Fun Luv’n Travel – Terms & Conditions

Fun Luv’n Travel (“we,” “us,” “our”) is an independent travel agency and an Independent Affiliate of Flip Flop Travel Group (FFTG).
All bookings are also governed by FFTG’s Terms & Conditions, which are incorporated here by reference.

1. Agency Role

Fun Luv’n Travel acts solely as a travel advisor and booking agent. We research, recommend, and arrange travel through third-party suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, and insurance providers. We do not own, operate, or control these suppliers, and we are not responsible for their acts, errors, omissions, or service changes. Your travel contract is directly with the supplier, and their terms and conditions apply.

2. Client Responsibilities

You agree to:

  • Provide accurate and complete traveler details, including names as they appear on passports, dates of birth, and contact information.
  • Review all confirmations and invoices within 48 hours of receipt and notify us of any errors immediately.
  • Meet all deadlines for deposits, payments, and requested information.
  • Verify and comply with all entry/exit requirements, including passports, visas, vaccinations, and health protocols.
  • Review travel advisories published by the U.S. State Department and Centers for Disease Control and Prevention (CDC).
  • Disclose any health or mobility limitations in advance.

3. Booking & Pricing

  • Deposits may be required to secure a reservation and may be non-refundable.
  • Final payments must be made by the supplier’s deadline.
  • Prices are not guaranteed until confirmed by the supplier and may change due to taxes, fees, surcharges, or currency fluctuations.
  • Optional charges such as resort fees, gratuities, baggage fees, seat assignments, and excursions are not included unless specifically stated.

4. Credit Card Authorization & Payments

  • By providing a credit card, you authorize Fun Luv’n Travel, FFTG, and suppliers to charge deposits, balances, service fees, and other agreed amounts.
  • The cardholder is responsible for payment for all travelers included in the booking.
  • Credit card authorizations are specific to the exact amount approved at the time of signing. Because travel costs may change (including supplier modifications, added services, or itinerary adjustments), a new authorization is required each time the total changes.
  • Our booking system (Tern) automatically clears prior authorizations when changes occur and requires a new signed authorization before any further payments can be processed.
  • You agree not to initiate a chargeback on properly disclosed non-refundable charges. Any disputes must first be addressed with us and the supplier. Improper or fraudulent chargebacks may result in legal action to recover funds, fees, and costs.

5. Travel Insurance

  • Comprehensive travel insurance is strongly recommended. Coverage may include trip cancellation, interruption, medical expenses, evacuation, baggage loss, and supplier default.
  • If you decline insurance, you may be asked to sign a waiver.
  • By declining coverage, you assume full responsibility for any losses, including 100% of trip costs, medical expenses, evacuation, or repatriation.

6. Supplier Terms

All bookings are subject to the terms and conditions of the suppliers involved. Supplier rules govern matters such as cancellation, refunds, baggage, check-in, boarding, documentation, and conduct. It is your responsibility to review and comply with supplier terms.

7. Cancellations & Refunds

  • All cancellation requests must be submitted in writing.
  • Refunds and penalties are determined solely by supplier policies. Many deposits and payments are non-refundable.
  • Fun Luv’n Travel’s service or administrative fees are non-refundable once services are provided.
  • Refund timelines are controlled by suppliers and may take weeks or months.

8. Health, Safety & Fitness to Travel

  • You are responsible for determining your fitness to travel.
  • Suppliers may deny boarding or service for health, safety, intoxication, or misconduct reasons. Costs incurred as a result are your responsibility.
  • You must comply with any health protocols in place at the time of travel.

9. Force Majeure / Public Health Events

Fun Luv’n Travel is not responsible for events beyond our control, including weather, natural disasters, government actions, pandemics, epidemics, border closures, strikes, terrorism, or war. Remedies, if any, are those provided by the supplier and/or your insurer.

10. Limitation of Liability

  • To the fullest extent permitted by law, our total liability for any claim related to your booking shall not exceed the commission or service fees we earned for that booking.
  • We are not liable for indirect, incidental, consequential, or punitive damages.
  • You assume all inherent risks of travel, including illness, injury, delays, natural disasters, political unrest, and supplier insolvency.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fun Luv’n Travel, FFTG, and affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

  • Your breach of these Terms or supplier rules.
  • Your violation of laws or regulations.
  • Acts or omissions by you or your traveling party, including improper chargebacks.

12. Group Bookings

For group reservations, the designated group leader is responsible for ensuring compliance with payment schedules and supplier rules. Fun Luv’n Travel is not responsible for disputes between group members regarding payments or arrangements.

13. Privacy & Data Security

  • Personal information is used only for travel planning, booking, and related communications.
  • We comply with applicable privacy laws and process payments in accordance with PCI DSS standards.
  • While reasonable safeguards are in place, no system is entirely secure. Liability for data breaches is limited to direct damages only.

14. Dispute Resolution & Governing Law

  • Any disputes with Fun Luv’n Travel shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in the State of Ohio, unless otherwise agreed in writing.
  • Claims must be brought individually and not as part of a class action.
  • These Terms are governed by the laws of the State of Ohio.

15. Acceptance of Terms

By approving a proposal, submitting payment, or checking the “I agree” box, you acknowledge and accept these Terms and Conditions as well as FFTG’s Terms and Conditions. If you do not agree, you should not proceed with booking.

Fun Luv’n Travel reserves the right to update or modify these Terms & Conditions at any time. Updated Terms will be effective immediately upon posting or distribution and will apply to all new bookings made after the date of posting. It is your responsibility to review the most current version before booking.
