I understand that Joel Cartagena and JCC Travels LLC are not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold Joel Cartagena or JCC Travels LLC responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.
I accept that Joel Cartagena and JCC Travels LLC are not responsible for, nor will I attempt to hold either of them liable for any injury, damage or loss I may suffer on the account of any conditions, actions or omissions that are beyond reasonable control. I agree that this disclaimer includes the entire traveling party and that in the event of any disputes; they may only be litigated in the state of Nevada, Clark County, with a maximum penalty not to exceed the total earned by Joel Cartagena or JCC Travels LLC in the original transaction.
I will review my travel documents for accuracy upon receipt and understand that I may contact JCC Travels LLC if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money. Conversely, cancellation of any aspect of my travel arrangements may result in financial penalties, in accordance with the supplier’s cancellation policies.
I have been advised to use a form of payment other than cash or check that may offer me the opportunity to dispute the charge should a vendor cease operating.
Privacy Notice (TSA Update: August 13, 2009): The Transportation Security Administration (TSA) requires you to provide your full name, date of birth, and gender for the purpose of watch list screening, under the authority of 49 U.S.C section 114, the Intelligence reform and Terrorism prevention Act of 2004 and 49 C.F.F parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth and gender may result in denial of transport or denial of authority to enter the boarding area. I understand that the Transportation Security Administration requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on my identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.
JCC Travels LLC is not responsible for issuance of travel identifications such as passports and/or visas and travelers should ensure they have or have been approved for the appropriate documents before purchasing travel.
I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas.
NOTE TO CLIENT: Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov. Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov.
I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by JCC Travels LLC to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize JCC Travels LLC to charge payment for such additional amounts after I have been notified of pricing change.
In some locations, your aircraft may be subject to insecticide spraying prior to the flight or while you are on the aircraft, you are strongly encouraged to always check the list of countries that require airlines to treat the passenger cabin with insecticides http://alturl.com/3rtty as this list is updated regularly.
I understand travel insurance has been offered to me for purchase to cover certain risks inherent in travel such as supplier bankruptcy, trip interruption and/or the inability to travel due to a medical or personal emergency. If I choose not to purchase travel insurance or if I purchase travel insurance on my own (not through JCC Travels LLC), I understand that JCC Travels LLC requires that I confirm or decline insurance in writing.
This is to confirm that, in keeping with all applicable laws, I am instructing the above agent to purchase travel and/or travel insurance against the form of payment verbally instructed.
I further understand that I have authorized this transaction and will hold Joel Cartagena and the JCC Travels LLC agency harmless with respect to these instructions. It is understood that the above agency may request government issued photo identification and may verify the billing address of the card.
Travel to certain destinations may involve greater risk than others. JCC Travels urges you to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at https://travel.state.gov/content/travel.html, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID-19 requirements or other required immunizations or health insurance, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, JCC Travels will not be liable for damages or losses that result from travel to such destinations. It is your responsibility to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. When traveling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. Air travelers with identification (ID) that does not meet the REAL ID ACT requirements will have to use alternate ID forms (passport, military ID, or permanent resident card) to pass TSA security checkpoints—even for domestic travel. Visas are required when they apply. You can find out if your international destination requires a visa at https://www.usa.gov/visas-citizens-traveling-abroad. JCC Travels strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Failure to carry appropriate health insurance coverage may result in the delay or denial of necessary medical treatment during the Trip. If you have health insurance and have a valid insurance identity card, you should carry proof of the same during the Trip. Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/. In addition, certain countries restrict travelers with criminal convictions, even if expunged. Please inform us prior to booking with us if this applies to you and seek separate legal counsel to confirm your ability to travel to your desired destination. If you are denied access to a country or a Vendor due to a conviction, JCC Travels shall not be liable for any losses, expenses, or refunds to you or anyone in your group.
You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss flight(s), and subsequent scheduled travel bookings trips. JCC Travels bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damage, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
To the fullest extent provided by law, you agree to and shall indemnify and hold harmless JCC Travels and its Representatives from any expenses, losses, liabilities, damages, judgments, settlements and costs, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) your breach or violation, or threatened breach or violation, of these Terms and Conditions; (ii) any of your acts or omissions, including any damage caused by you to persons or property while participating in the Event, (iii) any force majeure or inherent risk of travel; or (iv) claims brought by third parties in connection with any of the foregoing.
You are aware that the travel you are undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: force majeure, motor and conveyance vehicle collisions, water related activities, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, or JCC Travels; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places, including where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, illnesses caused by COVID-19 (or other pandemics, diseases, viruses, etc.), physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.
You understand that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip and in consideration of the Event services provided by JCC Travels, you are willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. You hereby accepts and assumes full responsibility for any and all risks in connection with your travel and agrees to and shall hold harmless and fully release JCC Travels, and its employees, shareholders, agents, and representatives (“Representatives”)from any and all claims associated with the trip, including any claims of third party negligence, and you hereby release and covenant not to sue JCC Travels or its Representatives for any such claims or join any lawsuit or action that is suing JCC Travels. These Terms and Conditions also bind your heirs, successors, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, as well as the Exclusion on Liability and Indemnification provisions above, shall survive any termination or cancellation of these Terms and Condition
