Explorique Travel Services Terms and Conditions

By booking travel arrangements with Explorique Travel Services ("Explorique", "we", "us" or "our"), you warrant you are at least 18 years of age and agree to be bound by the following terms and conditions and any additional terms and conditions of any suppliers that are applicable to your booking arrangements. These terms apply to all bookings made through Explorique, whether online, via phone, or in person.
You agree to be financially responsible for all of your travel bookings made on behalf of yourself and any member of your traveling party and warrant that all information supplied by you on behalf of yourself, members of your household, or other members of your traveling party, is true and accurate. You agree that you will only make legitimate reservations or purchases with Explorique and its suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.
All bookings are accepted by Explorique as an agent for the third-party suppliers on your itinerary. Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree to abide by the terms and conditions of purchase imposed by any supplier that you have selected as a service provider on an itinerary you have approved.
By reviewing and accepting these terms and conditions, you acknowledge and authorize that Explorique will charge the credit card you have provided for the guarantees, deposits and final payments associated with your booking.
IN ALL CASES, EXPLORIQUE WILL NOT BE HELD RESPONSIBLE FOR ERRORS NOT REPORTED WITHIN 24 HOURS OF RECEIVING BOOKING DOCUMENTATION.
Explorique reserves the right to modify these terms and conditions from time to time at its sole discretion. Please refer to your most up to date booking documentation for the latest terms and conditions.

PAYMENTS, CANCELLATIONS AND ALTERATIONS TO BOOKINGS
All quoted prices are subject to change without notice and are based on availability. Prices and availability cannot be guaranteed until booked and/or deposit is completed. All bookings are subject to availability and confirmation by Explorique. A deposit or full payment may be required at the time of booking, as specified during the booking process.
Booking terms and conditions with certain suppliers permit price increases before the customer has paid in full. No price increases are permitted once full payment has been received by the supplier. If the price increase is more than 7% (except increases resulting from an increase in retail sales tax or federal Goods and Services Tax or Harmonized Sales Tax), you have the right to cancel that supplier booking and obtain a full refund. Please note that there may be more than one supplier included in your travel plans, and other bookings may not be changeable or cancellable. Explorique will make reasonable efforts to offer alternative arrangements, depending on the policies of the additional suppliers.
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and supplier promotions are subject to availability and may change without notice. You are advised to reserve early to avoid disappointment, increases in fares and additional late booking fees.
Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations. Explorique is not responsible for surcharges or foreign transaction fees imposed by your credit card or bank.
Certain governments, tourist and hotel authorities have implemented destination, departure, heritage or environmental taxes or fees. These taxes or fees may not be included in your hotel and may be collected by customs authorities and/or upon check-out of your hotel. Explorique will make all reasonable efforts to advise you of such fees in your booking documents.
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Explorique. By submitting a credit card authorization form to Explorique, you agree to allow Explorique to use your payment method to purchase travel products from our suppliers on your behalf. EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF EXPLORIQUE OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF EXPLORIQUE OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, EXPLORIQUE RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments and/or credit card guarantees for travel are due prior to departure according to each supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, and/or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to Explorique in writing. As a result of cancellation, third-party supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the supplier’s refund.
Explorique is has no control over refund policies and other rules mandated by resorts or accommodation providers. Failure to show up on the day of your check-in will be considered a no-show. No-shows will result in the cancellation of your booking, and the supplier's terms and conditions and cancellation policy will prevail with regard to whether any refund will be provided. The resort or accommodation provider reserves the right to cancel your booking at their discretion due to unforeseen circumstances, including but not limited to overbooking, natural disasters, or health and safety concerns. If the resort or accommodation provider cancels due to unforeseen circumstances or natural causes of your booking, Explorique will make reasonable efforts to offer an alternative arrangement or provide a refund, depending on the policies of the supplier.
