FLIP FLOP TRAVEL GROUP (FFTG) – TERMS & CONDITIONS

Effective Date: August 30, 2025

Please read these Terms & Conditions carefully before booking travel with Flip Flop Travel Group (FFTG). By submitting payment or confirming a reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

SECTION 1. LEGAL DISCLOSURES

1.1 FFTG complies with state Seller of Travel (“SOT”) requirements where applicable. Certain states, including California, Florida, Washington, and Hawaii, require travel sellers to register, post bonds, and disclose registration numbers. Where required, FFTG’s registration numbers will be disclosed on invoices, websites, marketing materials, and advertisements. Independent Contractors working under FFTG’s umbrella are not authorized to use any registration numbers other than FFTG’s, and all consumer-facing materials must display FFTG’s approved disclosures.

1.2 If a booking includes air transportation, the United States Department of Transportation requires that all advertised prices include mandatory taxes and fees, that operating carriers are disclosed on codeshare flights, that baggage policies and fees are disclosed in advance, and that refund rights apply when FFTG is the merchant of record.

1.3 Travel insurance may protect against trip interruption, medical emergencies, baggage loss, supplier default, and other risks. FFTG may provide access to travel insurance policies as a licensed travel retailer under the supervision of a licensed insurance producer. Clients who decline insurance must sign a waiver acknowledging that FFTG has explained the risks of traveling without coverage.

1.4 FFTG complies with applicable federal and state privacy laws. Client data is used exclusively for travel arrangements, supplier communications, and marketing when consent has been given. Data will not be sold or shared outside of travel booking purposes. All payment information is processed in compliance with PCI DSS standards, and FFTG does not store CVV codes.

SECTION 2. ROLE OF TRAVEL AGENT VS. TRAVEL ADVISOR

2.1 FFTG acts solely as an agent for third-party suppliers, including airlines, cruise lines, hotels, and tour operators. Your travel contract is directly with the supplier, not FFTG.

2.2 FFTG provides advisory services by offering recommendations, guidance, and booking assistance. While FFTG may advise on suppliers or destinations, FFTG does not guarantee supplier performance, pricing, or service levels.

2.3 FFTG is not liable for acts or omissions of suppliers, including flight cancellations, schedule changes, accommodation quality, or services rendered. Clients are responsible for reviewing supplier-specific terms and conditions, including refund, change, and cancellation rules.

SECTION 3. CLIENT ADVISORIES & RESPONSIBILITIES

3.1 Clients are solely responsible for obtaining valid passports, visas, permits, vaccinations, and other entry documentation.

3.2 Clients must review U.S. State Department and CDC advisories prior to travel.

3.3 Clients are responsible for disclosing health conditions or mobility limitations; failure to disclose may result in denied services without refund.

3.4 Clients must comply with payment schedules. Missed or late payments may result in automatic supplier cancellation without refund.

SECTION 4. SUPPLIER TERMS & CONDITIONS

4.1 All travel bookings made through FFTG are subject to the supplier’s rules, policies, and conditions, including but not limited to cancellation, refund, baggage, check-in, boarding, and conduct requirements.

4.2 By booking, the Client agrees to abide by both FFTG’s Terms & Conditions and all supplier rules.

SECTION 5. PRICING & PAYMENT TERMS

5.1 All prices quoted are subject to change until confirmed by the supplier. Prices may fluctuate due to exchange rates, fuel surcharges, taxes, or supplier-imposed fees.

5.2 Where required by law, including in California, all advertised pricing includes mandatory fees. Optional costs such as gratuities, excursions, or insurance are not included unless expressly stated.

5.3 FFTG accepts credit and debit cards as well as approved electronic payments. Personal checks may be accepted but are subject to clearance delays.

5.4 The Client agrees not to initiate a chargeback without first allowing FFTG and the supplier an opportunity to resolve the issue. Fraudulent or improper chargebacks may result in legal action for recovery of funds and related costs.

SECTION 6. PAYMENTS, CANCELLATIONS & REFUNDS

6.1 Deposits may be non-refundable. Final payments follow supplier deadlines and must be made on time.

6.2 All cancellations must be submitted in writing. Refund eligibility depends entirely on supplier policies. FFTG’s service or administrative fees are non-refundable.

