Brendan Vacations Terms & Conditions

 Your agreement is with Brendan and a contract is formed when you make a reservation with us that we accept. Enrollment in and payment for a guided vacation/holiday shall constitute acceptance by the guest of the terms and conditions in this document. These cannot be varied except in writing by an officer of the Company.

All contracts with Brendan are made subject to the terms of these booking conditions. 

We reserve the right to change these booking conditions at any time prior to you making a booking.

The invalidity of any provisions herein shall not affect the validity of any other provisions. The agreement shall be construed as though the invalid provision was not contained herein and was replaced with an enforceable provision as similar as possible to the original provision. Should any conflict arise between these booking conditions and those contained within our brochures, these booking conditions shall prevail.

DEPARTURE DATE

The departure date is the date indicated on the booking confirmation. 

SECURITY 

Security is a major concern to all of us and the situation globally is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. You must accept these risks involved in travel to any country that may experience security difficulties and accept responsibility for your own travel decisions. You are urged to consult with government sources, including the United States Department of State, news sources as well as your Travel Agent prior to making your travel plans.

TRAVEL INSURANCE

We highly recommend that all guests have travel insurance, meeting the minimum levels listed below, that includes trip interruption, trip delay & medical expense coverage resulting from illness related to a pandemic event, such as COVID-19, and any medically-imposed quarantine such as could result from a guest in the group contracting COVID-19, covering all applicable dates of travel with Brendan Vacations. You are not required to purchase your insurance from Brendan Vacations. The choice of insurer is yours. View our travel insurance options here:

COVERAGE SHOULD BE AT LEAST THE FOLLOWING AMOUNTS: 

Trip Interruption: Cost of the trip (excluding air)

Trip Delay: $150/day, $750 total per person

Emergency Evacuation/Repatriation: $100,000 per person

Medical Expense: $25,000 per person

Most travel insurers require you to purchase your coverage within a certain time of making your initial deposit/payment. Guests are advised to research and purchase insurance as soon as possible after making the deposit/payment. 

You are welcome to choose any travel insurance product that meets or exceeds the requirements above. We will ask you to provide Brendan with information regarding your insurance policy prior to final payment being due.

No policy covers every risk. Coverages, conditions, exclusions and limitations under each policy differ. The minimum amounts listed above may not cover all your costs. You will be responsible for costs in excess of coverage amounts and for all costs if coverage does not apply. We encourage you to research your choices for a policy best suited to your circumstances. Should you choose to travel on Brendan without the required travel insurance, you will need to declare this option when you complete your trip registration.

COVID-19 

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the WHO senior citizens and guests with underlying medical conditions are especially vulnerable. 

We ask that you please take personal responsibility for your wellbeing. This begins with packing any personal protective equipment and sanitisers you require. Please adopt physical distancing and hygiene practices throughout your pre-trip travel arrangements and follow all health instructions whether physical signage, or requests from our professional staff, once you are holidaying with us. To travel with Brendan, you voluntarily assume all risks related to exposure to COVID-19. Full details of hygiene protocols can be found on our website.

WHAT’S NOT INCLUDED IN THE TRIP

Excess baggage

Lunches and meals other than specified

Expenses of personal nature and incidentals at the hotels

Transportation, sightseeing and admissions other than specified

Tips and gratuities ($5 USD, or Euro equivalent, per day per person suggested for Travel Director, $3 USD per day per person for Coach Drive and $2 USD per person for a Local Expert)

Brendan Vacations’ Travel Protection Plan is not included and can be purchased for an additional charge, please inquire for details.

RESERVATIONS

We require a minimum of 9 guests in order to operate a custom group. If the group does not have at least 9 guests booked 120 days prior to departure we reserve the right to cancel your departure. Alternatively we will reprice the booking as a Private Chauffeur trip. Different booking conditions will apply. A refundable $500 USD group deposit is required within 14 days of receiving the offer. If after 14 days deposit is not received, your vacation must be repriced on current rates of exchange. Please note that this deposit will be applied to final costs. If currency fluctuates more than 5%, Brendan reserves the right at any time (including after initial deposit) to amend the quotation or charge a surcharge to the booking as needed. If there are major itinerary changes after the initial deposit, the currency rate may be subject to change. It is important that you stress this to your clients in the even that additional monies need to be collected. Additional air/hotel/charter deposits may be required to hold space and will be advised at time of proposal. 95 days prior to departure, we require a non-refundable deposit of USD $200 per person. 65 days prior to the group’s departure date we require final payment for all services.

