Terms & Conditions of booking and service

The person completing the booking warrants that he/she has authority to accept the passage ticket conditions on behalf of all persons named on the booking.

It is important that you and all members of the travelling party are aware of the following important terms & conditions as they relate to all bookings held by our office on your behalf. If you are making bookings on behalf of a couple or group of people it is your responsibility to ensure that all members of the travelling party are aware of these terms & conditions and that you have accepted them on behalf of all those travelling on the booking. We will not be liable for a lead traveller’s failure to share these Terms and Conditions with all travellers in their group.

Where you are obtaining Services for your own personal or leisure travel and your immediate family members, such as a spouse and/or minor children, you represent and warrant that you have the authority to act on behalf of such immediate family members with respect to the Services.

Where you are obtaining personal or leisure travel Services for others who are not your spouse or minor children (i.e., children who are the age of majority, parents, siblings and their families, friends, or others) (“Other Travelers”), you represent and warrant that you have the authority to act on behalf of such Other Travelers. Where you are obtaining Services for a group of people, you should be honest and upfront with those within the group, particularly regarding financial issues and limitations. Me Time Holidays & Travel is not responsible for any division of fees and costs among Other Travelers and, unless otherwise stated in writing, you shall remain solely responsible for all fees and costs.

We draw your attention to the Terms and Conditions below, these Terms and Conditions including all brochures, documents, correspondence, and the terms and conditions of our suppliers form the basis of the contract with you. Before making a booking with us you must ensure that you have read and understood these Terms and Conditions (and ask any questions you may have). By asking us to confirm your booking you are accepting all the Terms and Conditions laid out below and acknowledging that you have read the Terms of this Contract and agree with it.

You understand and agree that you are hiring Me Time Holidays & Travel to act as your agent for the specified purpose of performing Services. This limited purpose includes our action as your agent in circumstances such as acquiring transportation, hotel accommodations, sightseeing, and other related services for your benefit. You understand that performance of Services may require us to enter into agreements and pay deposits or costs upfront in order to secure such services for your benefit and you hereby delegate authorisation and signature authority to us to enter into such agreements and charge your credit card according to the terms of this Service Agreement. We will make all reasonable efforts to inform you in writing prior to acting as your agent of the transaction’s nature and our planned action.

Prices quoted are in Australian dollars unless specified and are subject to change at the discretion of the supplier, until paid in full. This can be due to changes in taxes, fuel surcharges, currency fluctuations or other factors beyond our control.

Me Time Holidays & Travel receives fees or commission from third parties/suppliers under this contract. Me Time Holidays & Travel offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Me Time Holidays & Travel does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that Me Time Holidays & Travel acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that Me Time Holidays & Travel shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

Service Fees

Advisor’s fee for Services is determined by the scope and complexity of the contemplated Travel; the specific amount will be communicated following the initial consultation call. Our Service Fee/s is always non-refundable, even if you decide not to book with us or your reservation is cancelled.

You understand and agree that our Service Fee does not cover the cost of any travel arrangements, including but not limited to: airfare, hotel reservations, tour operator fees, or other costs deriving from booking your Travel Experiences with airlines, hotels, tour operators, or other suppliers. For such costs, you are responsible for providing us with a signed authorisation form that gives us the authority to purchase on your behalf and charge it to your credit card or another authorised payment method.

Product Prices

Price quotes are applicable to the date and time at which they are issued and cannot be guaranteed until payment is made. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card issuer fees. Advisor is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees, or supplier-imposed increases.

Booking Procedure

To make a booking with Me Time Holidays & Travel you must be at least eighteen years old and agree to all the terms and conditions as advised in this document. In order to secure a booking you must pay a deposit or in full as advised. The person completing the booking warrants that he/she has authority to accept the passage ticket conditions on behalf of all persons named on the booking.

You should carefully read all the terms and conditions specific to the product you are booking before finalising your travel transaction. A deposit must be received within the time specified to confirm a booking. The booking will be automatically cancelled if no deposit is received within this time.