6.3 If a supplier cancels or significantly alters a booking, FFTG will assist in securing a refund, future travel credit, or rebooking. FFTG is not liable for additional costs incurred.

6.4 Refund timelines are controlled by the supplier. Refunds may take weeks or months depending on supplier processing.

6.5 Refunds for insured losses must be submitted to the insurer. FFTG may assist with documentation but is not responsible for claim outcomes.

SECTION 7. TRAVEL INSURANCE

7.1 FFTG strongly recommends comprehensive travel insurance coverage.

7.2 Coverage may include trip cancellation, interruption, medical expenses, evacuation, baggage, or supplier default.

7.3 Clients who decline insurance must sign a waiver.

7.4 FFTG is not an insurer and cannot guarantee claims.

SECTION 8. HEALTH, SAFETY & CONDUCT

8.1 Clients must comply with all health protocols, including vaccinations, testing, and masks where required.

8.2 Suppliers may deny boarding, refuse service, or remove clients for intoxication, misconduct, or noncompliance.

8.3 FFTG is not liable for denied service or resulting costs.

SECTION 9. LIMITATION OF LIABILITY & FORCE MAJEURE

9.1 FFTG’s liability is limited to commissions earned on the booking. FFTG is not liable for illness, injury, death, loss, delay, or inconvenience caused by suppliers, governments, or third parties.

9.2 Events beyond FFTG’s control, including natural disasters, pandemics, labor disputes, terrorism, war, government restrictions, and weather, suspend FFTG’s performance. Clients may only seek remedies offered by suppliers.

9.3 By booking, the Client assumes all inherent risks associated with travel.

SECTION 10. SUPPLIER INSOLVENCY OR BANKRUPTCY

10.1 FFTG is not responsible if a supplier ceases operations or defaults.

10.2 FFTG will assist in recovery where possible but cannot guarantee refunds.

10.3 Travel insurance may cover supplier insolvency.

SECTION 11. PANDEMIC, EPIDEMIC & PUBLIC HEALTH EVENTS

11.1 The Client accepts the risks of travel disruptions caused by pandemics, epidemics, or other public health emergencies. Such events may result in border closures, quarantines, testing requirements, or government mandates.

11.2 Refunds or credits in these circumstances are subject solely to supplier policies. FFTG has no obligation to provide refunds beyond those offered by suppliers.

11.3 The Client agrees that FFTG is not responsible for additional expenses, including but not limited to medical treatment, lodging, meals, or repatriation, arising from public health events.

SECTION 12. INDEMNIFICATION

12.1 The Client agrees to indemnify, defend, and hold harmless FFTG, its officers, employees, independent contractors, and affiliates from any claims, damages, losses, or expenses, including attorneys’ fees, arising out of the Client’s breach of these Terms & Conditions.

12.2 The Client further agrees to indemnify FFTG against claims arising from violation of any law, regulation, or supplier policy by the Client or members of the Client’s traveling party.

12.3 Indemnification also applies to damages caused by the negligent or intentional acts of the Client during travel.

SECTION 13. NOTICE REQUIREMENTS

13.1 All notices, cancellations, or legal communications to FFTG must be submitted in writing to the address or email provided on the invoice or contract.

13.2 Verbal cancellations or notices will not be considered valid.

SECTION 14. ADDITIONAL TERMS

14.1 FFTG reserves the right to update these Terms & Conditions at any time. Updates will be posted on FFTG’s website and will apply to all future bookings.

14.2 These Terms & Conditions, together with supplier rules and any written agreements between the Client and FFTG, constitute the entire agreement between the parties.

14.3 No oral statements or representations alter these Terms unless confirmed in writing by FFTG.

SECTION 15. CONFIDENTIALITY

15.1 Any proprietary or confidential information exchanged between FFTG and the Client, including personal data, payment details, and booking records, shall remain confidential and used solely for travel-related purposes.

15.2 FFTG agrees to safeguard Client information under applicable privacy laws.

15.3 The Client agrees not to disclose any confidential or proprietary information received from FFTG to third parties without FFTG’s written consent.

SECTION 16. NON-SOLICITATION

16.1 The Client agrees not to solicit or attempt to solicit FFTG’s independent contractors, employees, or affiliates for the purpose of establishing a direct relationship outside FFTG for competing travel services.