Certain bookings may not be able to be changed. Once payments have been applied to a booking, change and cancellation policies are in effect both from the supplier and from Explorique, where applicable. Non-refundable penalties of 100% may apply to all or part of your bookings. Supplier charges for changes and cancellations vary and often depend on when cancellation is received. All requests for changes to a booking must be made in writing to Explorique. If eligible, changes to any reservations once confirmed may result in additional fees. Explorique will advise you of these fees in advance of any changes being made. Complete terms and conditions may be found in the suppliers' documentation and/or receipts. We strongly recommend that you purchase travel insurance to protect you from unexpected cancellations.
When tour, cruise or package prices are based on suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. A supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to, severe weather. Any alterations to an itinerary are at the sole discretion of the supplier, and Explorique bears no responsibility for any such changes. Any cancellations of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy. If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you.
TRAVEL DOCUMENTS AND ACCEPTABLE IDENTIFICATION REQUIREMENTS
It is your responsibility to obtain and carry a valid passport, visa(s), and/or any other acceptable identification documents required by applicable government regulations in order to board a flight for yourself and any member of your traveling party. The name, date of birth, and gender that appears on your acceptable identification documents must exactly match the same such data that is listed on airline ticket(s) and other Supplier booking records. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you and/or members of your traveling party to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. WHEN YOU RECEIVE ANY AND ALL TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT EXPLORIQUE WITHIN 24 HOURS IF CHANGES OR CORRECTIONS ARE REQUIRED.
It is also essential that you examine your passport well before your travel date to ensure that it is not damaged in any way. Passports with even minor damage may be rejected, resulting in your being denied boarding for flights and possible forfeiture of your travel arrangements.
Explorique strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Additional entry requirements and/or visas may be necessary to visit certain countries. It is your responsibility to check with the consulate or a visa agency about the necessary documents for your trip. You are responsible to make Explorique aware when you or other members of your traveling party intend to travel on a passport from a country other than Canada or the United States of America. Explorique neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel, and you are fully responsible to obtain any required visas in advance of your travel. Should a visa not be issued, Explorique is not responsible for lost payments made toward the contemplated trip. Note that rules of each country regarding entry and exit change on a daily basis. Please allow sufficient time for securing passports and visas as this process can be lengthy.
Children and infants also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided, such as a letter of consent or a court order. Any adult traveling with children may be required to show evidence of parenta/custodial and/or access rights. Foreign and domestic authorities may also require evidence that the adult has consent of both parents, legal guardian(s) and/or the court to travel with the children. Some countries may not permit children to enter or, in some cases, leave the country without the required documentation. Please consult appropriate authorities in your area of residence and intended regions of travel well in advance of your intended travel for further information.
It is strongly recommended that travelers carry printed copies of all travel documents and confirmations, especially when crossing international borders or using shuttle or third-party transfer services. Digital copies stored on mobile devices may not be accessible or accepted by certain customs or immigration authorities as valid proof of travel.
ADDITIONAL ENTRY AND EXIT REQUIREMENTS
Each country holds different views of past criminal offences, whether within or outside of their boundaries. If you have a current or prior criminal offence, contact that country directly for entry and exit requirements. Be aware that felony convictions or certain misdemeanors (like DUI) could result in denied entry. It is your responsibility to ensure you are legally able to enter certain countries as we do not inquire about an individual’s criminal record in the interest of respecting your privacy. Certain countries may require immunizations, health screenings and/or required documentation of such immunizations and screenings before travel and/or entry. It is your responsibility to ensure you have the proper vaccinations and/or health documentation prior to departure or upon landing at your destination. In some cases, required inoculations must be recorded on a valid vaccination certificate, which you must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, we advise that you check with your health practitioner BEFORE booking.
Travelers with dual citizenship should be prepared to present a valid passport from the country they are entering, as many countries — including Canada and the United States — require citizens to enter using their valid passport from that country. For example, entry will likely be denied to dual US/Canada citizens attempting to re-enter Canada or the United States with only a foreign passport.
