Southwest Adventure Tours Terms and Conditions

PAYMENTS: 50% of the balance is due 60 days prior to departure. The remaining balance is due 35 days prior to departure of the tour. The prices for this tour are quoted as cash prices. Our preferred method of payment is: company check, cash, electronic or wire transfer. There will be a 5% handling fee on any other form of payment.

TOUR SALES UPDATES & ROOMING LIST: Regular updates on actual sales are required at 270, 180, 120 and 90 days prior to departure. Please send the initial rooming list at least 90 days prior to departure. A final rooming list is due no later than 45 days prior to departure.

ADJUSTMENT TO PRICE: Due to the nature of booking tours many months in advance, tour elements such as hotels, activities, meals and attractions are subject to changes out of the control of Southwest Adventure Tours. If any supplier should become unavailable, Southwest Adventure Tours will find an equitable alternative. Southwest Adventure Tours does reserve the right to adjust the prices in the event of any unforeseen cost increases such as increased government fees, taxes, fuel cost, etc. Also, if the number of paid passengers falls below the minimum number quoted, Southwest Adventure Tours reserves the right to adjust the price accordingly.

HOTEL LIST: Once all hotel accommodations are secured, Southwest Adventure Tours will send a written confirmation. Hotels are subject to change prior to receiving the written confirmation.

CANCELLATION POLICIES: Tour Cancellation: If the complete tour is cancelled 90 - 45 days prior to departure, any non-refundable costs paid to suppliers and vendors will be forfeited. If the complete tour is cancelled less than 45 days prior to departure, all payments made by the client are non-refundable. Individual Cancellations: Individual passenger reservations cancelled up to 45 days prior to departure, are 100% refundable. No refunds for cancellations within 45 days of departure. Page 5 of 20 Acts of God: In the event that a tour is affected by an act of God such as a natural disaster including fire, flood, weather, earthquakes, etc., or man-made disasters such as government shutdowns or unrest, hostilities, war or civil unrest, Southwest Adventure Tours may, at its sole discretion, agree to other refunds which will come in the form of credits that may be applied to future tours with Southwest Adventure Tours. These credits must be applied within 24 months of cancellation. *If the client does not comply with the above payment and cancellation policies, Southwest Adventure Tours reserves the right to cancel the tour and retain any or all prior payments.

GRATUTIES: We would like to remind you that Guide Gratuity is not included with the cost of the tour. It is recommended to tip your guides $20-$25 a day, per person. SPECIAL NEEDS: The client acknowledges that it is responsible to identify all special physical requirements of any individual passenger. Southwest Adventure Tours disclaims any obligation to provide individual assistance with mobility, eating, daily care or any other personal matters. Disabilities requiring special equipment or attention must be reported to Southwest Adventure Tours at the time of booking. Southwest Adventure Tours will make a reasonable effort to accommodate any special needs but is not responsible for any denial of services by independent suppliers such as hotels, restaurants, outfitters and transportation. If special assistance is needed, passengers must be accompanied by a qualified companion. Tour passengers should understand that this tour may include activities that are beyond their physical capabilities.

GOVERNING LAW: This agreement shall be governed by the laws of the State of Utah.

LIABILITY: Southwest Adventure Tours liability is strictly limited and not responsible for any act or omission beyond its control including but not limited to damages, injury, loss, delay, irregularity or accident. This includes without limitation any negligent or willful act, or failure to act, or breach of contract by, any person or company supplying services pursuant to this agreement. All such parties are independent contractors. Southwest Adventure Tours is the client’s agent and is not the agent for any party acting as a supplier of services. Southwest Adventure Tours is not responsible for any loss or added expense due to delays, accommodation changes, mechanical breakdowns or the loss or damage to luggage due to the negligence of third party suppliers. Southwest Adventure Tours is not responsible for acts of God, lack of medical care, sickness, weather conditions, acts of terrorism, or any other event beyond our control.