16.2 This obligation survives the completion or termination of any travel arrangements.

SECTION 17. ARBITRATION AGREEMENT

17.1 Any dispute, controversy, or claim arising from or relating to these Terms & Conditions shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).

17.2 Arbitration shall be conducted in Texas unless otherwise agreed in writing.

17.3 Each party shall bear its own attorneys’ fees unless otherwise provided by law, except that the prevailing party shall be entitled to recover arbitration costs.

17.4 Arbitration awards shall be final and binding and may be entered in any court of competent jurisdiction.

SECTION 18. GOVERNING LAW & VENUE

18.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflicts of law principles.

18.2 Any litigation permitted under these Terms shall be brought exclusively in the courts of Tarrant County, Texas.

SECTION 19. SERVICE FEES

19.1 FFTG may charge service fees in addition to supplier costs. Service fees are disclosed at the time of booking and are non-refundable once services are rendered.

19.2 Administrative or after-hours fees may also apply for itinerary changes or special handling.

19.3 The Client agrees that FFTG’s service fees compensate for advisory services and are separate from supplier charges.

SECTION 20. HEADINGS

20.1 Headings in these Terms & Conditions are provided for convenience only and do not alter the meaning or interpretation of the underlying provisions.

SECTION 21. WAIVER

21.1 The failure of FFTG to enforce any provision of these Terms & Conditions shall not be construed as a waiver of such provision or the right to enforce it later.

21.2 Any waiver must be in writing and signed by an authorized representative of FFTG to be valid.

SECTION 22. ELECTRONIC SIGNATURES

22.1 The Client agrees that electronic signatures, acknowledgments, or acceptances of these Terms & Conditions shall have the same legal effect as handwritten signatures.

22.2 By clicking “I agree,” making payment, or confirming a booking, the Client acknowledges acceptance of these Terms.

SECTION 23. AUTHORITY TO CONTRACT

23.1 The Client represents that they are at least eighteen (18) years of age and have the legal capacity to enter into binding contracts.

23.2 The Client further represents that they are authorized to act on behalf of all members of their traveling party and to bind them to these Terms & Conditions.

SECTION 24. HEALTH & FITNESS TO TRAVEL

24.1 The Client is responsible for determining their own fitness to travel.

24.2 FFTG is not responsible for injuries, illnesses, or conditions arising during travel.

24.3 Suppliers may refuse service to Clients deemed medically unfit to travel. FFTG is not liable for costs arising from denied service due to health or fitness.

SECTION 25. CRIMINAL STATUS OF CLIENTS

25.1 The Client affirms that they are not currently facing outstanding criminal warrants or travel restrictions that would prevent lawful travel.

25.2 FFTG is not responsible for denied boarding, entry, or deportation resulting from criminal status, immigration records, or government enforcement.

25.3 The Client remains responsible for all costs incurred as a result of such restrictions.

SECTION 26. MEDIA & TESTIMONIAL USE

26.1 The Client grants FFTG permission to use testimonials, reviews, photos, or feedback voluntarily shared with FFTG for marketing and promotional purposes.

26.2 The Client may revoke consent for future use by providing written notice to FFTG. However, materials already published or distributed may continue to be used.

SECTION 27. THIRD-PARTY LINKS & RESOURCES

27.1 FFTG’s website and communications may contain links to third-party websites or resources.

27.2 These links are provided for convenience only, and FFTG is not responsible for the content, policies, or accuracy of such third-party sites.

27.3 Accessing third-party resources is at the Client’s own risk.

SECTION 28. COMMUNICATIONS CONSENT

28.1 By booking with FFTG, the Client consents to receive communications by email, text message, phone, or messaging applications for purposes of fulfilling travel arrangements or providing updates.

28.2 Clients may opt out of marketing communications at any time, but essential service communications are mandatory for fulfilling travel.

SECTION 29. PRICING ERRORS

29.1 FFTG reserves the right to correct errors in advertised or quoted prices, even after booking.

29.2 If a correction materially changes the booking, the Client may accept the revised pricing or cancel for a refund of monies paid to FFTG.

SECTION 30. GOVERNING LANGUAGE

30.1 These Terms & Conditions are written in English, which shall be the controlling language.

30.2 Any translations are provided for convenience only and shall not alter the meaning or interpretation of these Terms.