Booking Conditions

Reservations are subject to the terms, conditions and requirements of carriers, hoteliers and other service providers. You should carefully read all the terms and conditions specific to the product you are booking before finalising your travel transaction. Suppliers often reserve the right to cancel or vary any itinerary and substitute components of any tour, including but not limited to hotels and accommodations of comparable quality, if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on a tour. During local or national holidays or special events, peak seasons, on certain days of the week, and during religious occasions, certain facilities such as museums, churches, restaurants, sightseeing tours, hotels, and shopping may be limited or not available. Alternatives will be offered whenever possible. Advisor cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes and will not be considered cause for cancellation by the traveller. Normal cancellation penalties still apply to the tour that has been changed.

Fares & Prices

Me Time Holidays & Travel does not guarantee fares or prices until full payment has been received. Schedules and availability, fare conditions and prices can change at any time. Routing restrictions and other special conditions may apply. Deposits merely hold the reservations and do not guarantee prices.

Accuracy of Information and limitations of liability

Me Time Holidays & Travel does not endorse or recommend any particular travel service provider. Me Time Holidays & Travel and its third party suppliers have taken reasonable care that all travel information and listings is correct but is subject to amendment at any time without notice. Me Time Holidays & Travel publishes such information in good faith and if in doubt you should check with a representative of Me Time Holidays & Travel to ensure any information displayed is correct at the time of booking. You acknowledge and accept that: Me Time Holidays & Travel accepts no responsibility or liability for any fault or delay on the part of any third party in providing travel services to you where your booking has been properly processed by it; nor are we responsible for any acts or omissions of airlines or other third parties in the course of delivery of such travel services. Under no circumstances will we be liable for direct, indirect, consequential or incidental damages including but not limited to lost profits or savings or damages for disappointment.

Airport Check-in

It is strongly recommended that you check-in at the airport a minimum of two (2) hours prior to scheduled departure for domestic flights and three (3) hours prior to scheduled departure for international flights. It is the traveler's responsibility to reconfirm flight times at least 24-72 hours prior to scheduled departure. Recommended check-in times are subject to change without notification. It is the traveler's responsibility to remain abreast of changes in condition or airport rules that might require earlier arrival times. This information can be found when entering your confirmation number on the airline website. Me Time Holidays & Travel will not assume responsibility for any air or schedule changes.

Payment Options

All prices are based on payment by cash, credit card or direct deposit. Credit card payments incur a transaction fee imposed by the merchant and declared at the time of payment.

Cancellations and Administration Fees

Any and all cancellations must be made in writing. Once you have paid a deposit your booking is subject to cancellation/amendment fees. Each cruise line, airline and tour operator has their own cancellation policies and you should refer to their specific terms and conditions for information regarding cancellation charges. Specific cancellation fees for your booking are available from your travel advisor. Where amendment of a booking is permitted by the travel supplier, a charge of $50 per person is payable to Me Time Holidays & Travel for each permitted amendment. This is in addition to any fees charged by the individual suppliers. In addition to supplier cancellation fees, Me Time Holidays & Travel charge an administration fee of $100 per person for any cancellation received prior to final payment, or 10% of the total booking value once final payment has been received. Refunds are provided based on these conditions and only on receipt of any refund from the suppliers involved. Any refunds will be processed in the same manner as were received. If paid by credit card, a refund will be made back to the same card. Merchant fees as outlined under 'Payment Options' are non refundable. Payments received by EFT will be refunded to the same original payor.

Amendment Fees

Where amendment of a booking is permitted by the travel supplier, a charge of $50 per person is payable to Me Time Holidays & Travel for each permitted amendment. This is in addition to any fees charged by the individual suppliers.

Service Fees

A non-refundable Service fee may be payable in respect of certain transactions. These fees are payable in addition to those imposed by travel service providers. Please contact your advisor for more details.

