PLEASE READ THIS NOTICE. BY MAKING A PAYMENT YOU AGREE TO THE TERMS AND CONDITIONS AS SET FORTH BELOW. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL THE TRAVEL AGENCY IF YOU HAVE ANY QUESTIONS.
THE ART OF ESCAPE TRAVEL is acting as a mere agent for SUPPLIERS (identified on the forthcoming documents) in selling travel-related accepting services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Travel Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers' companions or group members.
Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, Travel Agency does not guarantee any of such supplier's rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. Travelers have done due diligence, are aware of the quality of the hotel accommodations chosen and agree that Travel Corporation will not be responsible if they are not satisfied.
COVID-19, Pandemic Risks, Cancellations and Insurance:
Traveler assumes complete and full responsibility for, and hereby releases The Art of Escape Travel and any of our Independent Contractors harmless should you not comply with the entry requirements to your particular country and/or your return back to the USA. You can check the government website that you are traveling to for any travel warnings as well as the country you are visiting for the most up to date Covid Restrictions and requirements. [http://travel.state.gov/travel/warnings.html. For medical information, call the U. S. Centers for Disease Control (CDC), (404) 332-4559 or log on to www.cdc.gov./travel. The Art of Escape Travel is not held liable for, for checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. It is the passenger’s responsibility to have proper passports, passenger declarations, testing and any other form or requirement for your destination. The Art Of Escape Travel shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, local laws, terrorists acts, bankruptcy or cessation of supplier or carrier services, climatic conditions, Acts of God, Covid or any other Pandemic delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of Picture This Travel’s control.
If travel plans are delayed or cancelled for any reason there will be no refunds issued by The Art of Escape Travel. All refunds come from our supplier. There will be no refunds for cancellations made 90 days or less before departure, unless approved by the travel suppler including cancellations due to actual or threatened terrorist events. There will be no refunds due to fear of travel from actual or threatened terrorist events.
By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency.
TRAVEL VISAS, VACCINATIONS, ETC.: Some countries require a Visa to visit their country, even for a short vacation. Please discuss potential Visa requirements with your Travel Counselor. Please refer to the United States government website for complete and current requirements for country(s) you wish to visit: https://travel.state.gov/content/travel/en/international-travel.html
TRAVEL INSURANCE: Travel insurance is optional, but highly recommended. If you decline travel insurance, you must notify your Travel Counselor via email, or in writing. Declination of insurance indicates that you understand you may not have coverage for any/all of the following: Trip Cancellation (cost of trip), Trip Interruption or Delay, Baggage Loss or Delay, Medical Coverage when on a ship or in a non-U.S. port, emergency evacuation for medical, political or weather-related reasons, death, dismemberment, etc. It's extremely important that you discuss travel insurance with your Travel Counselor.
PRE-EXISTING MEDICAL CONDITIONS: In order for your travel insurance to cover pre-existing medical conditions for either the traveler, or for any covered person that may cause you to cancel, travel insurance MUST BE PURCHASED WITHIN 14 DAYS FOLLOWING THE FIRST ITEM THAT WAS PLACED UNDER DEPOSIT BY OUR AGENCY.
NOTE: Travel insurance does not cover you for death or injury resulting from activities such as sky diving, bungee jumping, parasailing, etc. To be certain if your activity will be covered, contact the insurance provider directly. You should ensure that the provider of your activity has insurance which will cover emergency medical/dental, emergency transportation, and repatriation of remains, if necessary.
ACCURACY OF GUEST INFORMATION: For EACH guest booked, the first and last name, gender and date of birth, MUST BE ACCURATE AND MATCH EXACTLY to the ID used for travel (e.g. passport, birth certificate, driver's license). If ANY discrepancies are noted, contact your ART OF ESCAPE TRAVEL agent immediately upon receipt of this invoice and BEFORE authorizing your initial deposit payment and/or full/final payment. Payment authorization using our PAY NOW feature constitutes your review and APPROVAL that each guests' information has been checked by you for accuracy.
BRIDES OR NEWLY MARRIED: Your travel MUST be booked with the name that matches the ID you will be using for travel. If you are newly married and have not yet changed your Driver's License or Passport to your married name, YOU MUST TRAVEL UNDER YOUR MAIDEN OR PREVIOUS LEGAL NAME!!! Simply showing your marriage license as proof of your new name is NOT sufficient! THE DOCUMENT YOU ARE USING FOR IDENTIFICATION must match the name on your booking. Your invoice will reflect the name under which you are booked. Payment authorization using our PAY NOW feature constitutes your review and approval that your booked name matches the ID you will be using for travel.
ALL PRICES SUBJECT TO CHANGE UNTIL UNDER DEPOSIT. Please note that THE ART OF ESCAPE TRAVEL cannot guarantee pricing until a deposit has been made.