SECTION 31. SUCCESSORS & ASSIGNS

31.1 These Terms & Conditions are binding upon and inure to the benefit of FFTG, the Client, and their respective heirs, legal representatives, successors, and permitted assigns.

31.2 The Client may not assign or transfer their rights or obligations under these Terms without FFTG’s prior written consent.

SECTION 32. CLIENT DEFAULT

32.1 If the Client fails to comply with these Terms, including failure to pay amounts due, FFTG may cancel any pending or confirmed bookings without liability.

32.2 FFTG reserves the right to recover from the Client any damages or costs incurred as a result of such default.

SECTION 33. DEADLINE TO BRING CLAIMS

33.1 Any claim arising out of or related to travel services booked through FFTG must be filed within one (1) year from the date of the occurrence giving rise to the claim.

33.2 Claims filed after this period are barred, regardless of the nature of the claim.

SECTION 34. UPDATES TO TERMS

34.1 FFTG reserves the right to amend or update these Terms & Conditions at any time.

34.2 Updated Terms will be posted on FFTG’s website and shall apply to all new bookings made after the date of posting.

34.3 Continued use of FFTG’s services after changes take effect constitutes acceptance of the updated Terms.

SECTION 35. ILLEGAL ACTIVITY

35.1 The Client agrees not to use FFTG’s services to plan or carry out any illegal activities.

35.2 FFTG reserves the right to cancel bookings or report suspected illegal activity to authorities.

35.3 The Client remains responsible for any costs or losses incurred as a result of illegal activity.

SECTION 36. SEVERABILITY OF SUPPLIER TERMS

36.1 Where FFTG’s Terms & Conditions conflict with mandatory supplier terms or applicable law, those provisions shall be superseded only to the extent necessary.

36.2 All remaining provisions of these Terms remain in full force and effect.

SECTION 37. SURVIVAL OF FINANCIAL OBLIGATIONS

37.1 All financial obligations of the Client to FFTG, including unpaid service fees, reimbursements, or damages, shall survive completion or cancellation of travel arrangements.

37.2 The Client remains responsible for such obligations until satisfied in full.

SECTION 38. CLIENT RESPONSIBILITY FOR MINORS

38.1 Parents or guardians booking on behalf of minors accept full financial and legal responsibility for the actions of minors during travel.

38.2 Suppliers may impose additional requirements for minors, including notarized parental consent forms. FFTG is not responsible for denied boarding due to failure to comply with such requirements.

SECTION 39. GROUP BOOKINGS

39.1 For group reservations, the designated group leader is responsible for ensuring compliance with payment schedules and supplier rules.

39.2 The group leader is considered the contracting party with FFTG and is responsible for distributing communications to group members.

39.3 FFTG is not responsible for disputes among group members regarding payments or travel arrangements.

SECTION 40. LOYALTY PROGRAMS

40.1 Frequent flyer miles, hotel points, cruise credits, or other loyalty program benefits are subject to the rules of the issuing program.

40.2 FFTG does not guarantee the accrual or redemption of loyalty points.

40.3 Clients are responsible for providing accurate membership information at the time of booking.

SECTION 41. TRAVEL AT CLIENT’S OWN RISK

41.1 The Client acknowledges that all travel involves inherent risks, including illness, injury, crime, political unrest, natural disasters, and accidents.

41.2 FFTG is not liable for losses or damages arising from risks inherent in travel.

41.3 The Client accepts personal responsibility for travel decisions and participation in activities, excursions, or experiences.

SECTION 42. TRAVEL DOCUMENTS

42.1 The Client is solely responsible for obtaining and carrying valid travel documents, including passports, visas, permits, and vaccination certificates.

42.2 Failure to obtain the required documents may result in denied boarding, entry, or deportation without refund.

42.3 FFTG may provide guidance but does not guarantee accuracy of entry requirements, which are subject to change.

SECTION 43. ENTRY & EXIT REQUIREMENTS

43.1 Entry and exit requirements are determined by government authorities and may change without notice.

43.2 The Client is responsible for verifying requirements prior to travel and complying with immigration and customs rules.