Please note that entry to another country may be refused even if the required information and travel documents are complete. EXPLORIQUE WILL NOT BE LIABLE IN THE EVENT YOU OR ANY MEMBER OF YOUR TRAVELING PARTY ARE DENIED ENTRY INTO A COUNTRY FOR ANY REASON.
AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN
Please note that flight times are subject to change, and Explorique shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.
Advance seat selection on flights may be available for a nominal fee, depending on your class of booking. Please check with us for details if you would like assistance with advance seat selection. There are no guarantees that the airline will seat you with other members of your travelling party or not re-assign you to a different seat to accommodate changes in aircraft configuration. IN ALL CASES, EXPLORIQUE WILL NOT BE HELD RESPONSIBLE IF YOUR ASSIGNED SEATS ARE NOT AVAILABLE OR ARE CHANGED AT THE AIRLINES' DISCRETION, EITHER IN ADVANCE OR AT THE TIME OF TRAVEL.
Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights and all charter flights. Each airline may have cut-off times for check-in that differ from these recommendations. Please re-confirm your airline check-in times at least 24 hours prior to check-in. Travelers arriving after check-in cut-off times will be denied boarding and may results in the loss of the seat/reservation.
For charter flights, hotel check-out times often remain fixed, even if flight departure occurs in the evening. Please inquire at hotel check-in whether late check-out is available for purchase directly from the hotel. Missed flights due to delayed arrival at the airport will be considered a no-show by the airline, with no refunds provided.
Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Please check your documents for airline contact information and flight reconfirmation numbers.
IMPORTANT TRAVEL SECURITY MEASURES AND BAGGAGE ALLOWANCE
Visit www.catsa-acsta.gc.ca and https://www.tsa.gov/travel/security-screening for detailed information regarding heightened security measures for carry-on baggage in Canada and the United States. Please consult the relevant airline representative(s) and/or country authorities that are part of your booking to verify security procedures and on board restrictions in advance of your travel dates.
Specific size and weight restrictions and charges vary between airlines and regions. Do not assume that if your baggage is acceptable as checked or carry-on baggage with one airline that it will be acceptable with another. Also note that baggage allowances may vary with a specific airline to accommodate various aircraft configurations. Excess baggage charges may apply or your bag may not be accepted if limits are exceeded. Please check your documents for specific airline baggage allowances or contact the relevant airline representative(s) in advance of your travel dates for more details. IN ALL CASES, EXPLORIQUE WILL NOT BE HELD RESPONSIBLE FOR DISRUPTION TO TRAVEL PLANS DUE TO ANY BAGGAGE OR BELONGINGS THAT ARE NOT ACCEPTABLE FOR TRAVEL AND TRANSPORT FOR ANY REASON.
HAZARDOUS MATERIALS (USA)
Federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. INSECTICIDE NOTICE (USA)
We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
POSSESSION OF DRUGS AND CONTROLLED SUBSTANCES
You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor and that prescription drugs are in their original containers.
The Legalization of Cannabis in Canada did not change Canada's border rules. Taking cannabis or any product containing cannabis across Canada's international borders is illegal and can result in serious criminal penalties both at home and abroad. This is the case even if you are travelling to places that have legalized or decriminalized cannabis. Transporting cannabis used for medical purposes is also illegal. EXPLORIQUE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO ANY DESTINATION IS PERMITTED IF YOU ARE CARRYING ANY DRUGS OR CONTROLLED SUBSTANCES, AND EXPLORIQUE SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT YOUR OWN RISK.
CURRENCY
Travelers are recommended to obtain and use local currency when visiting international destinations. Do not assume that your home currency will be accepted when you travel internationally. Canadian currency and traveller's cheques are often not accepted abroad. Consult a bank or foreign currency exchange to find out the most appropriate currency to carry.
Exchange rates may also vary between the booking dates for your travel arrangements and your actual travel dates. Your credit card provider may also charge additional fees for transactions in a foreign currency. All exchange rate fluctuations and credit card processing fees are outside of Explorique’s control and responsibility.
