Wish It Travel Terms and Conditions

Your Agreement with Wish It Travel LLC
Before we make or finalize arrangements for your flight, hotel, car rental, tour, cruise, or other trip, we require that you sign this form. Your signature will signify your agreement with the following terms and conditions:
1. Agent for Suppliers. Wish It Travel LLC ("we" or "us") and its independent sales contractors are not the source or supplier of the travel services you have requested, and act solely as an agent for the actual suppliers of such services (the "Suppliers"), such as airlines, hotels, car companies, cruise lines, and tour operators. The Suppliers whose names appear in the information supplied to you are those who are actually responsible for providing the travel services. You agree not to hold us or our independent sales contractors responsible should any of these suppliers: 1) fail to provide the travel services requested; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience; or 4) change or modify any portion of the itinerary, including but not limited to air carrier, routing, ports of call, or scheduling. We have no special knowledge regarding the financial condition of the Suppliers, and we have no liability for recommending a trip credit in lieu of a refund.
2. RELEASE. YOU HEREBY RELEASE AND DISCHARGE US, OUR OWNERS, EMPLOYEES, AGENTS, AFFILIATES, REPRESENTATIVES, AND INDEPENDENT SALES CONTRACTORS FROM AND AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, DEBTS, DEMANDS THAT YOU MAY HAVE FOR ANY INJURY, COSTS, PROPERTY DAMAGE, PERSONAL LOSS, OR DEATH, OR THOSE TRAVELING WITH YOU, IN CONNECTION WITH ANY ACCOMMODATIONS, TRANSPORTATION OF OTHER TRAVEL SERVICES, OR RESULTING DIRECTLY OR INDIRECTLY FROM ANY OCCURRENCES OR CONDITIONS THAT ARE BEYOND OUR REASONABLE CONTROL. THIS RELEASE SPECIFICALLY INCLUDES GIVING UP ANY RIGHT YOU MAY HAVE TO SUE US FOR NEGLIGENCE FOR SERVICES RENDERED BY THE ACTUAL PROVIDERS OF SERVICES AND/OR SUPPLIERS.
3. Review the Itinerary. You agree to check the itinerary, invoice, and travel documents for accuracy upon receipt and to contact us or our independent sales contractors if you have any questions. Discounted fares typically involve restrictions and changing any aspect of your travel arrangements may result in the payment of additional money. You acknowledge that you have been advised of, and are responsible for, any change/cancellation or other penalties that apply to your reservation and that any cancellation or modification may result in penalties that may include loss of deposit or no refund.
4. Credit Card Authorization. You authorize us to serve as your agent and provide your credit card/payment to the supplier(s) on your itinerary for the deposit and full payment for your trip. You acknowledge the information presented to you is accurate. You agree to all agency and Supplier terms and understand that you are fully responsible for all payments applied to your reservation(s). We recommend that you use a credit card as this may offer the opportunity to dispute the charge should a vendor cease operating.
5. Necessary Documentation. The Transportation Security Administration (TSA) requires you to carry government-issued identification in order to board a flight. Your name, date of birth and gender that appear on the identification must exactly match what is on your airline ticket and in booking records. Failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight. You further acknowledge that beginning on May 7, 2025, you must present a driver's license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information). If traveling internationally, you must have a valid passport, and depending upon my destination and nationality, you may need to obtain one or more visas. Be aware that any foreign country, including Canada, may deny entrance to anyone with any type of criminal record.
6. Risks of Travel.
a. In General: We and our independent sales contractors have no special knowledge regarding unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel, and we have no special knowledge of the suitability for disabled persons of any portion of your trip. For information concerning possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. Travel Warnings Section, or http://www.travel.state.gov/, click on "Find International travel Information" then click on "Country Information", and fill in the name of the destination country .For medical information, Wish It Travel recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel and click on "Destinations". You assume full and complete responsibility for checking and verifying any passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). YOU HEREBY RELEASE US AND OUR INDEPENDENT SALES CONTRACTORS FROM ALL CLAIMS ARISING OUT OF ANY PROBLEM COVERED IN THIS PARAGRAPH.
b. COVID Risks of Travel. You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risks of COVID-19. We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA's website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. By traveling during the ongoing COVID-19 pandemic, you acknowledge the contagious nature of COVID-19 and voluntarily assume all risks related to exposure to COVID-19. YOU HEREBY RELEASE US AND OUR INDEPENDENT SALES CONTRACTORS FROM ALL CLAIMS ARISING OUT OF ANY PROBLEM COVERED IN THIS PARAGRAPH.
7. State Seller of Travel Registrations.
a. Washington. Wish It Travel, LLC is registered with the State of Washington as Seller of Travel; No. 605-85-4101. If transportation or other services are canceled by us, all sums paid to us for services not performed in accordance with this agreement will be refunded within 30 days of receiving the funds from the supplier, if we did not send funds to the vendor, we will refund them within fourteen days after cancellation by us, unless you request that we apply the money to another travel product and/or date.
b. California. Seller of Traveler # 2164787-50. California law requires that certain sellers of travel have a trust account or bond. This business has a bond. This business is not a participant in the California Travel Consumer Restitution Corp, which covers California-based sellers only. If the supplier cancels, we will refund all sums paid to us for services not provided, unless you advise us in writing to the contrary, after cancellation. This does not apply where we have remitted the payment to another registered seller of travel or a supplier. In this situation, we will provide a written statement accompanied by bank records establishing our disbursement of the payment to the supplier, and if disbursed to another seller of travel, proof of its current registration.
c. Florida. Wish It Travel, LLC is registered with the State of Florida as Seller of Travel No. ST45663
8. Supplemental Price Increases. Travel arrangements involving airline tickets, air tours and cruise components are subject to supplemental price increases after the date of purchase due to additional charges imposed by a supplier or government. YOU may be charged additional sums by us and/or the supplier(s), to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. You hereby consent to such increases and authorize us and/or the supplier(s) to charge your credit card for such additional amounts.
9. Travel Insurance. We and our independent sales contractors recommend the purchase of travel insurance. However, no representation or description of the insurance made by us or our independent sales contractors constitutes a binding assurance or promise about the insurance. Please check and initial your acceptance or refusal of travel insurance below.
10. Claims Deadline, Governing Law, and Exclusive Forum. You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that this agreement will be governed by Illinois law and that the courts in Grundy County, Illinois will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