43.3 FFTG is not responsible for denied entry, deportation, or fines due to non-compliance with immigration laws.

SECTION 44. CUSTOMS & LOCAL LAWS

44.1 The Client is responsible for complying with customs regulations and local laws at their destination.

44.2 FFTG is not liable for fines, penalties, arrests, or legal consequences resulting from violations of foreign or domestic laws.

SECTION 45. CLIENT CONDUCT

45.1 The Client agrees to conduct themselves with respect and courtesy toward suppliers, other travelers, and local communities.

45.2 Suppliers may refuse service or remove travelers engaging in disruptive, unsafe, or unlawful conduct.

45.3 FFTG is not responsible for additional costs arising from denied service due to misconduct.

SECTION 46. SPECIAL REQUESTS

46.1 FFTG will forward reasonable special requests (such as bedding, meals, accessibility, or adjoining rooms) to suppliers.

46.2 FFTG does not guarantee that special requests will be honored by suppliers.

46.3 The Client releases FFTG from liability where suppliers fail to meet special requests.

SECTION 47. SUPREMACY OF LAW

47.1 These Terms & Conditions are subject to applicable laws, treaties, and mandatory supplier rules.

47.2 Where conflicts exist, applicable law or mandatory supplier terms shall control, but all remaining provisions of these Terms shall survive.

SECTION 48. INDEPENDENT EXCURSIONS

48.1 Excursions, activities, or services booked outside FFTG or offered through third parties, including cruise lines and resorts, are operated independently of FFTG.

48.2 FFTG is not responsible for the safety, quality, or performance of independent providers.

48.3 Participation in such activities is at the Client’s sole risk.

SECTION 49. TECHNOLOGY & SYSTEM ERRORS

49.1 FFTG is not responsible for errors, delays, or failures caused by booking platforms, internet connections, or third-party systems.

49.2 In the event of a system error, FFTG reserves the right to correct mistakes or cancel bookings with refunds where applicable.

SECTION 50. CHECK-IN & NO-SHOW POLICY

50.1 The Client is responsible for arriving on time and meeting supplier check-in deadlines for flights, cruises, tours, and transfers.

50.2 Failure to meet check-in requirements may result in denied boarding or cancellation of reservations without refund.

50.3 FFTG is not responsible for losses resulting from late arrivals, missed connections, or no-shows.

SECTION 51. ACCOMMODATION STANDARDS

51.1 Descriptions of accommodations, including photos, amenities, and ratings, are provided by suppliers and are for reference only.

51.2 Standards vary by country and property. FFTG does not guarantee the quality, availability, or condition of accommodations.

51.3 The Client accepts that variations may occur between descriptions and actual accommodations.

SECTION 52. ACCESSIBILITY & SPECIAL NEEDS

52.1 FFTG will communicate requests regarding accessibility, dietary needs, or other special requirements to suppliers.

52.2 FFTG cannot guarantee supplier compliance with such requests.

52.3 Accessibility standards vary by country. The Client accepts that some destinations may not be fully accessible.

SECTION 53. AIRLINE RESPONSIBILITIES

53.1 Air travel is subject to international conventions, U.S. Department of Transportation regulations, and individual airline contracts of carriage.

53.2 Airlines are solely responsible for flight schedules, delays, cancellations, denied boarding, baggage handling, and safety requirements.

53.3 Claims for flight-related issues must be submitted directly to the airline.

SECTION 54. MEDIA WAIVER FOR EVENTS & GROUPS

54.1 For group trips, hosted events, or familiarization programs operated by FFTG, the Client grants FFTG permission to use photography, video, or testimonials captured during such events for promotional purposes.

54.2 Clients who do not wish to be included must notify FFTG in writing prior to travel.

SECTION 55. SUPPLIER SUPREMACY WHERE LEGALLY REQUIRED

55.1 FFTG’s Terms & Conditions apply except where federal law, international conventions, or supplier rules impose mandatory provisions.

55.2 In such cases, the required law or supplier rule shall prevail only to the extent of the conflict.

SECTION 56. COMMUNICATIONS CONSENT

56.1 By booking with FFTG, the Client consents to receive communications by email, text, phone, or messaging applications for booking updates, confirmations, and travel-related services.

56.2 Clients may opt out of marketing communications at any time, but essential service communications are required for fulfilling travel arrangements.