AIRLINE ITINERARIES: Airlines may change air schedules/flight numbers without notice. The Art of Escape Travel is not responsible for these changes. THE ART OF ESCAPE TRAVEL ADVISES CLIENTS TO CHECK THE AIRLINE'S WEBSITE 24 HOURS IN ADVANCE TO CONFIRM FLIGHT TIMES AND TO DOWNLOAD THE AIRLINES APP AS WELL AS SIGN UP FOR DIRECT ALERTS FOR ANY FLIGHT CHANGES. Air bookings are subject to the rules and regulations set forth by the airline. In addition, Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids, aboard the aircraft. If you do not understand these restrictions, contact your airline or go to http://www.faa.gov/about/initiatives/hazmat_safety.
CRUISES: Cruise Lines reserve the right to alter cruise itineraries without notice. The Art of Escape Travel is not responsible for these changes. Cruise bookings are subject to the rules and regulations set forth by the cruise line.
PASSPORTS: Passports are not needed for all bookings. If your trip will take you outside of the United States, please read the following section carefully to determine the passport requirements for your booking. The Art of Escape Travel is not responsible for non-compliance with government regulations regarding travel documentation.
PASSPORTS FOR CRUISE BOOKINGS: If your cruise departs and returns to the same United States port, you MAY use a birth certificate with a seal in lieu of a Passport, or you may also use a Passport Card. If, however, you must return to the United States via any other transportation, for any reason, you will be denied transport without a valid Passport BOOK! For this reason, The Art of Escape Travel recommends that clients always travel outside the United States with a valid PASSPORT BOOK!
PASSPORTS FOR NON-CRUISE BOOKINGS: You cannot travel outside the United States without a valid PASSPORT BOOK! You cannot use a birth certificate, driver's license, or Passport Card - you must have a Passport Book.
PLEASE LOCATE AND CHECK YOUR PASSPORT BOOK AND ENSURE THAT THE PASSPORT WILL NOT EXPIRE UNTIL, AT A MINIMUM, SIX MONTHS AFTER THE DATE YOU RETURN HOME!! If your passport will expire less than six months after you return home to the U.S., contact your Travel Counselor for advice on which countries you are visiting and their specific expiration date requirements, or consult the website http://travel.state.gov/content/travel/en.html
NOTE: Passport documentation MUST be in good condition, e.g. no missing or torn pages, no excessive bending, or suspicious tampering/manipulation of the document. Passports must be in compliance with not only the United States requirements, but also for the countries you are visiting while traveling.
CANCELLATIONS AND CHANGES: The agency must be notified by the client, via email, or in writing, of the intent to cancel any portion, or all, of their booking. The Art of Escape Travel reserves the right to assess a "per person" administration fee for any cancellation or change. This is separate from any Vendor cancellations. Cancellation and/or change fees can be provided by your Travel Counselor.
Agency Disclaimer: The Art of Escape Travel and our Independent Contractors, an independently owned and operated agency, acts solely as a general booking agent on behalf of the customer, for the purpose of processing bookings and reservations with various cruise lines and travel suppliers. The Art of Escape Travel and our Independent Contractors have no control over the travel suppliers, the fares charged for services, their policies and procedures, changes in itineraries, the scheduling of their services, or their methods of providing services. Therefore, The Art of Escape Travel and our Independent Contractors shall not be liable or responsible, and is released of responsibility and liability, for any delay, inconvenience, loss or damage for personal or property injury, to any Passenger resulting from breach of contract or any acts or omissions on the part of any travel supplier, cancellation of any service by a travel supplier, any refund due from a travel supplier, any terrorist activities, civil or labor unrest, mechanical or construction defects or failures, diseases, local laws, climatic conditions, or any other cause.
Travel Supplier Policies: Travel suppliers’ brochures contain important information. Read travel suppliers’ policies concerning cancellation penalties. It is each passenger’s responsibility to have all required documentation, including but not limited to: (1) government issued birth certificate and photo ID, or (2) valid passport and/or visa. Passports are recommended for all travel. All passengers assume full responsibility for inquiring and confirming passport, visa, vaccination, other entry requirements, safety and security conditions of destinations to be visited. The “Taxes” category on the Travel Invoice includes air taxes, port taxes, departure fees, government fees and fuel surcharges if applicable. These costs are imposed by the suppliers and airlines and are subject to change until time of departure. The Art of Escape Travel and our Independent Contractors have no control over these taxes and fees and should they increase, your invoice will reflect this increase.
Cruise Line Air: If you have purchased air flights as part of your cruise package from the cruise line you may or may not receive a non-stop itinerary. The Art of Escape Travel and our Independent Contractors do not have control over the airline or the flight schedule that you are assigned. The cruise lines reserve the right to assign airlines and schedules (including commuter flights and charters) at their discretion. In many cases seat assignments for cruise line assigned flights are not available until check-in at the airport. Any special requests for air travel must be made at least 120 days prior to departure date. The service is an ‘air customization’ and deviation charges are assessed per person, plus any fare differential. Regardless of whether you purchase the travel supplier or on your own, it is imperative that you reconfirm your flights directly with air carrier 72 hours and then again 24 hours prior to travel. The Art of Escape Travel and our Independent Contractors are not responsible for any flights provided either by the travel supplier or booked directly with the airline.
