Terms & Conditions

By booking your travel plan with Aqua & Earth Travel, you are agreeing to be bound by the terms of this agreement and any additional terms and conditions of any supplier that apply to your booking arrangements/travel plan. The lead passenger assumes the responsibility of sharing these terms and conditions with each passenger in their household or group, including payment of all amounts when due. It is the responsibility of each passenger to read the terms and conditions in its entirety. In addition, we reserve the right to modify these Terms and Conditions. If there is any part of these terms and conditions that you do not agree with, please do not use our travel planning services.

Planning any vacation takes extensive time and effort before the departure date ever arrives as well as continued support for a booked travel plan. We have a travel consultation rate structure to cover these services. You will be advised of our consulting fee for your travel plan and it will be charged before the delivery of your proposal. The consulting fees are nonrefundable and shall be paid by the lead passenger regardless of whether a client books a trip with us.

Modifications: you are allowed up to 3 modifications for quotes before deposit must be made to secure your reservation. All requests for modifications or cancellations must be given in writing via email to Aqua & Earth Travel.

All deposits and payments are subject to the payment and refund policies of the supplier. Cancellations, change in traveler name or other alterations to your travel plan may be NON-REFUNDABLE in whole or in part, SUBJECT TO ADDITIONAL FEES, or other costs or obligations of the lead passenger and should be made only after sufficient research into the consequences of said cancellation and/or change. All changes and cancellations must be done in writing and sent via email to Aqua & Earth Travel. Travelers are also subject to additional fees assessed by Aqua & Earth Travel for said travel plan alterations or cancellations and will be due prior to confirmation of those alterations or cancellations. NOTE: Failure to make any payment according to the payment schedule timeline may be considered a cancellation and or alteration and the amounts paid to that point may be deemed non-refundable in full or in part or your travel plan cancelled. It is imperative that the lead passenger make certain that all payments are made timely and in full as required by your travel plan payment schedule and is governed entirely by the terms and conditions of the supplier and/or Aqua & Earth Travel. Once a reservation is cancelled it can not be reversed.

Credit Cards: While we do accept major credit cards including Visa, Mastercard, American Express and Discover, the lead passenger must provide us a signed Credit Card Authorization agreement for your travel plan—and will be valid for each transaction associated with your trip. Your authorization is a binding agreement for us to charge your card, and as such, you waive any right to a chargeback in the case of cancellation for any cause (excepting fraud), including a force majeure event, as defined herein. Further, you agree to refund policies and procedures as outlined in these terms and conditions as well as those refund policies and procedures of each supplier associated with your travel plan. In the event a client attempts to chargeback, reverse, or recollect a travel plan payment, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney fees to enforce said payment owed to Aqua & Earth Travel and/or any supplier associated with your travel plan. Checks, Cash, and/or Direct Deposits are not accepted.

“Force majeure” clauses shall be enforced by Aqua & Earth Travel as well as by each supplier associated with your travel plan. Any circumstances beyond our reasonable control, (including, but without limitation, to acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, sickness, epidemics, pandemics, quarantines, government intervention, weather conditions, defects in machinery and vehicles, delays or other unforeseeable event), that affect your travel plan negatively shall not be deemed to put Aqua & Earth Travel in breach of these terms and conditions nor other contractual obligation to assist with your travel plan, shall not mandate that any refund, by reason of delay in performance, or by non-performance, of any of our obligations hereunder to the extent that any such delay or non-performance is due to any force majeure. If our agency, and/or any of our travel suppliers, are affected by force majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to your trip.

Client responsibility: It is the sole responsibility of the client and all travelers to ensure they have all necessary travel documents, meet entry requirements for their destinations or passthroughs, secure any vaccinations needed for entry, and know your health risks for travel. This includes, but is not limited to, obtaining passports, completing entry forms, and understanding arrival/departure flight and luggage regulations, or vaccinations requirements. Aqua & Earth Travel cannot be held accountable for knowing or providing information on entry requirements for every destination. Travelers must independently verify and fulfill these requirements, whether they are staying in or just passing through a country. Client is also responsible for arriving at airports, cruise ports, train stations, excursion, hotel, transfer, and any other reservation at the appropriate times. If you miss your allotted time of arrival, you, the client are responsible.

Cancellation Policy: Aqua & Earth Travel understands that plans can change unexpectedly. In the event you need to cancel your trip, a cancellation fee of $150 per person will be applied to the credit card on file regardless of the number of days prior to departure. This fee is non-refundable. Please be aware that additional fees may be imposed by all suppliers, such as but not limited to airlines, hotels, and tour operators. Most deposits to suppliers are non-refundable.

Travel Insurance: We highly recommend purchasing travel insurance to protect against unforeseen circumstances. The travel client is subject to the terms and conditions including insurance coverage terms of said travel insurance. Aqua & Earth Travel is not responsible for the enforcement of said travel insurance and travel clients should do independent due diligence when obtaining said insurance, in eluding reviewing the instances for which the insurance will cover altered or cancelled travel costs.

Your data: will never be sold but will be given to our suppliers as needed to secure your travel arrangements. Your data will be held as securely as possible and never shared with other travelers even in your party other than your name as necessary.

Disputes: should be handled in a professional manner and discussed directly with your travel advisor. We will do our best to help you with your situation should one arise but can not be held responsible for the actions or inactions of any supplier of travel services or negligence on behalf of the client.

Acknowledgement

As lead passenger of this travel plan coordinated by Aqua & Earth Travel - I hereby acknowledge and accept the terms and conditions as set forth above and agree to abide by the terms and conditions set forth by any travel supplier (including but not limited to airline, rental, excursion, accommodation, tour, resort and any other associated with my travel plan) on behalf of all passengers in the travel group. I accept responsibility for timely and complete payment of all fees due to said suppliers on behalf of all passengers in the travel group. I acknowledge and accept that any refund that may be due to any passenger shall be provided to the passenger whose name the refund is attributable to regardless of source of payment. Aqua & Earth Travel is NOT responsible to reallocate any refunds according to payment source. By signing you are also stating that all of the information in this form is true and accurate.
