1. Acceptance of Terms
By engaging in services provided by AH Global Ventures LLC dba Travel With Angela Hope ("Company," "I," "me," or "my"), you ("Client") agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully, as they outline the rights, responsibilities, and limitations associated with using my services.
2. Services Provided
The Company provides travel advisory, planning, booking, and concierge services, including but not limited to:
- Hotel bookings
- Custom itinerary planning
- Transportation recommendations and/or arrangements
- Recommendations and/or bookings for activities, dining, and accommodations
- Additional travel-related services, as agreed upon in writing
The Company acts as an advisor providing curated recommendations and booking services, based on the Client’s preferences. However, I am not responsible for the actions, omissions, or decisions of third-party providers (e.g., hotels, airlines, tour companies). The Client acknowledges that final responsibility for travel arrangements and decisions lies with them.
3. Agent vs. Advisor Role
The Company acts as an intermediary ("booking agent") between the Client and various third-party suppliers, including airlines, hotels, and other travel service providers. While I facilitate the booking process and provide expert recommendations, I do not control or operate the services provided by third parties. The Company is not responsible for any failure by third-party providers to fulfill their obligations or for any damages, delays, or cancellations that may occur.
4. Legally Required Disclosures
The Company discloses that:
- All travel arrangements are subject to the terms and conditions of third-party providers, which may include suppliers, airlines, hotels, and other travel operators.
- Travel services are governed by federal and state regulations applicable to travel advisors. I advise Clients to familiarize themselves with applicable travel and safety requirements before booking.
- The Company is not liable for any legal restrictions or prohibitions regarding travel to or from specific destinations, including restrictions based on Client nationality or other factors beyond my control.
5. Client Responsibilities and Advisories
The Client is responsible for ensuring that they and all travelers meet all entry, exit, and safety requirements for travel, including but not limited to:
- Passports and Visas: It is the Client’s responsibility to ensure that all travelers possess valid passports and obtain any necessary visas before travel. Many countries require passports to be valid for at least six months beyond the travel dates.
- Health and Safety: Clients are encouraged to consult government travel advisories and health warnings before travel. The Company is not liable for any health or safety risks associated with travel.
- Prohibited Substances: It is strictly illegal to transport controlled substances, including marijuana, across international borders, even where permitted by state law. The Client assumes full responsibility for adherence to customs regulations and laws.
- Risk Awareness: Travel involves inherent risks, including but not limited to accidents, personal injury, or property damage. By accepting these Terms, the Client agrees that they understand these risks and assume full responsibility for them.
6. Payment Terms
- Fees and Charges: The Client agrees to pay all fees for the services as outlined in the agreement or invoice provided.
- Non-Refundable Deposits: Certain services may require a non-refundable deposit, as specified in the booking agreement. This deposit will not be refunded if the booking is canceled, regardless of the reason.
- Cancellation and Refunds: Cancellations and refunds are governed by the terms of each third-party provider. The Company will communicate and facilitate refund requests but is not responsible for the decisions or policies of third-party providers.
7. Cancellation and Refunds
The Company is not liable for any cancellation, delay, injury, or other issues that arise due to actions or omissions by third-party providers. By accepting these Terms, the Client agrees that any recourse for such issues must be directed to the provider in question, and the Company is not liable for damages resulting from the actions of these independent suppliers. In the event of a dispute, the Company’s liability, if any, is limited to the fees paid to the Company for planning and booking services.
8. Third-Party Suppliers
The Company may recommend or book services with third-party suppliers, including but not limited to hotels, airlines, and tour providers. These suppliers operate independently of the Company, and I am not responsible for their actions, omissions, or policies. The Client is subject to the terms and conditions of each supplier and should review these independently.
9. Limitation of Liability
The Company is not liable for any indirect, incidental, or consequential damages arising from or in connection with the services provided, including but not limited to:
- Personal injury or property damage during travel
- Delays, cancellations, or modifications to travel itineraries
- Loss of personal items, financial losses, or missed opportunities due to unforeseen circumstances
- Acts of nature, government actions, or other events beyond the Company’s control
In the event that the Client pursues legal action against the Company, the Client agrees that any damages awarded shall be limited to the amount of commission, booking fees, or planning fees paid by the Client to the Company, regardless of the nature of the claim.
10. Travel Insurance
The Company strongly recommends that Clients obtain comprehensive travel insurance to cover potential risks, including but not limited to medical expenses, trip cancellation, and personal property loss. The Company is not responsible for any losses incurred by the Client due to failure to obtain adequate insurance.
11. Changes to Itinerary
The Company reserves the right to make modifications to the itinerary if circumstances require it, including but not limited to:
- Safety concerns
- Changes in availability with third-party suppliers
- Unforeseen events beyond the Company’s control
The Client will be notified of significant changes as soon as possible, and alternative arrangements will be proposed where available.
12. Force Majeure
The Company shall not be held liable for any delay or failure to provide services due to circumstances beyond its control, including but not limited to natural disasters, political unrest, pandemics, strikes, or other events that significantly affect travel conditions ("Force Majeure Event"). In such cases, the Company will make reasonable efforts to reschedule or rebook services but cannot guarantee availability or refunds.
13. Disclaimer of Warranties
The Company provides services on an "as-is" and "as-available" basis. The Company makes no guarantees, warranties, or representations regarding the quality, completeness, or accuracy of services provided by third-party suppliers.
14. Confidentiality and Privacy
All personal information provided by the Client will be treated in accordance with my Privacy Policy. The Company is committed to protecting Client privacy and will not disclose personal information except as required by law or as necessary to complete bookings or services with third-party providers.
15. Intellectual Property
All content, materials, and recommendations provided by the Company are the intellectual property of Travel With Angela Hope and are protected by copyright law. Unauthorized reproduction, distribution, or use of this material is strictly prohibited.
16. Dispute Resolution
In the event of a dispute, the Client agrees to seek resolution through negotiation or mediation before pursuing legal action. If the dispute cannot be resolved through these means, it will be submitted to binding arbitration in California, USA, in accordance with the rules of the American Arbitration Association (AAA).
17. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of California, USA, without regard to its conflict of laws principles.
18. Amendments to Terms
The Company reserves the right to amend these Terms at any time. The latest version will be posted on my website, and continued use of my services constitutes acceptance of any changes.
