The Crafted Escape – Terms & Conditions

0. Definitions

  • Agency refers to The Crafted Escape.
  • Client refers to the lead traveler or group representative booking through the Agency.
  • Supplier includes airlines, cruise lines, hotels, tour operators, or other third-party providers of travel services.
  • Agency Fees refer to all non-refundable planning, booking, and administrative fees charged by The Crafted Escape.
  • Travel Insurance refers to protection purchased through a third-party insurer, not through The Crafted Escape.

1. Mission, Scope & Binding Agreement

At The Crafted Escape, our mission is to craft stress-free, memorable, and transparent vacation experiences. These Terms & Conditions protect both you (the traveler) and us (your travel advisor) while ensuring a smooth and enjoyable planning process.

By submitting payment, signing, or otherwise confirming your booking, you acknowledge that these Terms constitute a legally binding agreement between you and The Crafted Escape, regardless of payment method used.

Execution Jurisdiction: All electronic transactions under these Terms are deemed executed in the State of Maryland, USA, regardless of client location.

2. Planning, Research & Consultation Fees

non-refundable $50 per traveler planning fee is required to begin research and provide up to three customized quotes.

  • This fee covers professional research, itinerary design, and supplier coordination.
  • If you move forward with a booking, the fee will be credited toward your final package.
  • If no booking is made, the fee remains non-refundable as compensation for time and service rendered.
  • All agency service fees are non-refundable, even if the trip is later canceled or changed.
  • All itineraries, quotes, and planning materials are the intellectual property of The Crafted Escape and may not be shared or used to book travel elsewhere without written consent.

Extended Consultation Policy: For custom itinerary design exceeding five (5) hours of planning, an additional hourly consultation rate may apply. Clients will be notified prior to any such charge.

3. Quotes, Pricing & Payments

All quotes are subject to availability and change until deposits are received and reservations are confirmed by the supplier.

  • Prices may vary due to currency fluctuations, tax changes, fuel surcharges, or supplier errors.
  • Prices quoted exclude mandatory local taxes, resort fees, and surcharges unless expressly stated. These may be collected directly by the supplier.
  • Prices quoted in foreign currency are subject to exchange rate fluctuations until full payment is received.
  • All payments must be made according to supplier deadlines.
  • Missed or late payments may result in cancellation and loss of funds.
  • 3% processing and administrative fee applies to all agency-processed credit card transactions.
  • Payments made in foreign currency are subject to bank conversion rates at the time of processing. The Agency is not responsible for exchange discrepancies or bank transaction fees.
  • Foreign Bank Fees: Clients are responsible for all international wire or bank-imposed transaction fees.

Payment Failure Clause: If a payment is declined or reversed for any reason, the Agency reserves the right to cancel reservations until payment is resolved. Clients are responsible for any resulting supplier penalties.

Payment Authorization: The Client confirms that all payment methods provided are authorized for use. If the payment method belongs to another individual, the Client confirms they have obtained explicit permission to use that card for this booking.

Supplier Payment Authorization: The Client authorizes The Crafted Escape to act as its agent for remitting payments to travel suppliers. Payments made to The Crafted Escape are processed on behalf of the Client and transmitted directly to suppliers. The Agency does not assume financial liability for supplier non-performance.

Credit Card Dispute Window: Clients agree that any billing disputes must be reported to the Agency in writing within 10 business days of the charge appearing on their statement.

Authorized Data Processors: The Client consents to the processing of personal and payment data through secure third-party systems, including Stripe, Square, TravelJoy, and PayPal Business, which comply with PCI-DSS and U.S. privacy regulations.

Reinstatement Fee: Reinstatement of canceled bookings due to late payment may incur a $50 administrative fee plus any applicable supplier penalties.

Digital Identity Verification: The Agency reserves the right to request identity verification for major payments or chargeback disputes. Failure to comply may result in booking suspension.

4. Agency Role & Responsibilities

The Crafted Escape acts solely as an independent agent for airlines, cruise lines, resorts, tour companies, and other suppliers. We do not own or operate these services and are not responsible for their acts, omissions, or performance failures.