There can be no guarantees that your credit or debit cards continue to be functional while you're traveling. Please consider bringing some currency and/or alternate credit cards with you to avoid difficulties. IN ALL CASES, EXPLORIQUE WILL NOT BE HELD RESPONSIBLE FOR DISRUPTION TO TRAVEL PLANS DUE TO INADEQUATE ACCESS TO CURRENCY AND/OR CREDIT CARDS FOR ANY REASON.
LOCAL TAXES AND FEES
Certain jurisdictions and resorts apply additional fees such as environmental taxes, tourist card fees, or departure taxes that must be paid locally and may not be included in your package price. These may vary by region and are typically collected at your accommodation or airport. We will make reasonable efforts to advise you in advance of known local fees, but travelers are responsible for ensuring they carry sufficient cash or cards to cover them at the destination.
LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
Explorique acts solely as a booking agent for third-party suppliers and is not the source or provider of any travel service. Each supplier is an independent entity with its own management and is not subject to the control of Explorique. The suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those suppliers.
BECAUSE EXPLORIQUE ACTS AS AGENT FOR THIRD-PARTY SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT EXPLORIQUE IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. EXPLORIQUE HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY SUPPLIER BOOKING THROUGH EXPLORIQUE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF EXPLORIQUE’S CONTROL, AND YOU HEREBY EXONERATE EXPLORIQUE FROM ANY LIABILITY WITH RESPECT TO THE SAME.
EXPLORIQUE HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND YOU AGREE AND UNDERSTAND THAT ANY RECOVERY FROM EXPLORIQUE WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY EXPLORIQUE.
RISKS/SAFETY
Travel to certain destinations may involve greater risk than others, and you may have personal safety or security risks that are different from other travelers, including food sensitivities and other medical conditions. Explorique strongly recommends you to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the Canada and US Government authorities prior to booking travel to international destinations.

Living standards and practices at your destination and standards and conditions there with respect to the provision of utilities, services and accommodation may differ significantly from those in Canada and the United States. We strongly encourage you to consult up-to-date reports published by the appropriate government authorities for all destinations in advance of your intended travel.
BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, EXPLORIQUE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT YOUR OWN RISK.
FORCE MAJEURE
Explorique will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under these terms and conditions that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods, and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Explorique. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
In addition, bookings made by Explorique with third-party suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the supplier, pursuant to their policies, although Explorique shall use its reasonable efforts to secure reimbursement for you where possible.
TRAVEL INSURANCE
EXPLORIQUE OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF YOUR ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.
You acknowledge that you have been advised about the benefits of purchasing travel insurance by Explorique and the possible results if you choose not to purchase travel insurance. The purchase of travel insurance is not required in order to purchase any other product or service offered by Explorique; however, if you decline to purchase insurance, you understand that declining travel insurance means you will lose all benefits of coverage and you fully accept that risk.
Without appropriate travel insurance, you acknowledge and agree that if you cancel or interrupt your travel for any reason, portions of the trip/tour may not be refunded and Explorique’s and the third-party suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full amount of your travel booking and related costs. Explorique is not a licensed insurance broker, and is not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. EXPLORIQUE CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE. EXPLORIQUE IS ALSO NOT AUTHORIZED TO REPRESENT AND/OR ADMINISTER ANY INSURANCE CLAIMS THAT MAY BE ELIGIBLE TO BE FILED UNDER THE POLICY.
GENERAL
For our internal accounting purposes, invoices in US or foreign currencies may converted to Canadian dollars at today's rate of exchange and therefore may not match exactly with your credit card statement.
The laws of the province of British Columbia govern these terms and conditions. You hereby consent to the exclusive jurisdiction and venue of courts in British Columbia in all disputes arising out of or relating to travel bookings with Explorique.
If any part of these terms and conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
These terms and conditions (and any other terms and conditions referenced herein) constitute the entire agreement between you and Explorique with respect to travel bookings made with Explorique by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Explorique. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these terms and conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