SECTION 57. LIMITATION OF DAMAGES

57.1 FFTG’s total liability for any claim shall not exceed the greater of: (a) the amount of service fees paid by the Client to FFTG, or (b) the commission earned by FFTG on the booking in dispute.

57.2 FFTG shall not be liable for indirect, incidental, consequential, or punitive damages.

SECTION 58. NO THIRD-PARTY BENEFICIARIES

58.1 These Terms & Conditions create obligations solely between FFTG and the Client.

58.2 No third party, including traveling companions not listed as the contracting Client, has rights under this agreement.

SECTION 59. CURRENCY CONVERSION & FOREIGN TRANSACTIONS

59.1 Bookings processed in foreign currencies are subject to exchange rate fluctuations and bank-imposed fees.

59.2 The Client is responsible for any differences between quoted prices and actual charges due to exchange rates or fees.

SECTION 60. REFUND TIMING DISCLAIMER

60.1 Refunds are controlled by suppliers. FFTG has no obligation to advance funds before receiving them from suppliers.

60.2 Clients acknowledge that refund processing may take weeks or months.

SECTION 61. TRAVEL RISKS ACKNOWLEDGMENT

61.1 The Client acknowledges that travel involves risks including illness, crime, terrorism, weather, natural disasters, and political instability.

61.2 By booking, the Client voluntarily assumes all such risks.

SECTION 62. EXPORT CONTROL & SANCTIONS COMPLIANCE

62.1 FFTG will not arrange travel that violates U.S. sanctions, embargoes, or export control laws.

62.2 FFTG may cancel a booking without refund if it determines that the travel would violate such laws.

SECTION 63. CREDIT CARD AUTHORIZATION

63.1 By providing a credit card, the Client authorizes FFTG and suppliers to charge deposits, balances, service fees, and other agreed amounts.

63.2 The cardholder remains responsible for payment of all travelers in the booking.

SECTION 64. TRAVEL PROTECTION WAIVER

64.1 The Client acknowledges that FFTG has advised purchase of travel protection.

64.2 If declined, the Client assumes full responsibility for uncovered losses, including 100% of trip cost.

SECTION 65. MISSED FLIGHTS & CRUISE CONNECTIONS

65.1 FFTG is not responsible for missed flights, embarkations, or connections due to delays or cancellations.

65.2 All costs related to rebooking, meals, or lodging due to missed connections are the Client’s responsibility.

SECTION 66. BAGGAGE & PERSONAL PROPERTY

66.1 The Client is responsible for personal property throughout travel.

66.2 FFTG is not liable for lost, stolen, or damaged luggage, valuables, or belongings.

SECTION 67. PETS & SERVICE ANIMALS

67.1 Travel with pets or service animals is subject to supplier and government regulations.

67.2 FFTG is not responsible for denied boarding, quarantine, or costs related to animal transport.

SECTION 68. COLLECTION COSTS

68.1 If the Client fails to pay amounts due, FFTG may pursue collection.

68.2 The Client agrees to pay all collection costs, including attorney’s fees.

SECTION 69. ATTORNEY’S FEES

69.1 In any arbitration or legal action, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

SECTION 70. SURVIVAL OF MARKETING RIGHTS

70.1 Any testimonials, photos, or media voluntarily provided to FFTG may be used for marketing.

70.2 Such rights survive cancellation of travel or termination of the client relationship.

SECTION 71. DIETARY REQUESTS & FOOD ALLERGIES

71.1 FFTG will communicate dietary requests to suppliers but does not guarantee compliance.

71.2 The Client assumes all risks associated with food consumption while traveling.

SECTION 72. UNACCOMPANIED MINORS

72.1 Suppliers may impose restrictions or documentation requirements for minors traveling alone.

72.2 FFTG is not responsible for denied boarding due to failure to comply with minor policies.

SECTION 73. DUTY TO REVIEW ITINERARY

73.1 The Client must review invoices, itineraries, and documents within 48 hours of receipt.

73.2 The Client is responsible for costs of corrections after this period.

SECTION 74. MARKETING MATERIALS DISCLAIMER

74.1 Descriptions in brochures, websites, or marketing materials are for informational purposes only.

74.2 FFTG is not responsible for variations between marketing content and actual services.

SECTION 75. HEAD OF HOUSEHOLD RESPONSIBILITY

75.1 In group or multi-payer bookings, the designated Lead Client is responsible for ensuring full payment.

75.2 FFTG may cancel bookings if payments from individual travelers are not received, with the Lead Client remaining liable.

