force Majeure

Suppliers may modify or cancel travel services due to events including, but not limited to, weather conditions, mechanical issues, labor strikes, pandemics, government actions, or other unforeseeable circumstances ("Force Majeure"). Best Travel & Tours is not liable for such changes.

We will make reasonable efforts to assist with rebooking or refunds in accordance with Supplier policies but cannot guarantee outcomes.

Client Responsibilities

Clients are responsible for reviewing all itineraries, confirmations, and travel documents promptly upon receipt and notifying Best Travel & Tours of any discrepancies within 24 hours. It is also the client’s responsibility to comply with all rules, policies, and requirements set forth by third-party suppliers.

Best Travel & Tours cannot be held liable for any consequences resulting from a client’s failure to adhere to supplier regulations, travel documentation requirements, or any personal circumstances that may affect travel.

Dispute Resolution

All disputes arising from or related to travel booked with Best Travel & Tours shall be governed by the laws of the State of Florida. Any legal action must be filed in the appropriate court located in Florida.

Before pursuing any legal action, both parties agree to attempt informal resolution through written communication and mediation.

Liability Waiver

To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Best Travel & Tours, its employees, owners, contractors, and affiliates from any and all claims, damages, losses, or liabilities arising from, and not limited to:

  • Supplier errors, omissions, or failures
  • Acts of God, natural disasters, weather events, pandemics, or government actions
  • Personal injury, illness, death, or property damage
  • Missed flights, delays, cancellations, or changes in itinerary
  • Theft, accidents, or travel disruptions beyond our control
  • Your failure to obtain proper documentation or comply with travel requirements

This waiver applies whether the liability arises from negligence, contract, tort, or otherwise.

Acceptance of Terms

By making a booking, submitting payment, or signing a client agreement or invoice with Best Travel & Tours, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