Travel Documentation

Passport, Visa and Health requirements are the responsibility of individual travellers. Passports are required for all travellers departing Australia. Permanent residents travelling on a foreign passport must hold an Australian Re-entry Visa. Many countries require that foreign nationals entering hold a passport with at least six months validity. The final responsibility for ensuring documentation is correct is that of the individual traveller. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. Me Time Holidays & Travel will not be held responsible for tickets or documents lost by a third party, such as Australia Post.

Travel Insurance

Travel Insurance is highly recommended for all travellers. Please ensure you take note of the special inclusions and exclusions as they may relate to your particular circumstances. Pre-existing Medical Conditions and cover for this must be approved by the Insurer. You also understand and agree that we are not insurance agents and, if you do elect to purchase trip cancellation and/or travel accident insurance referred to you by us or independently acquired by you, travellers in your group, or Other Travelers, it is not our responsibility but the traveller’s sole responsibility to understand those travel insurance policy benefits, limitations, and restrictions and that any travel insurance policy is an Agreement solely between the traveller and the traveller’s insurance company.

Taxes Imposed

A large number of Airport, Departure & Security Taxes are imposed by various countries, states and towns around the world and in Australia. Where applicable these have been included in the cost of the travel product and are shown in the relevant tax boxes. There may be some variation in final costs depending on exchange rate fluctuation and the number of taxes imposed at time of booking. Any additional costs or taxes that will be required to be paid are the responsibility of the traveller.

Passports

Passports are required for all international travel. Passports must have a minimum of 6 months validity from the date of scheduled return to Australia. Travel documents and airline tickets must exactly match the name and spelling as appears in the passport. Additionally, for security reasons some airlines may require all details as they appear in the passport prior to ticketing. Please ensure that you advise your consultant of correct details at the time of booking. We will need to sight your passport before any documents can be released and we will not be liable for any incorrect information given to us nor for any re-issue fees imposed by the airline or tour operator should re-issue of documentation be required. If travelling on any passport other than Australian you must inform us immediately as it may be necessary to obtain a Re-Entry Visa into Australia or visas for other countries. Whilst we offer full assistance it is the responsibility of each traveller to ensure that they have full and correct documentation to undertake their journey.

Visa Requirements

Australian Passport holders require visas to enter some countries. Some countries allow for a "visa free" stay for tourism purposes. If you are travelling on business this does not always apply. Also, if you or a member of your travelling party have a criminal offence entry may be denied. Please speak with your travel consultant about this.

Please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration official(s). Should a visa not be issued, Me Time Holidays & Travel is not responsible for lost payments made toward the contemplated trip.

Some consulates charge visa fees and we reserve the right to charge a service fee to cover courier fees and the like should we obtain this documentation on your behalf. Issuance of visas is not the responsibility of your travel agent and we cannot be held responsible should you be unable to obtain the correct visas to undertake your journey.

Frequent Flyer Programs

Many airlines offer Frequent Flyer Reward Programs - if you are not a member of any of these programs we are happy to discuss your options and the benefits with you. Similarly, if you are a member of any Frequent Flyer program please ensure that your consultant is aware of this immediately so that the necessary steps can be taken to ensure that you earn the rewards. As a safeguard it is also advisable to keep all your boarding passes so that you can verify this against your Points Summary after travel has been completed.

Dept.of Foreign Affairs & Trade Warnings

For reasons of political unrest, acts of war or terrorism or natural disasters in certain parts of the world the Australian Government in conjunction with various other worldwide bodies may decide to issue a Government Advisory warning to Australian passport holders not to travel to that country. In these instances whilst travel to some countries is not advisable and some clauses of the travel insurance coverage may not be in affect we appreciate that some clients may still need to travel to those areas. Whilst we are prepared to make these bookings on our clients' behalf we do so without responsibility or liability.

