Danny Murdock Travel Terms and Conditions

1. Introduction

These Terms and Conditions (“Agreement”) govern the services provided by Danny Murdock, an affiliate of Fora (“Travel Advisor,” “we,” “us,” or “our”) to you (“Client,” “you,” or “your”). By engaging our services for travel planning, you agree to be bound by this Agreement.

2. Scope of Services

Our services include travel consultation, itinerary planning, booking of accommodations, transportation, activities, and other related services. The scope of services will be defined in a separate agreement or confirmation email upon engagement of our services.

3. Client Responsibilities

You are responsible for:

  • Providing accurate and complete information necessary to plan your trip, including but not limited to full legal names, passport details, special requests, and preferences.
  • Adhering to all terms, conditions, and policies of suppliers, including airlines, hotels, tour operators, and car rental companies
  • Securing and paying for all required travel documents, including passports, visas, and vaccinations.
  • Notifying us of any changes to your travel preferences, personal information, or circumstances.

4. Fees and Payment

Consultation Fees

A non-refundable consultation fee may be charged to begin the planning process. The fee amount will be provided prior to commencing services.

Service Fees

In addition to consultation fees, service fees may apply for specific arrangements, such as booking airfares, cruises, accommodations, tours, etc.

Payment Terms

Payments for travel services are due as specified in your booking confirmation or invoice. We accept payments via credit card. Failure to make timely payments may result in the cancellation of your bookings.

Third-Party Fees

Additional charges imposed by third-party suppliers (e.g., airlines, hotels) are subject to their terms and conditions. Any changes or cancellations may incur penalties as determined by the supplier.

5. Changes and Cancellations

Client-Initiated Changes

Any requests for changes to the itinerary, such as dates, accommodation, or activities, must be communicated to us in writing. Changes may incur additional charges, subject to supplier policies.

Cancellation Policy

Cancellations must be made in writing. Any cancellations will be subject to our cancellation fee as well as the terms and penalties imposed by third-party suppliers.

Supplier-Initiated Changes

In rare instances, changes may be made by suppliers. We will notify you of such changes and work with you to find suitable alternatives.

6. Travel Insurance

We strongly recommend that you purchase travel insurance to protect against unforeseen circumstances, including trip cancellations, medical emergencies, lost luggage, and other incidents. It is your responsibility to review and understand the terms of any travel insurance policy you purchase.

7. Liability

Third-Party Suppliers

We act as an intermediary between you and third-party suppliers such as airlines, hotels, and tour operators. We are not responsible for the acts, omissions, or errors of these suppliers. Any claims or disputes should be addressed directly with the respective supplier.

Limitation of Liability

To the fullest extent permitted by law, our total liability for any claims arising from or related to the services provided under this Agreement will not exceed the total amount of fees paid by you to us. We will not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of enjoyment, emotional distress, or missed connections.

Force Majeure

We are not liable for any loss or delay due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, government regulations, terrorism, pandemics, or other unforeseeable events.

8. Travel Requirements

Health and Safety

You are responsible for complying with the health and safety guidelines of your destination, including vaccination and testing requirements. We are not responsible for any health-related issues encountered during your trip.

Passport and Visa

It is your responsibility to ensure that you have a valid passport and the necessary visas to enter your destinations. Failure to obtain the required documentation may result in denied boarding or entry, for which we will not be liable.

9. Dispute Resolution

In the event of any dispute arising from or related to this Agreement, both parties agree to resolve the matter through amicable negotiations. If the dispute cannot be resolved, it will be subject to appropriate jurisdiction.

10. Privacy and Data Protection

We are committed to protecting your personal data. Any information collected during the travel planning process will be used in accordance with our Privacy Policy. We will not share your information with third parties except as necessary to complete your bookings.

11. Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles.

12. Amendments

We reserve the right to amend these Terms and Conditions at any time. Any amendments will be effective immediately upon posting the updated version on our website or otherwise notifying you.

13. Acceptance of Terms

By engaging our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. You further acknowledge that you are of legal age to enter into this Agreement.