Payment: Brendan Vacations accepts payments made in the form of checks, money orders, American Express, MasterCard, Visa or Discover Card. Credit card payments are accepted on an individual’s credit card for the GROSS amount authorized by the travel agent. In the event of a cancellation by the individual, penalties will be figured on the NET tour cost. Brendan will credit the difference between the net penalty and the net cost back to the client’s credit card as it is in the original form of payment. If the agency chooses to charge additional fees of any kind, they agree to act as the merchant for all received customer payments.

TENTATIVE EARLY QUOTE

Quotes made through November of the year prior to the year of operation of the custom tour are 

tentative. These quotes are based on the current year’s supplier pricing and are subject to change for the year of operation. Any quotes requested through October of the previous year will automatically be repriced in November with final supplier prices and up to date rates of exchange.

AIR

Air is covered under a separate agreement. Air arrangements will not be made until the land deposit is received and requires an additional deposit per person. The group air deposit is due within 7 days of receiving an air confirmation. Specific airline terms and conditions will be provided at the time air space is booked as each airline has their own policies and procedures.

Airport Transfers: A group transfer will be provided as long as the group arrives and departs on the start and end dates of the tour on the same flight. One group transfer per coach is included in the price quoted. If requested, additional airport transfers (group or private) can be included in the cost of your customized guided vacation. Passengers deviating from the group flight will be required to make their own arrangements. Please note there will be no reduction or refund from the price for any unused segments. If Brendan Vacations is not providing the air for your group, please provide the flight information in writing 65 days prior to departure.

TRAVEL E-DOCUMENTS

Travel e-documents will be sent to you approximately 21 days prior to tour start date (providing full payment has been received). If your group is leaving earlier, please ask your Groups Specialist to request your travel documents in good time.

CANCELLATION POLICY

In the event the entire group is canceled after a deposit has been received, up to 120 days prior to departure the initial Group deposit of $500 will be refundable.

For individual cancellations, the penalties are as follows:

65+ days: $200 per person deposit

64 – 31 days: 30% land cancellation penalty

30 – 15 days: 50% land cancellation penalty

14 – 0 days: 100% land cancellation penalty

If passenger cancellation causes the rest of the group to drop to a higher price bracket and final payment has been received, 100% land cancellation penalty may apply or the entire group will be re-invoiced based on the new passenger count.

Additional cancellation penalties may apply based on special inclusions and individual hotel policies.

No penalty for name changes unless air arrangements are involved up until 65 days prior to departure or prior to final payment being received.

Group packages that include airline tickets are subject to penalties in accordance with the airline’s own terms and conditions applicable to the airfare. These penalties are in addition to any land penalties incurred.

Individual purchase of Travel Protection Plan is non-refundable and may affect the amount and type of penalty and/or refund if individual cancels within penalty period.

GENERAL INFORMATION AND CONDITIONS 

Trip Prices: Prices are per person in US Dollars and are net (i.e., non-commissionable). Unless otherwise stated the trip (including Vacation Host) is priced in twin share.

Single and Triple Room Request: Brendan Vacations reserves the right to limit the number of single and triple (if available) rooms per group and are usually based on a maximum of six single rooms.

Coach: A standard coach will hold 49 guests. If your group requires more than one coach, the guests will be billed based on the number of total guests PER COACH and not the number of guests in the group (e.g. group size of 60 people = 30 guests per coach, billed at appropriate 30 rate).

Hotel Accommodations: All accommodations are subject to availability at time of booking and no accommodations will be reserved until group deposit has been received. If the group stays in any city during a major trade fair, holiday or peak travel season, accommodations may be very difficult to secure. In this case, we reserve the right to accommodate the group outside of the city and the price of accommodations will reflect peak demand. 

Passport and Visas: Each guest is responsible for having a passport that is valid for at least 6 months beyond the conclusion of their trip; all necessary visas and permits; and they must comply with entry, health or other requirements of the countries visited. Some of our vacations enter a country more than once; therefore multiple-entry visas may be required for some countries. The Operators and/or their employees and their agents are not responsible for passport, visa requirements, entry, health or other requirements of the countries visited or for any loss sustained by guests for failing to comply with laws, regulations, orders and/or requirements of countries visited.

Change Fee: Upon confirmation of arrangements, any voluntary change in any component of the itinerary may result in a $50 per person fee (airline penalties and fees, if applicable, will be additional).