Third Party Suppliers

As a licensed travel agent, we act only as an agent for services supplied on behalf of third parties such as airlines, cruise lines or hotel operators. Advisor, and its employees, members, agents, and representatives use third-party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this tour. Advisor is an independent contractor and is not an employee, agent, or representative of any of these suppliers. Advisor does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. All suppliers are independent contractors and are not agents or employees or representatives of Advisor. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilising the services, all travellers agree that neither Advisor, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveller or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Advisor. Each supplier operates under their own terms and conditions. By booking services with a supplier you are subject to their terms and conditions and it is your responsibility to ensure you are familiar with these terms. Limitations of Liability

Me Time Holidays & Travel shall not be responsible to the passenger for supplying holiday arrangements. Holiday arrangements include but are not limited to accommodation, flights, cruises, tours and transfers. These services are provided by reputable suppliers on their conditions. Therefore it should be noted all bookings with us are subject to the terms and conditions and limitations of liability imposed by the supplier. We accept no responsibility if you, the passenger, is refused entry to the intended country/countries visited. We will not be responsible for any expenses, costs, liabilities or loss in relation to such. We do not guarantee any specific flight schedule and do not accept liability for lack of adequate connections, delays or airline schedule changes. Advisor assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveller that may result from any act or omission on the part of others; Advisor assumes no responsibility or liability for personal property; and Advisor shall be relieved of any obligations under these terms and conditions in the event of any strike, labour dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Advisor accepts no responsibility for lost or stolen items. Advisor reserves the right to refuse any traveller or potential traveller at its sole discretion. By making a booking with Me Time Holidays & Travel you accept these terms and conditions.

Assumption of Risk/Waiver

Client is aware that travel to such areas as traveler is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Me Time Holidays & Travel and its employees members, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical exertion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Client understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, traveller is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Client hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Me Time Holidays & Travel and agrees to and shall hold harmless and fully release Me Time Holidays & Travel its employees, members, agents, and assigns (together Advisor) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of Advisor and traveler hereby covenant not to sue Advisor for any such claims or join any lawsuit or action that is suing Advisor. This agreement also binds your heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise

Indemnification

Client agrees to indemnify, hold harmless, and defend us, our affiliates, and our respective officers, directors, agents, employees, independent contractors, successors, and permitted assigns, from any and all claims, demands, losses, causes of action, damage, lawsuits, penalties, fines, costs, or expenses of actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorneys’ fees and costs incurred by us (“Losses”), arising out of, or relating to, a claim by any third-party claim involving: (a) breach of any of your representations, warranties, or covenants contained in this Service Agreement; (b) failure by any traveller under this Agreement to comply with any applicable federal, state or local laws, regulations, or codes; (c) any claims arising out of a traveller’s participation in the travel or Travel Experiences arranged and Services rendered under this Agreement. We shall give prompt written notice to you (a "Claim Notice") after obtaining knowledge of any Losses or discovery of facts on which we intend to base a request for indemnification and provide you with reasonable cooperation and assistance as you may request in the defense of such suit. Notwithstanding anything to the contrary in this Section, we may select our own legal counsel to represent our interests, and you shall: (a) reimburse us for our costs and attorneys' fees immediately upon request as they are incurred; and (b) remain responsible to us any Losses indemnified.

Agency Disclaimer

Me Time Holidays & Travel, an independently owned and operated travel agent, acts solely as a general booking agent on behalf of the customer, for the purpose of processing bookings and reservations with various travel suppliers and operators. Me Time Holidays & Travel has no control over travel suppliers, the fares charged for services, their policies and procedures, changes in itineraries, the scheduling of their services, or their methods of providing services. Therefore, Me Time Holidays & Travel shall not be liable or responsible, and is released of responsibility and liability, for any and all inconvenience, loss or damage for personal or property injury, to any passenger resulting from breach of contract or any acts or omissions on the part of any travel supplier, cancellation of any service by a travel supplier, any refund due from a travel supplier, any terrorist activities, civil or labour unrest, mechanical or construction defects or failures, diseases, local laws, climatic conditions, or any other cause. It is important that you and all members of the travelling party are aware of important terms & conditions as they relate to the bookings held by our office on your behalf.

Electronic Signature and Acceptance

The signing of this Agreement via electronic method will be considered legal and binding.