We are not liable for:

  • Supplier errors, delays, schedule changes, or closures.
  • Acts of God, pandemics, weather disruptions, government restrictions, or labor strikes.
  • Losses caused by airline cancellations, overbooking, or supplier insolvency.

All refunds and remedies are subject to the policies of the individual suppliers involved.

No Guarantee Disclaimer: The Crafted Escape does not guarantee the performance of any supplier, the accuracy of third-party information, or the outcome of travel experiences.

Supplier Rebooking Clause: The Agency reserves the right to rebook equivalent services with alternate suppliers of equal or greater value in response to cancellations or system-wide changes.

Airline Schedule Disclaimer: The Agency cannot guarantee airline schedules or on-time performance and is not responsible for losses resulting from delays or cancellations.

5. Documentation & Traveler Responsibility

It is the traveler’s responsibility to ensure that all names, dates of birth, and identification details match government-issued ID exactly.

  • Passports must be valid for at least six months beyond your return date.
  • Travelers are responsible for securing visas, vaccinations, and entry documentation.
  • Denied boarding or entry due to missing or incorrect documents is not refundable.
  • Traveler Conduct: Clients must exercise reasonable personal safety and comply with all local laws. The Agency is not responsible for injury or loss caused by reckless or unlawful conduct.
  • Notification Acknowledgment: Notices sent electronically to the client’s provided email address are deemed received upon transmission, whether or not opened.
  • Government Policy Disclaimer: Entry or vaccination requirements may change at any time. The Agency cannot guarantee entry or refund due to policy changes.

6. Travel Protection

Comprehensive travel insurance is required for group travel and strongly recommended for all bookings.

  • Clients who decline coverage acknowledge they are self-insuring and assume all related risk.
  • Supplier-provided plans differ from independent insurance and may not cover medical events.

7. Cancellations & Refunds

All cancellations must be submitted in writing.

  • $75 per person cancellation fee applies, separate from supplier penalties.
  • Supplier timelines may exceed 90 business days.
  • Force Majeure Clause: Non-refundable deposits and fees are retained to cover services rendered before cancellation.
  • The Agency is not responsible for supplier-issued credit tracking; clients must redeem credits before expiration.

8. Force Majeure, Insolvency & Health

The Crafted Escape is not liable for losses due to:

  • Natural disasters, pandemics, terrorism, cyberattacks, transportation shutdowns, or civil unrest.
  • Supplier insolvency or bankruptcy.

Insolvency Fund Notice: The Crafted Escape does not maintain a supplier insolvency trust account. Clients are encouraged to obtain travel protection that covers insolvency.

Medical Evacuation: Clients are advised to obtain medical evacuation insurance for international trips.

9. Accessibility & ADA Waiver

  • ADA standards may not apply outside the U.S. The Agency cannot ensure ADA-compliant accommodations internationally.
  • Clients with mobility aids are responsible for ensuring airline/hotel compatibility.

10. Privacy & Data Compliance

  • Compliant with GDPRESIGN, and UETA.
  • Data Storage Location: All records are securely stored in U.S.-based or GDPR-compliant data centers.
  • Clients may request deletion of personal data after retention requirements expire.

11. Ethical & Social Responsibility

  • Zero-Tolerance Policy: Harassment, discrimination, or abusive behavior toward staff will result in service termination.
  • The Agency supports sustainable tourism and rejects suppliers engaged in child or exploitative labor.

12. Legal Jurisdiction, Arbitration & Enforcement

Governed by Maryland law, enforceable in any U.S. jurisdiction.

  • Disputes resolved through binding arbitration under AAA Consumer Arbitration Rules.
  • Class Arbitration Severance: If any portion of this clause is unenforceable, the remainder remains binding.
  • International Law Compatibility: These Terms align with international contracting principles under the CISG.

13. AI Communication, Mediation & Successor Clause

  • AI Disclaimer: The Agency may use AI or automation tools for communication and document preparation, reviewed by human staff.
  • Mediation Clause: Both parties agree to mediation before any legal action regarding reputation or disputes.
  • Successor Clause: In the event of rebranding or transfer, contracts remain binding on The Crafted Escape’s successor entity.