SECTION 76. SECURITY SCREENINGS & BORDER CONTROLS

76.1 The Client is responsible for complying with TSA, customs, and immigration requirements.

76.2 FFTG is not liable for delays, fines, or denied boarding due to non-compliance.

SECTION 77. COLLECTION OF FEES FOR CHANGES

77.1 Suppliers may impose fees for changes. FFTG may also charge administrative fees for modifications.

77.2 All such fees are the Client’s responsibility.

SECTION 78. FORCE SURVIVAL

78.1 All indemnification, limitation of liability, governing law, and arbitration clauses survive termination or cancellation of this agreement.

SECTION 79. SUPPLIER SOLVENCY DISCLAIMER

79.1 FFTG makes travel arrangements solely as an agent for third-party suppliers. FFTG has no duty to monitor the financial condition or solvency of any supplier.

79.2 The Client acknowledges and agrees that FFTG shall not be liable for any losses, damages, or additional expenses resulting from supplier insolvency, bankruptcy, cessation of operations, or failure to provide contracted services.

SECTION 80. MEDICAL EVACUATION & REPATRIATION COSTS

80.1 In the event of accident, illness, injury, or other emergency, the Client acknowledges that medical treatment, evacuation, or repatriation may be necessary and that such services are often extremely costly.

80.2 The Client agrees that they are solely responsible for all costs associated with emergency medical services, evacuation, or repatriation.

80.3 FFTG strongly recommends that the Client purchase comprehensive travel insurance to cover these risks.

SECTION 81. CREDIT CARD CHARGEBACK INDEMNITY

81.1 The Client agrees not to dispute or charge back payments properly authorized for travel services, including non-refundable deposits, fees, or supplier-imposed charges.

81.2 In the event that a chargeback is initiated and reversed by the Client’s financial institution, the Client shall indemnify and reimburse FFTG for the full amount of the chargeback, including any associated fees, penalties, or collection costs.

SECTION 82. SUPPLIER REPRESENTATION DISCLAIMER

82.1 FFTG provides information and recommendations regarding suppliers based on publicly available data and materials provided by the supplier.

82.2 FFTG does not independently verify or warrant the accuracy of supplier statements, marketing materials, photographs, or descriptions.

82.3 The Client acknowledges that reliance on supplier representations is at their own risk, and FFTG is not liable for errors, misstatements, or omissions made by suppliers.

SECTION 83. ACCESSIBILITY & ADA LIMITATION

83.1 FFTG is not a “public accommodation” within the meaning of the Americans with Disabilities Act (ADA).

83.2 While FFTG will forward accessibility requests to suppliers, FFTG does not guarantee that accommodations, activities, or destinations will be ADA-compliant or otherwise accessible.

83.3 The Client acknowledges that accessibility standards and requirements vary by country and that FFTG has no liability where such standards differ from those of the United States.

SECTION 84. GROUP LEADER AUTHORITY

84.1 For group bookings, the designated group leader shall have full authority to act on behalf of all members of the group with respect to payments, cancellations, changes, and acceptance of supplier or FFTG terms.

84.2 All group members agree to be bound by the actions, decisions, and agreements of the group leader, including acceptance of these Terms & Conditions.

SECTION 85. DATA SECURITY & PRIVACY LIMITATION

85.1 FFTG takes commercially reasonable steps to safeguard Client information against unauthorized access, disclosure, or misuse.

85.2 The Client acknowledges that no system of data storage or transmission over the internet is entirely secure. FFTG does not guarantee absolute data security.

85.3 In the event of unauthorized access, breach, or disclosure, FFTG’s liability shall be limited to direct damages only and shall not include consequential, incidental, or punitive damages.

SECTION 86. CLASS ACTION WAIVER

86.1 The Client agrees that any claims or disputes arising under these Terms & Conditions shall be brought only in the Client’s individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

86.2 The arbitrator or court may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class action.

SECTION 87. ACKNOWLEDGMENT OF TERMS

87.1 By booking with FFTG, the Client acknowledges that they have read and understood these Terms & Conditions.

87.2 By submitting payment or booking confirmation, the Client accepts these Terms in full.
